HomeMy WebLinkAboutReso - CC - 081-2000RESOLUTION NO. 81-2000 RESOLUTION APPROVING CATEGORICAL EXEMPTION FLOOR AREA RATIO VARIANCE AND DESIGN REVIEW RESOLVED by the CITY COUNCIL of the City of Burlingame that: WHEREAS, a categorical exemption has been proposed and application has been made for a floor area ratio variance and design review for a first and second floor addition at 1701 Carmelita Avenue, zoned R-1 APN 026-166-010 Jeffrey M and Monica L Owens, property owners; WHEREAS, the Planning Commission held a public hearing on said application on June 12. 2000 at which time said application was denied; WHEREAS, this matter was appealed to City Council and a hearing thereon held on August 7. 2000 , at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing; NOW, THEREFORE, it is hereby RESOLVED and DETERMINED by this Council that: 1. On the basis of the Initial Study and the documents submitted and reviewed, and comments received and addressed by this commission, it is hereby found that there is no substantial evidence that the project set forth above will have a significant effect on the environment, and Categorical Exemption, per Article 19. Categorically Exempt per Section: 15303 - New Construction or Conversion of Small Structures Class 3 (a+e), Single-family residences not in conjunction with the building of two or more such units. In urbanized areas, up to three single-family residences may be constructed or converted under this exemption, is hereby approved. 2. Said floor area ratio variance and design review are approved, subject to the conditions set forth in Exhibit "A" attached hereto. Findings for such floor area ratio variance and design review are as set forth in the minutes and recording of said meeting. It is further directed that a certified copy of this resolution be recorded in the official records of the County of San Mateo. MAYOR I, ANN MUSSO, City Clerk of the City of Burlingame, do hereby certify that the foregoing resolution was introduced at a regular meeting of the City Council held on the 7th day of August , 2000, and adopted thereafter by the following vote: AYES: COUNCILMEMBERS: COFFEY, GALLIGAN, JANEY AND O'MAHONY NOES: COUNCILMEMBERS: SPINELLI ABSENT: COUNCILMEMBERS: NONE n W Ll 1 (�jCITY CLERK Conditions of approval for categorical exemption, floor area ratio variance, and design review. 1701 CARMELITA AVENUE effective AUGUST 7, 2000 1. that the project shall be built as shown on the plans submitted to the Planning Department date stamped May 19, 2000 Sheets A-1 through A-5, and that any changes to the footprint or floor area of the building shall require an amendment to this permit; 2. that the conditions of the City Engineer's and Chief Building Official's January 10, 2000 memos, shall be met; 3. that any changes to the size or envelope of the first or second floors, which would include adding or enlarging a dormer(s), expanding the footprint or floor area of the structure, moving or changing windows and architectural features or changing the roof height or pitch, shall be subject to design review; that the project shall meet all the requirements of the California Building and Fire Codes, 1998 edition, as amended by the City of Burlingame; that the shed and the concrete slab in the rear yard shall be removed prior to issuance of a building permit for the addition to the house; 6. that the rear yard be fully landscaped with grass and shrubs and that a plan be provided to protect all existing vegetation and approved by the city arborist before a building permit shall be issued and construction shall be stopped until the requirements of the approved plan are complied with or modifications reviewed and approved by the city arborist are installed and inspected; that the construction dumpster on the site be permanently hidden from view from the street or removed; 8. that no portion of the garage on this site shall be used to store tools, equipment or materials for any business owned by the home owner or home occupation on the site; and that the fence along the neighbor's driveway shall not exceed the maximum height or design requirements allowed by the city.
