RE: APPEAL TO COUNCIL OF COMMISSION DENIAL TO REMOVE A BRAZILIAN
PEPPER TREE AT 1750/52 SEQUOIA
I am writing concerning your appeal to the Burlingame City Council of the decision by the
Beautification Commission at its December 2, 1999 meeting. Your letter of appeal was received
by the Burlingame City Clerk's office on December 29, 1999 with a December 27, 1999
postmark. The letter from this office reiterating the appeal procedure was sent to you on
December 8, 1999. Your appeal, therefore, cannot be accepted. It did not arrive within the
prescribed ten day appeal window. No further appeals may be made. City Attorney Larry
Anderson has confirmed that your appeal to the City Council cannot be accepted.

Dear Council Members:
This letter is to request permission to remove the Brazilian Pepper tree from
our property at 1750/52 Sequoia. The Burlingame Beautification committee
has ruled on the matter and we would like to request reconsideration of their
denial.
We would like to point out to you that continuing to keep the tree presents
potential hazard to our structure and that we hope the City of Burlingame
willing to bear the responsibility of the repairs to our new roof, foundation
and pipes.
We would also like to point our that the exposed roots pose a potential
liability hazard to a pedestrian crossing from the driveway to the front door
of the front unit and by not letting us remove the tree we also hope that the
City of Burlingame will take on the responsibility of any injury to a person
tripping on them.
We understand that it is a mature tree but it is in the wrong place. Thank
you for your attention to this matter.

At its meeting of December 2, 1999 the Beautification Commission voted 5-1-1 (absent) to deny
your appeal for the removal of nine Pine trees and seven Cypress trees at the above address. The
Commission noted that insufficient information had been provided to justify the removal of all sixteen
trees. The Commission encouraged you, as the applicant, to make reapplication to the Parks Division
with a Certified Arborist report indicating findings that would justify the removals.
This decision can be appealed to the City Council in writing within 10 days of receipt of this letter.
