RE: APPEAL OF DENIAL TO REMOVE A CITY LIQUIDAMBAR TREE AT
1800 ASHTON AVENUE.
At its meeting of August 7, 2003, the Beautification Commission voted 5-0-2 (absent) to
deny your appeal of the denial to remove one City Liquidambar tree at the above address.
The decision was based on the health of the tree, available root damage mitigation, and
the fact that the tree is part of a street tree grove on that block.
This decision may be appealed to the City Council in writing within 10 days of receipt of
this letter (August 22, 2003).

RE: APPEAL OF DENIAL TO REMOVE THE CITY OWNED LIQUIDAMBAR
TREE @ 1800 ASHTON AVENUE
Your appeal for the removal of the City -owned Liquidambar tree at 1800 Ashton Avenue
has been placed on the Burlingame Beautification Commission's August 71h Agenda. A
public hearing will be held which will result in a ruling by the Commission on your
appeal.
The Commission meets at 5:30 p.m. in Conference Room A at City Hall, 501 Primrose
Road, Burlingame, should you wish to attend and address the Commission regarding your
appeal.
The Commissioners will be notified of the appeal in advance of the meeting, so that they
may inspect the site.
The Commission will not rule on the Liquidambar tree which was being illegally
removed. The Commission does not rule on illegal actions, nor does it participate in
monetary sanctions for such actions. As per previous correspondence, the tree will be
completely removed by City in the near future.

RE: ILLEGAL REMOVAL OF ONE CITY -OWNED LIQUIDAMBAR TREE & THE REQUEST
FOR REMOVAL OFA SECOND LIQUIDAMBAR TREE C, 1800 ASHTON DRIVE -
BURLINGAME
On June 11, 2003, unlicenced workers, hired by you to remove both City -owned Liquidambar trees, were stopped
from continuing their work after your previous request to this office that the City -owned trees be removed had been
denied. The attempted removal of the City -owned Liquidambar tree is in violation of the Burlingame Municipal
Code chapter 11.04.085:
"It is unlawful for any person to cut down, trim, prune, plant, remove, injure or destroy any tree,
shrub, or plant in or upon any street or public place in the city without a permit therefore
from the director."
The tree was damaged beyond repair and will need to be removed by the City's tree crew. The City will be
replacing the tree in the Fall. Please choose the replacement tree from the enclosed Official Street Tree list and
respond to our office by July 31, 2003 with your selection. If we have not heard from you by that date, we will
choose an appropriate tree for that site. Following the completion ofthe aforementioned work, you will be billed
for the appraised value of the destroyed tree as well as the associated cost for the attached Certified Arborist's
report submitted by Mayne Tree Expert Company.
With regard to the other existing Liquidambar tree at the above address, I am again denying your request for the
removal of the remaining City -owned tree. This Liquidambar tree is a mature, healthy tree, and as we have
discussed in the past, the roots can be cut 6' out from the trunk and root barriers placed enabling you to
relandscape. If you wish to appeal this decision, you may do so by writing to the Burlingame Beautification
Commission, C/O Burlingame Parks & Recreation Department, 850 Burlingame .Avenue, Burlingame.

RE: AUGUST 7, 2003 MEETING
The August 7 meeting includes a Public Hearing. It concerns an appeal of a denial to remove a City
street tree at 1800 Ashton Avenue. The tree in question is a Liquidambar. The basis of the appeal
is included in your packet. The second Liquidambar was partially removed without permit by a
contractor. That tree was determined by the Arborist to require future removal; the structure has
been too compromised to remain. City crews will remove and replace that tree. Your hearing
concerns only the tree with the full canopy. Please read the attached documentation carefully for this
item.
Also on the agenda is the election of Commission Officers. The nominating Committee will present
its recommendations, and a voting will occur. The new Officers will be in place for the September
meeting.
At the June meeting, the issue of PG&E pruning practices was raised in the public comment section
of the meeting. In the interim, PG&E made a public presentation in Burlingame at the request of the
BULB organization. Peter Beesley of PG&E was present and addressed some of the issues of
concern to this Commission. In my conversation with Mr. Beesley, he detailed the process that his
crews are instructed to follow in communicating with property owners regarding pruning in backyard
easements. He is also reviewing pruning by his crews in this area. He expressed a willingness to
attend a future Commission meeting to explain PG&E practices and to answer Commissioners'
questions. Chairman McGowan thought that any such meeting was most appropriate after new
officers have been elected, particularly since he will be leaving the Commission. He is leaving the
Commission because he is moving out of Burlingame. We will certainly miss his leadership and his
horticultural expertise.
