HomeMy WebLinkAboutReso - CC - 023-2000RESOLUTION NO. 23-2000 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME APPROVING NEGATIVE DECLARATION, PURCHASE AND SALE AGREEMENT BETWEEN THE CITY AND THE DOUGHERTY CHARITABLE TRUST, AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENT ON BEHALF OF THE CITY, AUTHORIZING THE CITY MANAGER TO ACCEPT GRANT DEED, AND ALLOCATING MONEY FOR PURCHASE AND PROJECT PROPERTY: 1140 LAGUNA AVENUE, BURLINGAME, CALIFORNIA APN 026-192-210 RESOLVED, by the City Council of the City of Burlingame: WHEREAS, the real property at 1140 Laguna Avenue, Burlingame, California has been placed on the market for sale; and WHEREAS, the property is currently unoccupied containing a structure that is no longer habitable; and WHEREAS, the property could serve as an important additional parking area to serve the Broadway area and to improve circulation in the area, particularly from the Chula Vista Avenue parking area; and WHEREAS, the City has obtained an appraisal delineating the value range for the property, and WHEREAS, the City has also prepared a negative declaration pursuant to the California Environmental Quality Act that describes the acquisition, possible alternatives for improvements, and possible adverse environmental impacts; and WHEREAS, the negative declaration concludes that no significant environmental impacts will occur from either acquisition or improvement of the property as a parking area; and WHEREAS, on January 31, 2000, the Burlingame Planning Commission held a public hearing and after consideration, determined that the proposed acquisition and parking area were consistent with the Burlingame General Plan and that the negative declaration was appropriate and approvable; and WHEREAS, the City has submitted a bid and further negotiated with the property owner, and the owner is willing to convey the property to the City for the sum of $615,000 pursuant to the Purchase and Sale Agreement attached to this resolution as Exhibit A; and WHEREAS, the property owner has further provided written assurances to the City that the high bid submitted for the property was not obtained or submitted for consideration of any kind; and WHEREAS, it appears that the purchase price is reasonable in light of the frenzied real estate market in the Bay Area; and WHEREAS, the negative declaration has been prepared, noticed, and reviewed in conformance with the requirements of the California Environmental Quality Act and the CEQA Guidelines, and the Council has considered the negative declaration before adopting this resolution; and WHEREAS, the proposed acquisition of the property and use as a parking area would be consistent with the Burlingame General Plan, and the City was prepared to consider a resolution of necessity to acquire the property be eminent domain; and WHEREAS, this acquisition by the City is in the public interest, NOW, THEREFORE, IT IS RESOLVED AND ORDERED: 1. The negative declaration is approved. 2. The Purchase and Sale Agreement attached hereto as Exhibit A is approved. 3. The City Manager is authorized and directed to execute the Purchase and Sale Agreement by and on behalf of the City of Burlingame, and the Clerk is directed to attest to the signature of the City Manager. 4. The City Manager is further authorized and directed to execute an acceptance by the City of a standard form Grant Deed and such other documents necessary in connection with the Purchase and Sale Agreement, and the Clerk is directed to attest to the signature of the City Manager. 5. The sum of $500,000 is allocated from Capital Project 79340 — Parking Lot Improvements — and a further $270,000 from unallocated general fund balances for the price of purchase as well as improvement, legal, appraisal, and title costs. /24'e w 1% • 0' Iy`& MAYOR I, ANN T.
