HomeMy WebLinkAboutReso - CC - 034-2020DocuSign Envelope ID: DADC941 E-E943-457D-81 EC-CF394F900B2F RESOLUTION NO. 034-2020 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME SUSPENDING ENFORCEMENT OF CHAPTER 8.12 OF THE BURLINGAME MUNICIPAL CODE REGARDING RESTRICTIONS ON SINGLE USE BAGS DURING THE COVID-19 PUBLIC HEALTH EMERGENCY WHEREAS, the County of San Mateo and the City of Burlingame sought to reduce unnecessary waste and carbon emissions through regulation of single -use carry out bags; and WHEREAS, the City adopted the County's prohibition on the provision of free single -use carry out bags in 2013; and WHEREAS, a public health emergency has been declared on the national, state, county and local levels related to the infectious disease known as COVID-19; and WHEREAS, grocery stores and restaurants providing takeout and delivery food have been deemed to be essential businesses, necessary to the health and well-being of the public; and WHEREAS, the workers in grocery stores and delivery/takeout services are putting themselves on the front lines in order to serve the public during this public health emergency and deserve whatever protections can be granted to them to keep them healthy; and WHEREAS, reusable bags can be a vector for infection by viruses such as COVID-19; and WHEREAS, the environmental goals served by regulating single -use bags are important but are subordinate to the present public health emergency. NOW, THEREFORE, BE IT RESOLVED THAT: 1. Enforcement of Chapter 8.12 of the Burlingame Municipal Code is suspended for the duration of the current public health emergency, as defined by the longest -applicable emergency declaration of the federal, state, county, or city government, and for 30 days thereafter; 2. Staff is directed to communicate this action to essential businesses such as grocery stores, pharmacies, and takeout/delivery restaurants within the city; 3. Staff is further directed to communicate the expiration of this suspension to the same businesses after the relevant state of emergency has expired.
