commenting on 3 trees: 2 black acacias and a Canary Island date palrn. You were concerned
with the health and safety of them tme6.
All trees were rrea cared for diameter at 4.5 feet above grade. Each tv*e was given a
"Cordi#ion" rating for form and vitality from 1-200 using the following table.

garage. Slack acacia is a poor landscape species and is not ger.Qrally recommended

Our department has received a letter from the property owner at 1104 Cortez Avenue appealing the
decision to approve the removal of two Black Acacia trees and one Palm tree at the above address.
The application, as well as the letter appealing the decision, will be forwarded to the Beautification
Commission at the September 50', 2002 meeting. The Commission will then take action on this item
at the October 3`d, 2002 meeting.
The City Arborist advises that you obtain an independent Arborist Report that could be presented to
the members of the Beautification Commission prior to the October 3' meeting. (The agenda for that
meeting will be mailed to the Commission on September 25`'')
The Commission meets at 5:30 p.m., in Conference room "A" at City Hall, 501 Primrose Road should
you wish to attend and speak to the issue.

Dear Sir or Madam:
I received your notice that you plan to grant permission to the owners of the property at 1108 Cortez to
remove two large black acacia trees at the rear of the property.
I would like to appeal your decision and ask that the trees to remain in place. The trees are very
mature and visible from many directions and add greatly to the appeal of both properties and the
neighborhood overall.
You may not realize that the developer plans to move the driveway at 1108, and in the process will also
remove cherry, apple, and lemon trees, a large oleandar, a holly tree about 10 feet tall, a large antiique
rose bush, and several other shrubs in excess of 6 or 8 feet tall. In other words, every shrub and tree
along the south-east side ajoining my property is to be removed. The total effect is to denude almost
the entire property at 1108.
The petition to remove the trees states that they interfere with power lines. Many of the trees in
Burlingame interfere with power lines, which is generally controlled by trimming, not removal.
The petition also states that the trees interfere with existing structures. This is not a valid argument.
One of the existing structures is my garage, which was already addressed by the previous owner of
1008 who removed branches that leaned on the roof. The other existing structure is definitely to be
demolished by the developer, so the argument is moot. I suspect that the reason for removal is to
allow for the new garage to be built close to the property line, where the trees now stand. I believe that
a compromise design can be developed to allow both the new garage and the trees to coexist.
Many of the residents in this neighborhood are unhappy to see the number of trees removed in the past
year or so. For example, the entire west side of the block of Cortez between Forrestview and Sanchez
has had most of the mature trees, including redwoods, removed by developers — most of those trees
had lined the street, and where removed after the new homes were built. All of these actions change
the character of the neighborhood. There must be away for existing mature trees and new houses to
coexist. The quality of the neighborhood is in no way addressed by replacing a 20 foot tree with a 24-
inch box.

above address, and have made the following determination:
1) Both Black Acacia trees are leaning and are causing significant property
damage to existing structures.
2) The Palm tree is growing under primary electrical lines which will eventually
need to be "topped" resulting in the decline of the tree.
3) Replacement with three 24" box size trees will be required as defined in
Section 11.06.090 of the Urban Reforestation and Tree Protection Ordinance.
Therefore, I intend to issue a permit for the removal of the trees subject to the provisions of the
Burlingame Municipal Code. If you agree with the conditions, please sign the enclosed permit and
return in the self addressed envelope BEFORE August 14, 2002.
If you wish to appeal this decision or any of its conditions or findings, you must file a written request
by August 14, 2002 as provided in Section 11.06.080 of the Urban Reforestation and Tree

RE: APPEAL OF THE DECISION TO REMOVE TWO PRIVATE BLACKACACIA TREES
AND ONE PALM TREE @ 1108 CORTEZ A VENUE - BURLINGAME
At its meeting of October 3, 2002 the Beautification Commission voted 7 - 0 to deny the appeal and
to allow the permit to be issued for the removal and replacement of two Black Acacia trees and one
Palm at the above address. The decision was based on the poor condition of the Black Acacia trees
and that the Palm tree is in close proximity to the P.G.&E. high power lines. The Commission also
noted that the Palm tree falls within the foot print of a proposed garage reconstruction.
This decision can be appealed to the City Council in writing within 10 days of receipt of this letter. If
no appeals to the Council have been received by October 21 st, the permit will be issued.
