Re: Updating City Ordinance. Chapter
regarding organization & duties of Beautification Commission
OVERVIEW: Our primary recommendations to update this City ordinance, written
in 1968, concern provision 3.28.050, "Powers and duties." Of the ten (10) currrently
listed duties, reflecting Commission activities in 1968, seven (7) have become the
responsibilities of the Parks Department or have become irrelevant due to changes in
City development.
1. We recommend the deletion of items a); c); d); e); f); g); and i) from provision
3.28.050, "Powers and duties."
2. We recommend the addition of the following 'duties,' to reflect current
Commission activities:
- Act as arbitrators to resolve differing opinions between citizens regarding
private and/or protected tree matters.
- Develop, sponsor, and/or implement programs and/or activities to promote
community awareness and participation in City beautification.
3. We propose for Commission discussion the following 'duty,' which reflects
current reality, but perhaps should not be formalized:
- As a regularly-calendared public meeting, provide the opportunity/occasion
for citizens to voice beautification -related ideas or concerns, and to obtain
information and/or advice.

3.28.010 Organization —Terms of members —
Compensation.
There shall be a beautification commission in the
city consisting of seven members, appointed by the
mayor, subject to confirmation of the city council; the
members thereof shall be qualified electors of the city,
and their terms of office shall be for a period of three
years and until their successors are appointed and
qualified The terms of the first members of the beauti-
fication commission shall be determined by lot so that
the term of two members shall be for one year, of two
members for two years and of three members for three
years, all commencing at the fast meeting of the
commission after the commission is fully constituted.
The members shall serve without compensation, but all
necessary expense shall be paid by appropriate council
action. (Ord. 884 1 (part); August 19, 1968).
3.28.041) Record of proceedings kept by
secretary —Filing.
The secretary of the commission shall keep it record
of all proceedings, resolutions, findings, determinations
and transactions of the commission, which records shall
be a public record, and a copy of which record shall be
filed with the city clerk as clerk of the city council.

3.28.050 Powers and duties.
It shall be the duty of the beautification commission,
subject to the approval of the city council, to:
_-9— (a) Recommend a master street tree plan for adop-
tion by the city council;
(b) Recommend an "Official Street Tree List" to the
city council for adoption, designating specific types of
trees which can be planted on any street, based on
pertinent local street and tree factors;
�---- (c) Recommend specific types of street trees for any
new subdivision;
�-- (d) Recommend a survey to be made from time to
time to determine those street trees which are to be
retained and those which should be removed to con-
form to the street tree planning and maintenance
program, having regard for both the immediate and
long-term needs of the city;
,9-- (e) Recommend programs for the planting, mainte-
nance and removal of all street trees in the city;

The commission shall hold regular meetings at least
once each month, and may hold such additional meet-
ings as it may deem necessary or expedient. A majority
of the commission shall constitute a quorum for the
purpose of transacting the business of the commission.

RE: Tree Removal Application - 1435 Alvarado
The owner of the property at 1435 Alvarado has applied for a permit to remove a Sequoia in the
front yard at that address. As the applicant states, the tree is causing damage to the property.
The tree, however, is a prominent feature in the neighborhood, and its removal would have a
significant impact. In order to move the process forward without undue delay to the applicant, I
am asking the Commission to review the application, and either:
1. Schedule a hearing for the regular meeting of April 1, 1999;

2. Direct me to proceed with the processing of the permit application.

Because the Sequoia tree at 1435 Alvarado is a prominent feature, and its removal would have a
�. significant impact in the neighborhood, your application was referred to the Beautification
Commission for review. At its regularly scheduled meeting of March 4, 1999 the Beautification
Commission voted 6 to 1 (opposed) that the application process proceed as usual.
