RE: Suggested Amendments and Questions on Chapter3.28 — Beautification Commission
I have received a memorandum from the Commission's subcommittee, which has been updating
Chapter 3.28 regarding the Commission. I wanted to provide you with some responses to the
suggestions and questions.
Powers and duties:
I recommend leaving subsections (a) [street tree plan], (e) [types of street trees], (f) [care of
street trees and parkways], and (g) [development of parkways] in the Code. While many of
these programs are already adopted or handled by Parks & Rec staff, these subsections give the
Commission the ability to recommend changes or specific programs to either the Council or the
Parks & Recreation Director.
Subsection (h) should probably be amended. As you may notice, primacy is given to recreational
use of all City parks, which may or may not be accurate as to all City parks. Secondly, the rules
and regulations governing specific parks are adopted by the Council. Our most recent
experience was with Cuernevaca Park.
2. Additions to powers and duties:
Rather than using the term "arbitrators," which can mean either a binding or advisory role, I
recommend the following new subsection: "Determine appeals from decisions of the director of
parks and recreation pursuant to chapter 11.06." I am not sure whether the Commission would
like to suggest broadening this intervention beyond the urban reforestation chapter to other
private tree matters.
3. Additional duty to receive beautification -related ideas or concerns:
I suggest that "As a regularly-calendared public meeting," be deleted. The Brown Act requires
the Commission to only meet at properly noticed and agendized meetings, and to accept public
comment on any issue that is related to the Commission's jurisdiction.

4. Other suggested changes/additions:
3.28.010 — The provision governing Commissioner terms of office is the standard one for all
City boards and commissions. Once a new Commissioner is sworn in by the City Clerk, the
predecessor Commission leaves office. This establishes a clear day of authority and right to vote
and participate; in addition, the Council expects the new Commissioner to begin attendance and
puts the new Commissioner within the attendance policy of the City. If we leave the end of the
term open to when the successor actively begins participation, no one knows when that might
happen; two people might be filling the same office at the same time.
3.28.020 — "without cause" means that the Council does not have to designate a reason for
removing a commissioner or board members. In other words, the person serves "at the will" of
the Council. If the terminology were left at "with cause," then the Council would be obligated
to not only designate a reason, but because it involves a government office, would have to
provide a hearing before removing a commissioner or board member. In other words, the
implication would be that the person has a vested right to the office, and a list of possible reasons
for removal would have to be placed into the Code.
3.28.040 — This section establishes the obligation for the Commission to keep minutes of its
meetings. Without this or a similar provision, there is no legal obligation for the Commission
to keep a formal record of its meetings and actions.
I hope these comments are helpful. I would be happy to work with both the Commission and the staff
on the final proposed amendments. As you may know, I will be working on clarifying amendments
to Title 3, which can of course, include the recommendations of the Commission regarding Chapter
3.28.

Subject: Sm Almet bad
This letter is being written to give strong support to the owner's request for the
removal of a large Black Acacia Tree from their property.
This tree is in very poor physical shape and is in some danger of falling against our
building.
The tree encroaches about 20 feet over the South side (rear of their lot) and about
30 feet over the East side of the property ( the side nearest our building's side -yard.)
The roots extending from this tree have caused a Yedical flasure about 3 feet in
length in one of the retaining walls of our garage.
Additionally, the massive encroachment onto our property by this undesirable tree
practically obliterates any sunshine into my apartment because of its dense canopy.

An arborist (S.P.McClenalwn Co, of Portola Valley) ,who gave me a price to
remove this tree, pointed out a split at the main crotch --about forty feet up the main
trunk. He told me that a good strong wind could break this branch. if that happens, it will
cause considerable damage to the upper level of our building.
This species of tree causes a large amount of debris to fall into our garage area and
requires our maintenance man to spend several hours a week keeping ahead of the mess,
The size of this tree is completely out character with the space it has and should be
removed.
Several recent photos of the offending tree, taken from our garage, show the
massive encroachment and will be forwarded to you under separate cover.

Re: Protected Tree Removal - 535 Almer Road
The owner of the property at 535 Almer Road has applied for a permit to remove a 105"
circumference Black Acacia as part of a proposed new condominium development. Plans
originally submitted by the owner indicate that this tree, and a 150" circumference live oak,
would be saved and protected during construction: Plan check comments and conditions were
based on that representation. Protection of these trees was addressed in the environmental
documents that are part of the planning process, and was discussed by the Planning Commission
at their hearing of January 11, 1999. Although the project as originally proposed was denied by
the Planning Commission, it has been revised and is now scheduled for rehearing.
In light of the mitigation measures recommended in the Negative Declaration, and the continuing
public concern over the removal of trees during development, I recommend that the Beautification
Commission schedule a public hearing during the regular meeting of May 6, 1999 to determine
whether this permit should be issued.
