RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME ACCEPTING
WITHDRAWAL OF BID OF BAY PACIFIC CONSTRUCTION COMPANY AND
AWARDING CONTRACT TO MCGUIRE AND HESTER CONSTRUCTION COMPANY
FOR ROLLINS ROAD SANITARY SEWER UPGRADE, PIPELINE AND PUMP STATION

RESOLVED, by the City Council of the City of Burlingame:
WHEREAS, the City duly noticed and advertised for bids for the upgrade of the pipeline and
pump system at the Rollins Road Sanitary Sewer Pump Station and received a total of 5 bids for the
project on August 10, 2000; and
WHEREAS, the lowest apparent bidder, Bay Pacific Construction Company, has asked that
it be allowed to withdraw it bid because of calculation and clerical errors in submitting the bid; and
WHEREAS, the second lowest responsible bidder, McGuire and Hester Construction
Company has the experience to perform the work and its bid is reasonable in light of the work to be
done; and
WHEREAS, it does not appear that re -bidding of this project would save the City any
money nor would it likely result in a faster project,
NOW, THEREFORE, IT IS FOUND, DETERMINED AND ORDERED:
1. The request by Bay Pacific Construction Company. to be allowed to withdraw its bid is
approved.
2. The bid submitted by McGuire and Hester Construction Company is accepted.
3. The City Manager is authorized and directed to execute the Agreement attached as
Exhibit A hereto for Project 9853/9947 by and on behalf of the City.
4. The City Clerk is authorized and requested to witness the signature of the Manager.

resolution was introduced at a regular meeting of the City Council held on the 5th day of September
and was adopted thereafter by the following vote:
