You directed that this item be continued to the July 1 meeting and asked that the applicant return with an arborist report on the trees. Last night at the regular meeting of the Burlingame City Council, a concern was expressed by a Council Member re safety at that site because of the excavation work which has been done next door at 530 El Camino Real. The Council did not want to delay the review of the project further and so asked that this matter be brought before the City Council on June 21. This action effectively means that the Beautification Commission is officially excused from further consideration of this matter. You do not need to plan your personal visit to this site. The City Council will review the matter and make the determination about whether or not the removals should be permitted. ME oAPoRwrao� June 24, 1999 CITY OF BURLINGAME PARKS & RECREATION DEPARTMENT MEMORANDUM TO: Beautification Commission FROM: John Williams, Parks & Recreation Director SUBJECT: Proposed Changes to the Commission's Enabling Ordinance I have reviewed the changes in Municipal Code Section 3.28 which have been proposed to date. These comments are my thoughts only and may not represent the feelings of the City Manager or City Attorney. After your Commission and our City staff have reviewed any proposed changes, then the City Council also has to be convinced that the changes are appropriate. This is not a difficult or complicated process, but it should be deliberate and it should be well considered by everyone. I have not addressed all the issues. Some of my thoughts : 3.28.010 add: "...but all necessary expenses, I am not sure what is intended. No such as required attendance at civic other Commission has language like this. events, shall be paid" Any unusual Commissioner out of pocket costs can be reimbursed now. 3.28.040 delete: "The Secretary of the Commission shall keep..." add: language about staff keeping minutes. 3.28.050 new `B": Suggests that the Commission should be the caretaker of two City Ordinances. This is really the City Attorney and Council's call, but 1 am not sure why you would want to have language in the law spelling -out who takes the minutes. 3 other Commissions presently have language identical to yours. I do not believe that the Commission should be the caretaker of any City Ordinances. Ordinances belong to the City Council. Commission and staff have duties under the Ordinances and should make recommendations for change from time to time. new "C": Suggests that the Commission should run programs new "D": Discusses citizen input at meetings. new "E": Suggests that the Commission facilitate disputes between private citizens. new "k": Simplifies section re making rules for City parks. This inevitably means the commitment of staff and money. Will need to either budget funds or do fund raisers. The Commission can always recommend to City Council that staff do new programs. This is a policy issue for Council. State law already spells out citizen rights to address the Commission about any subject. Probably not necessary. Not sure why Commission would want to take on this task. Major impacts on staff. City already pays a mediation service to do this in Burlingame. I will object to this proposal. I propose deleting this section completely. Parks & Recreation Commission already has this charge and regularly does this. Tim Richmond and I will be happy to discuss any of these issues at any time. Again, I would encourage you to take your time as you work your way through this review. attachment: Recommended changes "Mm �CITY 0 CITY OF BURLINGAME BURLI 'GAME PARKS & RECREATION DEPARTMENT CD'------D MEMORANDUM June 22, 1999 TO: Beautification Commission FROM: John Williams SUBJECT: Proposal for Tree Planting Program on California Drive As per your Commission's request at your May meeting, Parks & Recreation Department staff has been working to develop a report for you to use as a baseline for discussions about tree planting along the west side of California Drive from Broadway to Burlingame Avenue. It appears to me that both your Commission and the City Council have an interest in upgrading the appearance of this major connector between our business districts. I know we all understand that a tree planting plan undertaken now, will take several years to provide the attractive look that we all would like to see eventually. However, with a bit of vision, we can begin the process to make California Drive a special place. A second issue is converging to make this a good time to begin our discussion. The City of Burlingame and BART are about to enter into an agreement that will bring several thousands of dollars to the City, earmarked for the planting of trees. The bad news is that BART will be removing over 100 Eucalyptus trees along the east side of the CalTrain tracks, in the area north and south of Trousdale. The good news is that BART will pay for the trees removed and that money is earmarked for our tree replacement fund. Adequate funds can be made available from the Tree Replacement Fund for a $60,000 project, if the City Council so chooses. Some of the issues staff has considered: Should replacement trees be all one variety? Even though in neighborhoods, and generally throughout a community, it is usually best to mix tree species so that a blight or disease does not decimate an entire street, staff believes that this is a special case and a single tree specie could provide a special look. We should select a specie that does not have a history of health problems. • lat tree does staff recommendtree does staff recommend? Aristocrat Pear. It has a good success rate in �. Burlingame - minimal root impacts, attractive Spring blooms and Fall colors. • Should existing_trees be removed as a part of this project? Staff believes that it would not be appropriate to take out any healthy mature trees at this time. Unhealthy or weak trees could be removed and replaced as part of this project. In the future, as the new trees grow -in, perhaps a remove and replace program could be phased -in for mature healthy trees. We have not identified any trees that need to be removed at this time. Should property owners have the option to opt -out? Staff believes that the City should plant a tree in every reasonable location. Some of the commercial locations will not be optimal, in terms of the space available. Trees should be watered for the first summer, since many of the property and business owners will not be willing to help. There should be no requirements for property owners along California to get permits or pay for any part of the process. Can staff handle this project? 89 sidewalk concrete saw cuts will be necessary. This function will have to be contracted -out. Staff could plant and maintain trees for the first year, however, it will mean that some other tree crew task will have to be eliminated or reduced. City staff is NOT equipped to hand -water 98 new trees. Typically, the homeowner is expected to water new City street trees. We recommend that the entire task be contracted -out and that City staff not take over tree maintenance until one (1) year after trees have been planted. • Proposed budget to plant 98 trees and maintain for one (1) year. $ 7,120 Saw cut sidewalks for 89 trees (89 locations x $80) 2,940 Purchase 98 new trees 14,060 Plant 98 new trees 13,600 Purchase and install sidewalk grates for 16 trees (not mandatory) $ 37,720 Estimated total cost of Preparation and Planting In addition to the above, trees must be inspected, maintained as necessary and watered for at least one year (March through October). Property owners cannot be counted on to water trees on a regular basis. One vendor gave us a price of $40,000 for the one year maintenance period. It seems reasonable that we could organize this task and bid it so that it could be done for $20,000 or less for the year. It seems reasonable to assume that this project could be completely carried -out for $40,000 to $60,000. Date: May 12, 1999 To: Beautification Commission From: R. Quadri - Sr. Landscape Inspectors' Re: Removal of 13 Protected Trees - 2300 Adeline The owners of the property at 2300 Adeline (Sisters of Mercy) have submitted an application to remove 13 protected Eucalyptus trees on the east side of their property fronting Hoover Avenue. They have provided an arborist report (April 26, 1999) which evaluates the trees as a group, but not individually, and a letter (May 1, 1999) from the owner of a neighboring property requesting that the trees be removed. Since removal of a large number of protected trees will have an impact beyond the immediate area, I recommend that the Beautification Commission schedule a public hearing on this application, to be held at your next regular meeting. Eucalyptus globulus, located east of the Forest Parking Lot. You are concerned regarding the hazardous condition of these trees, as are the neighbors east of the trees, living along Hoover from 1514 to 1524 and 1530 Hoover. The trees were planted in a row at six to twelve foot spacing, with the exception of the lone tree opposite 1530 Hoover. They are typical of the mature to overmature blue gums, being approximately one hundred feet tall with long heavy limbs. Many limbs are poorly angled and there is a history of limb losses. Some trees have fallen limbs caught up in the branches at this time. They are also interfering with the growth of more desirable specimens below, including coast live oaks, Quercus agrifolia, and a redwood, Sequoia Sempervirens (Tree No. 12 is growing into this tree). Foreseeing the eventual need to remove these large trees, you have planted both holly oaks, Quercus ilex, and coast live oaks further back, between the parking lot and the street. A look at the trees at the north end of the Forest Parking west of Hoover will show what this area could look like if the blue gums were removed. The native coast live oaks provide screening with a beautiful canopy cover. I agree with your and the neighbors' concerns. The area would be better served by the removal of these trees. I have lived here since 1987 and have had a growing concern, along with my neighbors, about the safety of the 12 eucalyptus trees directly in front of the homes on the south end of Hoover Avenue. Their grossly overgrown height pose a great threat to us all on this street. The life span of the eucalyptus is approximately 100 years. These trees are close to if not over 100 years. They are shallow rooted and never should have been allowed to reach this height while so dangerously close to homes. If any of the 12 trees were to come down, which is highly likely because of our past winds and storms, it surely would result in serious injury or death. I have young children at home that sleep upstairs and during the past high winds I fear for the magnitude of destruction any one of these trees would cause if blown over on our homes. The only solution to this ever increasing threat is to cut these 12 trees down. There are oak trees growing beneath the eucalyptus trees. After removing the eucalyptus trees there is still plenty of young and new growth that would flourish without having to replant. I represent all of my neighbors on Hoover Avenue but would be happy to have them forward additional letters of concern if needed. Please keep me apprised as to impend- ing decision of this catastrophic threat to human life. I expect the school and the city to put the safety of the community above all else. Should these trees not be swiftly dealt with, my neighbors and I will hold the school and the city liable should any of them blow over. I am confident that the school will aggressively deal with the potential threat of these trees. They are native to Australia forests and do not belong in the small neighborhoods of Burlingame. They grow like weeds and are not native to our country. Their threat to us in this community proves �. that. If any of the 13 trees were to come down, which is highly likely because of our past winds and storms, it surely would result in serious injury or death. I have young children at home that sleep upstairs and during the past high winds I fear for the mag- nitude of destruction any one of these trees would cause if blown over on our homes. Because of their overmature age, any one of them will come down soon. I do not expect the City of Burlingame to play a dangerous game of Russian Roulette with our lives every time we encounter a storm or windy day. We are the people that live beneath these trees and no one else but us is threatened by them. The only solution to this ever increasing threat is to cut these 13 trees down. There are coast live oak trees and a redwood growing beneath the eucalyptus trees. After remov- ing the eucalyptus trees there is still plenty of young and new growth that would flour- ish. The Kohl Mansion, which is on the property and originally called the oaks, is listed on the National Registry of Historical Places and the Sisters of Mercy intend to replace with more live oak trees. This would satisfy our safety concerns as well as the con- cerns of the beautification committee. These trees are a threat to human life. I expect the school and the city to put the safety of the community above all else. Should these trees not be swiftly dealt with, my neighbors and I will hold the school and the City of Burlingame liable when one of them blows over. This is not a beauty issue, this is a life issue.
