You may appeal the Commission's decision to the City Council in writing by February 26th. Such letters of appeal must be accompanied with a $250 fee (made payable to the City of Burlingame) and delivered to the Parks & Recreation Department, 850 Burlingame Avenue, Burlingame, California, 94010. I may have been remiss in not listing other reasons for removal of these trees but cannot meet your criteria at this time. I am requesting an extension to enable me to make arrangements to meet the criteria in the following Beautification Commission's February Agenda. My husband and I are both physically handicapped. He is diagnosed with Alzheimer's and I am the care -giver (use a walker) and my free time to take care of these details is '1 limited. I will try to obtain an Arborist as soon as possible. If you wish to appeal this decision _you may: 1) Submit an independent Arborist Report supporting justifiable criteria for removal of these trees and/or any other supporting documentation you may have supporting your request for removal and, 2) Appeal this decision in writing to the Burlingame Beautification Commission, 850 Burlingame Avenue, Burlingame. Any documentation must be received at our office by December 22, 2006 if you wish your appeal to be placed on the Beautification Commission's January 4' agenda. I wish to appeal your findings that our request to remove the above Spruce tree does not meet criteria to justify removal based on the reasons sited in our original application and the code sections you referenced. * By review, we stated that the roots growing toward the street have lifted a portion of the sidewalk, creating a trip hazard, and appears to have affected the telephone and cable utility boxes located at the Northeast comer of our property and possibly the PG&E utility box located in the sidewalk at the Northeast comer. * By review, City code Chapter 11.06, sections 11.06.010-11.06.100 state; (1) provides for new residential construction requirements for trees, (2) what is the definition of a protected tree and what is defined as "removal and pruning," (3) further what is defined as pruning of the radiating roots/root bail by more than 113 rd being equivalent to "removal." We would like to amend our original application "reason for removal" to include; the original sidewalk/utility vault damage and include our plans for refurbishing the front yard landscaping as noted; 1. Over time, the Spruce tree roots radiating 70+ degree arch Southerly & Westerly have grown on the surface/lawn to substantial sizes. Obviously seeking water and nutrients from the lawn sprinkler system and fertilizing. Our plans to possibly re -grade the sloping front lawn area, resod and replacement irrigation system would affect the root system substantially. 2. Due to obvious needs, we have plans to replace the wood retaining wall with possibly a concrete wall, from rear of property to street with the adjoining/Eastern property. This would afifectively (cut) the roots which are radiating Easterly into the adjoining property. 3. Repairing the sidewalk in the proper way, requires the roots parallel to the sidewalk be cut back several feet ... running for several feet, and include a root barrier or the roots will grow back. * By review, as you maybe able to surmise from the above, the Spruce tree root system will be effected certainly beyond the 1/3`d. Further that this tree is not the only tree on the property (11.06.090) and we would be willing to replace the tree, to include (this time) a root barrier, with one of a reasonable size and type agreed. Clearly in hind site this spruce tree we planted (formally a live Christmas tree) was not the best decision due to this species maturity size and root system and certainly not the best location. Based on the above amended reasons for removal, please advise if your finds would allow the tree to be removed. Pending your notice, we may well wish to appeal your findings to the commission.
