RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME ACCEPTING
GRANT OF EASEMENT FROM 765 AIRPORT BOULEVARD L.P.
FOR PEDESTRIAN EASEMENT
RESOLVED, by the City Council of the City of Burlingame:
WHEREAS, the owners of the real property at 765 Airport Boulevard have developed a
new hotel; and
WHEREAS, in order to properly accommodate the hotel's entrance, the public sidewalk
must be placed on the private property; and
WHEREAS, because this accommodation is for private benefit, the owners are willing to
grant a pedestrian easement to accommodate the public sidewalk and to maintain that easement
in a safe and passable condition,
NOW, THEREFORE, IT IS ORDERED:
1. The Grant Deed for Pedestrian Easement attached hereto as Exhibit A is approved and
accepted, and the City Manager is authorized and directed to accept the Deed by and on behalf of the
City..
2. The City Clerk is directed to record the Deed and this Resolution with the County
Recorder of the County of San Mateo.

(oiBURLINGAME, a municipal corporation ("City"), a pedestrian easement on, over along and in that

6g o certain parcel of real property situate, lying and being in the City of Burlingame, County of San

O& Mateo, State of California, as generally shown in Exhibit A hereto, and as more particularly described

Grantor further agrees and covenants that it shall be responsible for all maintenance and repair
of the sidewalk and easement area, and shall keep it in a condition safe for pedestrian use at all times,
and that City shall have no responsibility or liability for the safety, maintenance, or repair of the
easement area.
This Grant shall run with the land and bind and inure to the benefit of and shall be binding on
the respective heirs, personal representatives, successors, and assigns of the parties hereto.
This Grant shall be recorded in the official documents of the San Mateo County Recorder.
