ROLL CALL Present: Commissioners Graham, Harvey, Jacobs, Taylor, Sine Absent: Commissioners Cistulli, Mink Staff Present: City Planner John R. Yost, City Engineer Frank C. Erbacher and City Attorney Jerome F. Coleman MINUTES - Upon motion of C. Jacobs, second C. Graham, the minutes of the December 8, 1980 meeting were approved and adopted with the following correction: on page 2, end of second paragraph(under "Discussion") add that the latest building constructed in that area has complied with normal parking require- ments; parking variance for this site would create more traffic congestion on Burlingame's only through street to Highway 101. AGENDA - Upon motion of C. Harvey, second by C. Graham, order of the agenda approved. APPLICATIONS FOR ACTION 1. VARIANCE FROM CODE SEC. 25.50.080 TO ADD A 621 SF SECOND FLOOR BEDROOM AND BATH TO THE EXISTING NON -CONFORMING HOME AT 1451 CALIFORNIA DRIVE (APN 026-072-020), ZONED R-1, BY ROBERT AND MARIANNE BRYANT. CP Yost reviewed this application to remodel the existing two bedroom, one bath house at 1451 California Drive by add.ing a third bedroom and additional bath at the second floor level. Reference staff report dated 1/12/81; site plans indicating the existing floor plan and current proposal; December 15, 1980 and December 29, 1980 letters from Robert and Marianne Bryant; January 9, 1981 memo from the Chief Building Inspector; aerial photo and Project Application and CEQA Assessment accepted by staff 12/19/80. CP Yost reviewed the proposal for the 621 SF bedroom and bath addition to the existing 1400 SF home and the permits required. Staff believed the new addition was reasonable and stated that it met all code standards (except for the existing non -conforming rear yard) and therefore recommended approval. Mr. and Mrs. Robert Bryant, the applicants, were present. Mrs. Bryant discussed their need for the addition in respect to the four legal requirements for a variance. She stated that there will be no visual impact or loss of privacy for the neighbors. Chm. Sine opened the public hearing. There were no comments for or against the application and the public hearing was closed. Concerns: Commission discussed the two concerns noted by the Building Department in their memo; unusual circumstances were noted. C. Jacobs found the four legal require- ments for a variance had been met, that there were unusual circumstances in the shape of the lot and the age of the structure, that additional living space was needed; that there would be no impact on adjacent properties; and that the request conformed to the requirements of the general plan. C. Jacobs moved for approval of the variance with the two conditions listed in the January 9, 1981 Building Department memo; motion seconded by C. Graham. Motion was approved on a 5-0 roll call vote. APPEAL UNDER MUNICIPAL CODE SEC. 18.08.050 FROM UNIFORM BUILDING CODE SEC. 1602a (1976 EDITION) WHICH PROHIBITS TYPE V CONSTRUCTION IN THE TEMPORARY BANKING UNIT FOR THE PACIFIC UNION BANK AND TRUST COMPANY, 360 PRIMROSE ROAD (APN 029-151-220), BY ROGER NYE, PRESIDENT AND CHIEF EXECUTIVE OFFICER. Reference January 9, 1981 memo from the Chief Building Inspector; January 6, 1981 letter from Roger Nye, January 8, 1981 letter from Robert J. Huntsberry and plans date-stamped January 5, 1981 showing the proposed temporary structure. CE Erbacher described the project and its history. He described its code deficiencies and cited sections of the code which were pertinent. Commission discussed the fire hazards involved and ways which the structure could be altered to improve its fire resistance. The project applicant, Mr. Roger Nye, and the project architect, Mr. John Taser were present and discussed the project. Materials used to construct the trailer were described as well as additional materials proposed by Bank Planning Associates to relieve the box -like appearance of the structure. C. Harvey discussed various means to increase the structure's fire resistance and questioned whether the appli- cant would be willing to make these changes. After further discussion, C. Taylor found that with the changes agreed to by the applicant, the temporary banking unit will have adequate safeguards; he therefore moved to sustain the appeal and allow the approval of a building permit with the following conditions: (1) that 5/8" sheetrock shall be added to the interior walls; (2) that wire glass shall be used along the side property line if requested by the fire marshall; and (3) that the structure shall comply with the additional safeguards proposed in Mr. Robert Huntsberry's January 8, 1981 letter on file. Seconded by C. Jacobs.. Motion passed 4-1, C. Graham dissenting. The audience was advised that this decision was final and was not subject to appeal to Council. 3. REVOCATION OF SPECIAL PERMIT APPROVED MAY 14, 1979 TO ALLOW MUNKDALE BROTHERS, INC. TO USE 3.4 ACRES UNDER THE PG & E LINES BEHIND 1576-1700 ROLLINS ROAD TO STORE CARS, RECREATION VEHICLES AND BOATS (AMENDED MARCH 19, 1980 TO STORE AND GROW PLANT MATERIALS) (CONTINUED FROM DECEMBER 8, 1980). Reference January 9, 1981 memo from the City Engineer. This item was continued to the February 9, 1981 Commission meeting to allow time for Mr. Munkdale to perform any required construction or maintenance and achieve compliance with City requirements. 4. TENTATIVE AND FINAL PARCEL MAP TO RESUBDIVIDE LOTS 5, 6 AND 7, BLOCK 5, ANZA AIRPORT PARK UNIT 7 (APN 026-344-010/020/030) INTO TWO PARCELS; PROPERTY AT 777 AIRPORT BOULEVARD, ZONED C-4, BY HOWARD G. HICKEY FOR ANZA SHAREHOLDERS' LIQUI- DATING TRUST (PROPERTY OWNERS). Reference January 6, 1981 memo from the City Engineer advising that the tentative and final parcel map met code requirements and was recommended for Commission's ap- proval. The applicant was present. C. Jacobs moved for approval and recommendation to City Council of this tentAtive and final parcel map; seconded by C. Graham. Motion approved unanimously on voice vote. OTHER ITEMS FOR ACTION 5. REVIEW OF MARCH 10, 1980 SPECIAL PERMIT TO ALLOW DHL CORPORATION TO OPERATE A COURIER SERVICE IN THE M-1 DISTRICT AT 865 HINCKLEY ROAD (APN 026-321-210/310) (CONTINUED FROM OCTOBER 15, 1980). Reference January 12, 1981 staff report from the City Planner; Landscaping Plan date- stamped October 17, 1980 and approved by the Parks Director on October 21, 1980. CP Burlingame Planning Commission Minutes Pa ge 3 January 12, 1981 Yost reviewed the history of this project and stated that the remaining site improve- ments have been completed satisfactorily by DHL Corporation. No further action is therefore necessary at this time by staff of the Commission. After discussion, Com- mission accepted the staff report and requested that DHL Corporation be so notified. 6. REVIEW OF AUGUST 27, 1979 SPECIAL PERMIT TO ALLOW MILLBRAE RENTS, INC. TO OPERATE AN EQUIPMENT AND TRUCK RENTAL BUSINESS AT 1336 ROLLINS ROAD (1337 MARSTEN ROAD) (APN 025-133-010) (CONTINUED FROM SEPTEMBER 8, 1980). Reference January 12, 1981 staff report from the City Planner; copy of a portion of the September 8, 1980 Planning Commission minutes addressing this site. CP Yost re- viewed the history of this Special Permit and stated that the final condition requiring installation of landscaping has been completed. The property is now consistent with the terms and limitations of the August 27, 1979 permit and no further action is neces- sary at this time. This report was accepted by the Commission and staff was directed to notify the applicant. 7. ADOPTION OF 1981 PLANNING COMMISSION MEETING SCHEDULE. Reference copy of the proposed 1981 Planning Commission Schedule. Motion to approve the proposed agenda was made by C. Jacobs.; seconded by C. Graham. Motion passed on a 4-0 roll call vote, Chm. SPECIAL PERMIT TO CONSTRUCT A 21,300 SF OFFICE BUILDING IN THE BURLINGAME AVENUE OFF-STREET PARKING DISTRICT AT 345 LORTON AVENUE, ZONED C-1, BY TONY CARRASCO OF D.L. WALKER ARCHITECTURAL SERVICES. 11. SPECIAL PERMIT TO CONSTRUCT A 1,800 SF PENTHOUSE (WITH A ROOF HEIGHT OF 40'5") ON THE PROPOSED OFFICE BUILDING AT 345 LORTON AVENUE, ZONED C-1, BY TONY CARRASCO OF D.L. WALKER ARCHITECTURAL SERVICES. 12. SPECIAL PERMIT TO OPERATE A COFFEE SHOP IN THE M-1 DISTRICT AT 866 MALCOLM ROAD BY LEE L. FONG. 13. COUNCIL HEARINGS: Page 4 January 12, 1981 - Variance to construct an 8..100 SF Church at 701 Firfield Road without on-site parking: December 14, 1980 hearing - Approved Conditionally. - Variance to construct a 6,575 SF commercial building at 1199 Broadway with 8 on-site parking spaces (rather thanthe required 17 spaces): January 5, 1981 hearing - Continued by Council for preparation of resolution which would limit the types of businesses which could occupy the new commercial building. 17.
