HomeMy WebLinkAboutReso - CC - 016-2000RESOLUTION NO. 16-2000 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME AGREEING TO THE REQUIREMENTS OF THE METROPOLITAN TRANSPORTATION COMMISSION, STATE OF CALIFORNIA, AND UNITED STATES GOVERNMENT FOR THE FEDERAL SURFACE TRANSPORTATION PROGRAM AND CONGESTION MITIGATION AND AIR QUALITY PROGRAM RESOLVED, by the City Council of the City of Burlingame: WHEREAS, the City of Burlingame has authority under the California Government Code §§ 34000 and following for the exercise of the powers of a city government; and WHEREAS, the Transportation Equity Act for the 21" Century (TEA 21) (Public Law 105-178, June 9, 1998) and the TEA 21 Restoration Act (Public Law 105-206, July 22, 1998) continue the Surface Transportation Program (23 U.S.C. § 133) and the Congestion Mitigation and Air Quality Improvement Program (CMAQ) (23 U.S. C. § 149); and WHEREAS, pursuant to TEA 21 and the regulations promulgated thereunder, eligible project sponsors wishing to receive Surface Transportation or Congestion Mitigation and Air Quality Improvement Program grants for a project shall submit an application first with the appropriate metropolitan transportation planning organization (MPO) for review and inclusion in the MPO's Transportation Improvement Program (TIP); and WHEREAS, the Metropolitan Transportation Commission (MTC) is the MPO for the San Francisco Bay region; and WHEREAS, the City of Burlingame is an eligible project sponsor for Surface Transportation Program or Congestion Mitigation and Air Quality Improvement Program funds; and WHEREAS, the City has duly submitted a grant application to MTC for funds from the Surface Transportation Program or Congestion Mitigation and Air Quality Improvement Program in fiscal year 2000 for the following projects: Bayshore Boulevard Rehabilitation California Drive Rehabilitation Rollins Road Rehabilitation Skyline Boulevard Rehabilitation TOTAL $ 500,000 $ 490,000 $ 490,000 $ 315,000 $1,795,000 WHEREAS, MTC requires, as part of the application, a resolution stating the following: a. The commitment of necessary local matching funds of at least 50%; and b. That the sponsor understands that the Surface Transportation Program and Congestion Mitigation and Air Quality Improvement Program funding is fixed at the programmed amount, and therefore, any cost increase cannot be expected to be funded with Surface Transportation Program or Congestion Mitigation and Air Quality Improvement Program funds; and c. The assurance of the sponsor to complete the project as described in the application, and if approved, as programmed in WC's TIP; and d. That the sponsor understands that funds will be obligated by September 30, 2002, or the project may be removed from the program, NOW, THEREFORE, IT IS RESOLVED AND ORDERED: 1. The City of Burlingame states the following: A. The City will provide the following amounts of at least 50% of the projects' costs in local matching funds: Bayshore Boulevard Rehabilitation $ 250,000 California Drive Rehabilitation $ 290,000 Rollins Road Rehabilitation $ 245,000 Skyline Boulevard Rehabilitation $ 185,000 TOTAL ---- $ 960,000 B. The City understands that the Surface Transportation Program and Congestion Mitigation and Air Quality Program funding for these projects is fixed at $ 835,000 total, and any cost increases must be funded by the City from local matching funds, and that the City does not expect any cost increases to be funded with Surface Transportation Program or Congestion Mitigation and Air Quality Program funds. C. The projects will be built as described in this resolution and if approved, as programmed in the Metropolitan Transportation Commission (MTC) Transportation Improvement Program (TIP). D. The program funds will be obligated by September 30, 2002. 3. A copy of this resolution will be transmitted to MTC. /Yi , 0 MAYOR I, ANN T.
