As part of its denial motion, the Commission reduced the assessment by $100.88, the amount designated as labor cost for replanting. This ruling may be appealed in writing to the City Council. Please be aware that should you appeal, the Council may uphold the Commission's ruling, reinstate your waiver request, or reinstat the original assessments. Our most recent telephone conversation was with City Manager, Dennis Argyres regarding his May 21" letter. We had stated our questions and position in our May 18`h letter to him (see enclosure). We disagree with his conclusion that we should pay the invoice to replace the dead tree. He informed us that we could appeal his decision to the Beautification Commission. We will supply written confirmation, at your request, from several people regarding the condition of the tree prior to removal. We actually have saved the cost of a tree removal for the city. McGill 208 Bayswater Avenue Burlingame, CA 94010 RE: Tree Removal — 208 Bayswater I have reviewed your May 18, 1997, letter plus the four staff letters and invoice concerning the tree removal at 208 Bayswater. While I understand some of the confusion in this matter, the bottom line is that a city tree was illegally removed. In order to protect the public from such acts, we must request mitigation of the damage. Since replacement of the tree in front of your home is not possible because of the spacing requirements, payment of replacement cost has been proposed by staff. I believe this is a reasonable approach and consistent with prior decisions of the city. If this proposed settlement for damages is not acceptable, you may appeal this decision wi�) days of this letter to the Beautification Commission. The Beautification Commission is a group of citizens which oversee the city's tree ordinance. If you choose not to appeal, you must pay the $317.26 within 30 a (thirty) days or the city will commence collection processes. I'm sorry that you or your contractor did not understand the city's tree ordinances, but we must protect the public's interest. Sincerely, 0000 Dennis Argyres City Manager v c: Parks & Recreation Director May 18, 1997 Dennis Argyres, City Manager City of Burlingame, City Hall 501 Primrose Road Burlingame, CA 94010-2899 Re: Tree removal correspondence, 208 Bayswater Dear Mr. Argyres: We have received Parks and Recreation Department letters dated February 13th, 1997; March 6th, 1997; March 1 lth, 1997; and March 19th, 1997 in addition to the related invoice originally dated February 13th, 1997. We have several questions related to these letters which were written in reaction to our removal of a tree from the planting strip in front of our house. The first letter, sent with the invoice, explained "though the current spacing requirements prevent us from replacing a tree in front of your address, we are billing you for all costs related to the replacement of this tree with an equivalent specimen tree." This was disturbing to us since we felt it unjust to bill us for something that was not going to be done. There was no mention of a tree being planted. There was only mention that we were being billed for one. We didn't understand the reason for the invoice. We called the Parks and Recreation Department with our initial questions. We were told in our phone conversation with Parks and Recreation Director, Mr. Williams that we would be billed for costs related to the replacement of the removed tree, but that he was new to his position that he would drive by to assess the planting strip at 208 Bayswater and get back to us. His subsequent letter of 3-06-97 agrees that there is no room for another tree, and that it is "appropriate NOT to charge" us for the illegal removal of the tree. That same letter goes on to offend us by suggesting we may have been "willfully breaking the City Ordinance." We are new to Burlingame and can not possibly be fully aware of all local ordinances and requirements of law. We are outraged by his implication that we intentionally violated the law, and we feel the his comment was objectionable and unwarranted. We further believe that the City Arborist has misinterpreted the conversation he had with our contractor. A logical (though we now understand, unlawful) option was offered, to the City Arborist by our contractor, to replace the removed dead magnolia tree with a healthy 24" box magnolia. The Arborist declined the offer. We feel that our contractor was doing his best to take care of the Arborist's concerns. Our contractor is licensed, honest, reputable, and has a history of doing excellent work. We and our contractor deserve an apology. The letter closes with the mention of a "regular tree program." We are told that it is appropriate to ask us "to reimburse the City for the planting of a replacement tree somewhere in the City." Is the "regular tree program" different from the "street tree master plan?" Is there a copy available to the public? Again, we called Mr. Williams to clarify the reference to the "tree program." We were surprised that this program had not been explained to us earlier. We asked if there was another course of action we could take in resolving this situation without cost to us. Mr. Williams told us that he would review the issue with the City Attorney. The March 1 lth letter references that discussion but makes no specific reference to anything said by the City Attorney. The letter serves to further complicate the issue by adding that according to arborist (and contact on the invoice), Steve Porter, the "replacement cost of a tree similar to the one you removed is $800.00." In the same letter Mr. Williams says "the cost to plant a tree in the City to replace the one you illegally removed will be $317.26. Do you have any established criteria for determining valuation of a replacement tree or for determining a tree's equivalency to another? There also seems to be a subtle threat in the tone of the letter: "If you choose not to accept the offer to pay for the replacement tree, the City would have no recourse but to seek to recover compensation for the $800.00 tree..." Is the assessed cost a randomly selected amount? We called Mr. Williams once again to request that he provide us with a copy of the ordinance he referenced several times. We explained that the process was not making sense to us, and that the ordinance excerpt he quoted made no reference to the "tree program" he had mentioned. If it is a pivotal issue, why was a copy not provided with the code that was sent to us? We asked if there was another course of action we could take to remedy this issue. We have received a copy of Chapter 11.04 of the City of Burlingame Municipal Code. We are unable to find a reference to which department or individual is authorized to enforce the code. We are unable to find any mention of the amount of the fine or fee that is being assessed us. We are unable to find reference to any fee being assessed for use by the city in its tree master plan. In fact, the code reads that funds are allocated by the council for that purpose. A member of the Parks and Recreation Department staff told us by phone that the planting strip is not to be maintained by the City and that we should remove and replace plants and shrubs if we like just so we don't disturb the existing trees or their root systems. We were told that this requires no permit. We have observed many property owners tending the planting strip in front of their houses. The code strictly prohibits these acts. When is that portion of the code enforced? Who decides which part of the code is enforced and at what times? Is it common to apply only parts of the code? Our reason for removing the tree is that it was dead. This can be verified by us, our contractor, our neighbor, and the Arborist, who was shown the tree after removal and who commented that it was dead. Our intent has been to improve our neighborhood by taking care of our property and the area in which we live. We think it inappropriate to penalize us for the removal of a tree that was dead, in the process of cleaning up our living space. We have made many improvements to our property since escrow closed in mid -September last year. We plan to do more. We are proud to be members of the Burlingame community, but we are unhappy with this situation. We look forward to your prompt response. On February 3, 1997 your contractor removed a City owned street tree in front of your home without asking for or receiving permission from me or any other City employee. Your action violated Section 11.04.035 of Chapter 11.04 of the Municipal Code of the City of Burlingame. It is unlawful for any person to cut down, trim, prune, plant, remove, injure or destroy any tree, shrub, or plant in or upon any street or public place in the City without a permit therefor from the director, who is hereby authorized to grant such a permit in his discretion. Steve Porter, City Arborist has estimated that the replacement cost of a tree similar to the one you removed is $800, according to procedures prescribed in the two publications which arborists use to value such trees. The two publications are species Classification and Group Assignment, Western Chapter of the International Society of Arboriculture, 1992 and Guide for Plant Appraisal, International Society of Arborculture, 1992. The City has already agreed to permit you to pay for the planting of a new replacement tree somewhere in Burlingame, in lieu of full payment for the tree lost. The cost to plant a tree in the City to replace the one you illegally removed will be $317.26. If you choose not to accept the offer to pay for the replacement tree, the City will have no recourse but to take action against you in small claims court to recover the $800 tree lost by the City, due to your actions. After my visit, I am in agreement that you do not need a replacement tree in front of your home. You are already well -forested. It also appears to me that our staff has interpreted our rules and policies correctly in regards to your situation. Your contractor illegally removed a City tree from in front of your home. I have no way of knowing your motives, but I am assuming that you were not willfully breaking the City Ordinance. I am not terribly happy with your contractor, however. He tried to talk the City Arborist into ignoring the violation and that is not acceptable in Burlingame in any City department. If your contractor has a business license and is licensed to work in Burlingame, he should have known the law and advised you appropriately. If you hired an unlicensed firm, than you were negligent. The condition of the tree when it was removed is now a moot point since City staff was unable to inspect the tree before it was removed. I agree with department staff that it is appropriate NOT to charge you for the illegal removal of a City tree since you may not have understood the City Code. It is appropriate, however, to ask you to reimburse the City for the planting of a replacement City tree somewhere in the City as a part of the regular tree program. It is the intent of City Ordinances and policy that a new tree be planted in the City when another protected tree is removed. Sincerely, John W. The Commission noted that 24" box size trees can be purchased for less than the $175 contribution to the City's tree planting fund, and that there are several species of trees that can be planted in the front yard without causing any damage. This decision can be appealed to the City Council in writing within 10 days of receipt of this letter. Box 2171, El Granada, California 94018 May 19, 1997 Beautification Committee Parks and Recreation Department 850 Burlingame Avenue Burlingame, CA 94010-2899 Re: Tree replacement under Section 11.06.090 In December, 1996, your department issued a permit to remove a pine tree from the front lawn of my mother's house at 1418 Sanchez Avenue. The tree, when it was planted by my mother in early 1988, was only about sixteen inches in height. It was a promotional Christmas gift from Thrifty and came in a can. In the few intervening years, the tree outgrew the house and was beginning to cause damage to the sewer line and PG&E electrical wires. Please refer to the attached copy of the letter signed by Richard P. Quadri, Senior Landscape Inspector, for his determination. As a result of this letter, the tree was removed. The problem is with having the tree replaced. First, there is no room on the property to plant a new tree. The house was constructed in 1906 on a very small parcel. Its front lawn is approximately twelve by twenty-five feet and the sewer line from the house runs through the middle of it. This tiny lawn has no room for trees of any size. The original tree was removed because it had outgrown its location. The back yard is approximately forty-five by thirty feet, of which approximately fifteen by thirty feet is covered by a cement and brick patio. The remaining grass portion of the yard already has two full-grown trees, an apricot and an oak, leaving no room for a third tree. Secondly, my mother, who owns the house, is 83 years old and is in poor health. Her total monthly income is $570 from Social Security and a small pension. She has outlasted any life savings she had and has no other assets. My brother and I make up the differences in her living expenses, which include everything from utilities and property taxes to medical expenses. Both of us have families and our own financial responsibilities. We cannot afford a $175 contribution to the City of Burlingame to plant a tree elsewhere. Finally, the original tree was destructive and a nuisance. It was removed for that reason. We feel there should not have been a replacement requirement attached to the removal permit.
