The decision was based on the 2 out of 3 Arborist's Reports recommending removal of the tree. The Commission also encouraged that the existing tree be maintained as long as possible during the construction phase and that, both property owners work with each other to come to an agreement with regard to the replacement species and location. The Commission's decision maybe appealed to the City Council in writing by November 21 st. Such letters of appeal must be accompanied with a $250 fee (made payable to the City of Burlingame) and delivered to the Parks & Recreation Department, 850 Burlingame Avenue, Burlingame, California, 94010. Subject tree is approximately 60 feet in height with an equal crown spread. Trunk diameter when measured at 48 inches above surrounding grade is 35.5 inches. The south and east sides of the tree are surrounded by paving materials. The blacktop extends all the way_ to the trunk on the east side. This asphalt should be removed to allow some water to get to the roots near the base of the tree. The condition of the tree is very good the structure is rated good. Some pruning is required to correct some crossing branches. In addition to some maintenance trimming a 3/8 inch extra high strength cable should be installed in the upper portion of the crown to reinforce the large lateral lhnb that extends out over the street to the south. Some soil movement was noted under the sidewalk and surface rooting consistent with this species and soil profile. The driveway approach is also broken, however, it should be noted that this damage was caused by heavy equipment used to remove a large Oak from the property in October of 2002. Sub -surface fertilization is advised to mitigate soil compaction. The south and east sides of the tree are paved over and traffic travels over the tree roots on both of these areas. Fertilization should be completed in March or April. A soil injected slow release product is best. Thank you for using the services of The Davey Tree Expert Company. At the conclusion of the hearing, Commissioners will vote to uphold or deny this appeal. There is no provision in the ordinance for the Commission to delay implementation of the permit, if approved. There is also no provision in the ordinance which allows the Commission to specify the location of any replacement trees, if required. The permit to remove this tree was requested as part of the Planning/Building Permit process. The appeal will be placed on the agenda for the November 3, 2005 meeting of the Burlingame Beautification Commission, which begins at 5:30 p.m. At the public hearing you will have the opportunity to speak and present additional documents, as will any other interested parties. Beautification Commissioners will receive copies of the permit application, as well as copies of the supporting arborist's reports. They will have the opportunity to inspect the tree in advance of the meeting. At the meeting, Commissioners will be able to question staff and anyone who speaks to the issue. BURLINGAME- Dear Mr. Porter, This letter is appeal your decision to issue a permit for the removal of the subject tree, and to specifically request that this tree not be removed or replaced until after the current owners of 1604 Chapin Avenue have fully addressed and have reached some consensus with us regarding the landscaping plan for the "landscaping line of separation" between our properties that provides privacy for our family. The subject tree, a large silver maple, has been a pleasure for our family since we moved into 1610 Chapin Avenue in 1998, providing shade and the charming suggestion of an old tree fitting to "The City of Trees." This tree had been maintained periodically by reputable tree services hired under the auspices of the former owner of 1604 Chapin Avenue, who, by actions and statements, believed that the beauty of the silver maple and the shade it offers far outweigh "damage to surrounding hardscape." In fact, very shortly before his mother passed away, the previous owner was speaking with me about having a tree service (Davey Tree was mentioned) come and do maintenance on the tree. Our family empathizes greatly with the new owners of 1604 Chapin Avenue, the Murray's, in their desire to essentially "wipe slick" the 1604 lot and build a house and landscaping totally new that meets their own preferences. We have been happy to meet the Murrays and hear that they are actively "greasing" the way through the Burlingame planning process by hiring respected and connected local architects/technical experts to design and build their new "bungalow." At a sit-down in our house, the Murrays mentioned they had an arborist's opinion regarding the silver maple and suggested the tree may be unsafe. We have expressed our family's concerns to the Murrays in two major areas: site security/lighting and maintaining as long as possible the line of trees and shrubs that has for many years provided both visual and physical separation between our properties, as well as, in the case of the subject silver maple, shade for our front yards. The Murrays indicated they are supportive of our concerns. Therefore, as you might imagine, your letter is disturbing, since it indicates a plan to remove sooner, rather than later, a significant piece of our "separation line," and not for being unsafe, but instead for other reasons, which do not suggest the tree couldn't stay for the foreseeable future. Further, your letter leaves open-ended the question of when and where the "one 24-inch box size tree" will be placed. Please reconsider your decision to issue the removal permit at this time. At a minimum, in the interests of preserving our family's privacy and comfort over the upcoming months of demolition and construction in the 1604 lot, we ask that you delay removal of the tree until a reasonable point in time in the future when we and the Murrays have worked out the nature and timing of the installation of the new landscaping.
