Commissioners DATE: OCTOBER 8, 1999 �" TO: BEAUTIFICATION COMMISSION FROM. • STEVEN PORTER - CERTIFIED ARBORIST RE: CONSIDERATIONS/GUIDELINES USED FOR PROTECTED TREE REMOVAL PERMITS The following guidelines are used when I conduct site inspections on permit applications for private tree removal in the City of Burlingame. I. Aesthetics a) Not a consideration 1) Example, Palm trees: The primary consideration is health, sound structure, and degree of present or potential future property damage. H. Health a) If the reason for decline cannot be detennined, i.e. insects/fungus, the resident will be required to submit an arborist report from a certified arborist. M. Sound Structure a) Consideration is given as to whether a poor structure can be corrected by pruning. IV. Property Damage a) Removal permitted if high cost, unsafe, or visible damage is being caused to foundation of house/garage or roof -- Actual structural damage. b) Unless the damage is extreme and no other justifying factors exist, removal is not permitted for damage to walkways, planter boxes, rain gutters, or lawns. c) Removal is not permitted for shade or leaf litter issues. V. Undesirable Species a) Monterey Pine 1) Insect infestations 2) Fungus (Pine pitch canker) b) Black Acacia 1) Unstable during high winds particularly when soil saturated 2) Severe root problems (invasive) In extreme cases, certain factors may change a determination. The hearing will be held before the Burlingame Beautification Commission on Thursday, February 5th at 5:30 p.m. The Commission meets at City Hall, 501 Primrose Road, Burlingame, should you wish to attend and address the Commission regarding this matter. The Commission's decision was based on findings that the tree was a viable, healthy tree and that maintaining the roots, and the pruning and thinning of the tree, could have been alternatives to removal. Further, the Commission recommended that City staff negotiate a cash settlement for the unpermitted removal of the Camphor tree, and that you be required to plant a 36" box size landscape tree on the property at the above address. You may appeal the Commission's decision and recommendation to the City Council in writing by March 6'. Such letters of appeal must be accompanied with a $250 fee (made payable to the City of Burlingame) and delivered to the Parks & Recreation Department, 850 Burlingame Avenue, Burlingame, California, 94010. Sincerely, Randy Schwartz Parks & Recreation Director RS/kh March 19, 2004 Mr. Bob Haddad 831 Crossway Road Burlingame, CA 94010 RE: AGREEMENT FOR THE ILLEGAL REMOVAL OF A PROTECTED CAMPHOR TREE @ 831 CROSSWAY ROAD - BURLINGAME Dear Mr. Haddad: Enclosed please find the Agreement representing the negotiated settlement as discussed at the meeting with you on March 2, 2004. At the meeting, it was agreed that you would reimburse the City of Burlingame $3,000, paid out in $300 monthly payments, over the next ten months. You will receive ten monthly statements beginning on April 1, 2004 and ending on January 1, 2005. Payments will be due and payable by the last day of each month. Upon obtaining all signatures on the Agreement, the Parks & Recreation Department will issue a permit for the removal of the remainder of the tree. The permit also includes the agreed upon condition, that a 24" box size landscape tree be planted at any location on the property. The permit will be effective six months from the date of issuance. The sale of the above property does not negate this Agreement which is transferable with the deed on the property.
