(I base my decisions on tree health, stability, and property damage only.) 3) Removal of this Eucalyptus tree to move utility lines, may impact other protected trees on neighboring properties. (A specific plan from P. G. &E. would help to clarify the impact on neighboring trees.) 4) Therefore, the application has again been denied. Our department is already in receipt of your appeal to the Burlingame Beautification Commission. This item has been placed on the November 1, 2001 agenda for fii Cher consideration. A tie vote means that your appeal has failed. This decision can be appealed by writing to the City Council within 10 days of receipt of this letter. Or, as suggested by the Commission, you may make reapplication to the Parks Division providing further information that may justify the removal. Sincerely, '�'D �_ 0 f Tim Richmond Parks Superintendent TR/kh This is our second submission of our request to remove a tree from our backyard I have enclosed four photos that show low overhang wires that cross the length of our yard right down the middle of our yard, 11 lines total The photo with the blue sky in the background shows a view of these lines while lying on my back in my yard, imagine enjoying a barbecue outside with these lines above you. Any new landscaping we do to our yard will always have this view under us while we are in the yard playing, barbecuing, socializing and especially makes it very unattractive to add a new three level deck to our yard It is important for us to create a pleasant and usable play area in our yard, not only for our 4 year old but for the twins that are currently growing in my wife Is womb. We can not afford the approximate cost to trench these lines (from $42,000 to $50,000) compared to cutting the tree and moving the lines (From $13,500 to $19,000). At the moment, the only access to our yard is from the front door and around the side of the house (not great access when kids are playing there when an adult is in the house). The building of a new suitable deck that gives us usability, access and beautification of our yard is going to cost from $25,000 to $35,000 not including landscaping of the yard The additional cost to trench is to much for us to pay compared to moving the lines. If we cannot move those lines, we will not spend the money beautifying our backyard The lines will stay as they are as will the tree and the condition of the back property. I am requesting for the second time the chance to have my permit reviewed by the beautification committee to remove the tree so we can beautify and use the yard for my growing family. We appreciate the beauty that tree's add to our city, which are one of the reasons we live in Burlingame. We as much as anyone enjoy anything that is alive and green, see our front yard to see how important greenery is to us. However, in keeping with this goal of living in a wonderful environment, I am asking for consideration of removing one large tree while still leaving two, so we might enjoy our property which we worked hard to buy, improve and keep. We would like our property within Burlingame to be one we can enjoy fully as a family. Thank you for your consideration in this matter. It was noted during the discussion that the tree is healthy and that your safety concern with regard to the spikes on the trunk could be remedied by shaving them off. We would hope that there would be some other alternative to the removal of these neighborhood assets. The trees provide a home to several squirrels and birds. These trees also provide a sound and pollution deterrent for the neighborhood. In the notice that we received, it does not indicate which of the acacia trees at 809 Paloma �- Ave are going to be removed and who made the determination that these trees were unsafe. Also, how would the removal of these two trees affect the other trees that are connected. We would hope that in the City of Trees all options would be exhausted prior to the removal of these old and beautiful trees. Thank you for your consideration. In the picture below (figure 1), they're the two trees towards the left. Also pictured are three other Black Acacia trees which have grown within one foot of an outbuilding. Those trees and outbuilding belong to our neighbors at 813 Paloma and may or may not be removed simultaneously; these will be addressed separately by them and are mentioned here for reference only. NEIGHBOR'S THREE TREES AND OUTBUILDING We're concerned about the extreme size and weight of our trees and the potential liability and safety issues which they might pose. �. Directly behind our chimney, visible as a (relatively) shorter, darker green tree, is a mature Flowering Plum, which is healthy and will remain. Its height is approximately 30 feet. There's also an Incense Cedar in the immediate area estimated to be 20 years old; this too will remain and perhaps prosper. Behind is the stand of Black Acacia. It's believed to be 90-100+ feet tall and is composed of a total of six Black Acacia growing in three different yards. This includes the five trees I've mentioned: our two which we'd like permission to remove, plus the neighbor's three. Also part of that same `mass' of trees, located to the far left, is a third neighbor's single Black Acacia, which is not part of this request for a Protected Tree Removal Permit. We've had a certified Arborist, Don Cox (WC3203) take a look at the situation. Though we've not requested a report, he made it clear that, in his opinion, the trees were over mature and top heavy due to their close proximity to one another. Thanks for your time in reviewing this situation. We hope that you'll be able to grant a Protected Tree Removal Permit, preferably with no replacement required. Actually, we're in the process of installing landscaping composed in a great part of California native plants and foresee trees once again filling the space where the Black Acacias are now. But we're looking at species which will grow to perhaps half the height, or less, of the Black Acacias and in doing so be less imposing as well as less dangerous. The Commission's decision was based on the findings of the City Arborist that the trees have co -dominant trunks and heart rot. In addition, the City Arborist noted that this species is fisted with I. S.A. as having a high incidence of whole tree failure. This decision can be appealed to the City Council in writing within 10 days of receipt of this letter. If the City Council has not received an appeal from you by the close of business on Friday, October 26a`, the permit will be issued to the applicant.
