RE: APPEAL FOR THE DENIAL OF REQUEST TO REMOVE 15 TO 20 FEET (MORE
THAN 1/3) FROM THE TOP OF A PRIVATE REDWOOD TREE AT 13
BANCROFT ROAD
At its regular meeting of June 6, 1996, the Burlingame
Beautification Commission received your appeal for the denial of
your request to remove 15 to 20 feet from the top of a Redwood tree
on your property. Because of the July 4th holiday, the Commission
will not be able to review this matter until their August 1
meeting.
The Commission meets at 5:30 p.m. in Conference Room "A11 at City
Hall should you wish to attend.

RE: TREE REMOVAL REQUEST - 13 BANCROFT ROAD
The tree in question is a 38" dbh redwood approximately 60+ feet in height, located in the front
yard at 13 Bancroft Road.
Mr. Arbues submitted an application for Asplundh Tree Company to prune the tree, but stated
that the work would not involve the removal of more than 1 /3 of the crown: As you are aware, a
permit would not be required for such work. However, Steve Porter, our Tree Supervisor, met
on site with Nili Niu, a representative of the Asplundh Tree Company, and was informed that they
proposed to top the tree below the secondary power lines. This procedure would remove nearly
1/2 the height of the tree and would cause it severe damage. The tree is in need of maintenance,
but the work needed would not fall under our permit requirements. An application that
specifically stated the extent of the "pruning", or requested removal, would allow comment from
neighboring properties: The application as submitted did not give me any basis to make the
necessary findings to process it. On that basis I denied the permit and informed Mr. Arbues of his
appeal rights.

Dear Mr. Arbues:
I am denying your request for pruning of the redwood tree at the above address. Our Tree
Supervisor, Steve Porter, spoke with a representative from the Asplundh Tree Company and was
informed that they proposed to top the tree below the secondary lines (nearly 1/2 the height of the
tree). This procedure would severely damage the tree.
�- As you know, pruning of less than 1/3 of the crown of the tree does not require a permit.
Asplundh Tree Company is also aware of this provision, and can perform any work that does not
exceed that amount.
You can appeal this decision to the Beautification Commission, care of this department. A
written appeal must be received by May 15, 1996. Please enclose a photograph of the tree with
the appeal. A letter from Asplund Tree Company describing the work to be done, and the need
for it would also help the Commission in deciding this matter.

To whom it may concern,
This letter is to request permission to keep a White Birch tree in
front of my property which was planted several months ago. The tree
is approximately two years old. Mr. William Ward came out to inspect
the tree and informed me that he would check with the Commission
and let me know.
There are several White Birch trees within the area and I didn't
expect that it would cause a problem. Apparently this tree is not on
your approved listing of trees and is therefore the reason that I'm
writing to request your approval to leave the tree in its current place.
In the future I would like to plant two additional city approved trees
in front of my property and would like to request permission at this
time to do so.

Dear Mr. Arbues:
At its regular meeting of August 1, 1996, the Burlingame
Beautification Commission denied your appeal regarding the 38" dbh
redwood tree at the above address due to discrepancies in the
permit application. Specifically, they noted that the extent of
work requested on the application would not require a permit, yet
the work proposed by Asplundh Tree Company would. Further, your
appeal letter describes the tree as being 120' to 150' in height,
when it is in fact about half that.
Several Commissioners agreed that the tree needs maintenance and
acknowledged your concerns, but felt they had no basis to act
without a permit application that accurately reflects the extent of
the work proposed.
As you were informed in a letter dated 4-29-96, you may prune up to
1/3 of the crown of the tree without a permit. In a subsequent
conversation with Mr. Maravigli of P.G.& E., he told me that he
would ask Asplundh to do whatever work could be done within the
requirments of the Ordinance that would not require a permit: I
agreed that would resolve the matter, but to date nothing further
has been done. If that proposal is not satisfactory, you should
file a new application that specifically states the extent of the
work to be done to this tree.
The decision of the Beautification Commission can be appealed to
the City Council in writing before their meeting of September 3,
1996.

Dear Mr. Beucus:
At its regular meeting of August 1, 1996, the Burlingame
Beautification Commission voted to deny your request to approve the
unauthorized planting of 1 Birch tree in the City planter strip.
It has been determined that Birch trees do not do well and should
not be planted in narrow planter strips. Doing so makes them more
susceptible to infections caused by fungus. Additionally, should
this tree grow to maturity it will affect the sidewalk and the
City's water meter which is only a few feet away. This decision
may be appealed in writing to the City Council before their
regularly scheduled meeting of August 19, 1996.
The Birch tree should be removed by September 3, 1996. Please call
the Park Division at (415) 696-7245 if you have any questions or
wish to discuss your request to plant additional trees in the
City's planter strip. -

replacement requirements for a tree to be planted in the city
right-of-way. Due to the July 4th holiday, the Commission will
review this matter at their August 1 meeting. The Commission meets

TO WHOM IT MAY CONCERN:
MY NAME IS BOB JOHNSTON AND I AM THE OWNER BF THE PROPERTY OF 1133 KILLARNEY
LANE LOCATED IN BURLINGAME. LAST WINTER A TREE LOCATED ON MY FRONT LAWN
DIED AND WAS REMOVED BY THE CITY OF BURLINGAME. AT THE TIME I EXPLAINED
I WOULD BE LANDSCAPING SOON AND DID NOT WANT THE TREE REPLACED AS I WOULD
HAVE TO REMOVE THE TREE DURING THE PROJECT. THE PROJECT WAS DELAYED UNTIL
SPRING AS I NEEDED TO INSTALL A SUM -PUMP BUT THE CITY OF BURLINGAME WAS
REPLACING THE SIDEWALK IN THE AREA WHERE I NEEDED TO INSTALL THE PIPE FOR THE
PUMP. THE WEEK AFTER THE SIDEWALK WAS REPAIRED I BEGAN MY PROJECT. I HAVE
SPENT $450QO.00 WIDENING MY DRIVEWAY FROM ONE VEHICLE WIDTH TO TWO. I
HAVE ALSO PUT IN A WALKWAY (FOUR FEET WIDE) LEADING FROM THE SIDE OF MY
HOUSE TO THE SIDEWALK. THESE TWO CHANGES HAVE TAKEN TEN FEET OF WIDTH FROM
WHAT WAS ONCE MY FRONT LAWN. DUE TO THIS CHANGE A TREE INSTALLED ON MY
FRONT LAWN WOULD NOT CONFORM WITH THE SIZE OF THE LAWN AND WOULD NOT HAVE
A GOOD APPEARANCE AS IT WOULD BE MUCH TOO LARGE CONSIDERING THE NOW EXISTANT
SMALL LAWN. ]'I AM STILL. -IN THE PROCESS OF INSTALLING A SUM PUMP AND
LATER A SPRINLKER SYSTEM.
I PRESENTLY HAVE SEVERAL TREES IN FRONT AS WELL AS IN BACK OF MY HOME.
I INTEND TO PLANT ONE MORE LARGE TREE IN MY BACK YARD. HOWEVER: I DO NOT
DESIRE TO PLANT ANOTHER TREE IN MY FRONT LAWN.
I REQUEST YOU ALLOW ME TO COMPLETE MY PROJECT AND REFRAIN FROM PLANTING
ANOTHER TREE IN MY FRONT LAWN.
PLEASE ADVISE ME OF ANY HEARING (PRIOR TO THE HEARING) INVOLVING THIS ISSUE.

Burlingame Beautification Commission voted 6 - 1 to approve your
request that tree replacement requirements be waived on the City
right-of-way based on the following findings:
1) There is an existing private tree in the front yard.

decreased the planting area.
