HomeMy WebLinkAboutReso - CC - 076-2000RESOLUTION NO. 76-2000 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME REVISING FEE SCHEDULE AND ESTABLISHING BONDING REQUIREMENTS FOR PERMANENT AND NON -PERMANENT ABOVE -GROUND FIXTURES WITHIN THE CITY'S RIGHT-OF-WAY RESOLVED by the CITY COUNCIL of the CITY of BURLINGAME that: WHEREAS, this matter came before the City Council on July 5 , , 2000, and was regularly noticed as required by Government Code § 66016; and WHEREAS, the City Director of Public Works has presented a report to the Council showing that the costs to the City of processing and inspecting encroachments has increased, but that there has been no increase in the fees for this construction for two decades; and WHEREAS, the proposed fees do not fully reimburse the City for the costs of providing the issuance and inspections services nor the potential liability to the City for such work; and NOW, THEREFORE, it is hereby ordered and directed as follows: 1. The schedule contained in Exhibit A hereto is adopted for fees and bonds for permanent and non -permanent above -ground fixtures. 2. The City Engineer is authorized and directed to implement the fees and provisions of the Schedule contained in Exhibit A. 3. This schedule shall become effective sixty (60) days from the date of this resolution as required by Government Code § 66017. to • 0 Mayor I, ANN T. However, the City Engineer may determine that specific construction is extremely complex, difficult, or affects significant public facilities, and increase the amount of the fees or bonds required. In doing so, the City Engineer shall provide a written statement of the reasons and analysis of the increased fee or bond to the permittee. The fees to be applied in such a situation shall not exceed the actual costs of providing the issuance and inspection services. ISSUANCE AND INSPECTION FEES Permanent above -ground fixtures Processing $50 Inspection $25 Total $75 Non -permanent above ground fixtures Processing $25 Inspection $25 Total $50 The inspection portion of the fees will be returned to the applicant if the application is denied. BONDS OR CASH DEPOSIT, REQUIRED Permanent above -ground fixtures $300.00 The bond or cash deposit will be returned to the applicant if the application is denied or when the construction is completed.
