RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME
ADOPTING GUIDELINES FOR ENFORCEMENT AND MONITORING UNDER THE
INDUSTRIAL WASTE DISCHARGE PROGRAM
RESOLVED, by the City Council of the City of Burlingame:
WHEREAS, the City wishes to safely and properly operate the sanitary sewer system and to
ensure that industrial users and others properly abide by the requirements of the Chapter 15.10 of the
Burlingame Municipal Code and applicable Federal and State requirements; and
WHEREAS, the guidelines attached hereto as Exhibit A are intended to set out procedures
to be generally used in the enforcement and monitoring efforts of the City; and
WHEREAS, this Resolution and the ordinance amending Chapter 10.15 adopted
concurrently with this resolution replace the Sanitary Sewer Use Rules and Regulations adopted in
Resolution No. 74-91; and
WHEREAS, nothing contained in this resolution or the attached guidelines shall constitute
any basis on which any person may allege or claim that the City of Burlingame failed to properly
enforce or monitor any business, discharge, or other activity of any kind,
NOW, THEREFORE, IT IS ORDERED:
1. The Guidelines for Enforcement and Monitoring under the Industrial Waste Discharge
Program attached as Exhibit A hereto are approved.
2. Resolution No. 74-91 is hereby superseded and repealed.

I. Enforcement Response Guidelines
A. Description of Terms
The following terms and abbreviations used in the enforcement guidelines are defined as follows:
AO ----------------------- Administrative order
Civil Litigation --------- Civil litigation against the industrial user seeking equitable relief, monetary
penalties, or actual damages, or a combination of these
Criminal Investigation-- Pursuit of possible punitive measures against an individual or organization
through a court of law
Fine ---------------------- Monetary penalty assessed by Control Authority officials
N ------------------------ Industrial user
Meeting ----------------- Informal compliance meeting with the IU to resolve recurring
noncompliance
NOV--------------------- Notice of Violation
SV ----------------------- Significant Violation
Show Cause ------------ Formal meeting requiring the ICT to appear and demonstrate why the
Control Authority should not take a proposed enforcement action against
it. The meeting may also serve as a forum to discuss corrective action and
compliance schedules

G. Enforcement Noticing and Reply
1. Within thirty (30) days of the date of a notice of violation, a plan for the satisfactory correction of the
violation shall be submitted to the city.
2. When the City finds that a violation has been taking place, the City may require the User to submit for
approval, a detailed time schedule of specific actions that the User shall take in order to prevent or correct
further violations. The City may require that this schedule be prepared by a professional qualified to develop the
proposed actions and schedule.
II. Inspection, Monitoring, and Sampling
A. City will provide adequate identification for all inspections and other authorized personnel to conduct the
inspections and monitoring performed under Chapter 15.10 of the Municipal Code. These persons shall identify
themselves when entering any property for inspection or monitoring purposes, and may request assistance from
the City police or fire services in performing their duties.
B. Guidelines for inspection and sampling are as follows:
1. Light dischargers — no sampling is generally required; inspections will generally occur twice a year.
2. Moderate dischargers — sampling and inspections will generally occur twice a year.
3. Heavy dischargers — sampling will generally occur twice a year; generally there will also be one SIU
inspection and two grease interceptor inspections each year.
4. Non -conventional dischargers — the diverse nature of these dischargers makes a general guideline
difficult, but it is expected that there will be two samples each year plus inspections.
