RESOLUTION APPROVING CONDITIONAL USE PERMIT TO ALLOW REAL
ESTATE USE ON THE GROUND FLOOR OF THE REAL PROPERTY
AT 320-350 PRIMROSE ROAD
ZONE: C-1, SUBAREA B-1 (PROPOSED)
PROPERTY OWNERS AND APPLICANTS: PRIMROSE PLAZA PARTNERS

RESOLVED, by the City Council of the City of Burlingame:
WHEREAS, theproperty owners of 320-350 Primrose Road have applied for a conditional
use permit for real estate office use on the ground floor; and
WHEREAS, the Planning Commission of the City of Burlingame held a public hearing
on November 8, 1999, at which time the Commission reviewed and considered the staff report
and all other written materials and testimony presented to the Commission on this application; and
WHEREAS, the Planning Commission recommended approval of theproposed conditional
use permit subject to conditions; and
WHEREAS, on December 6, 1999, the City Council held a public hearing on the
conditional use permit and received and considered all written and oral testimony presented on the
matter; and
WHEREAS, the City Council considered the negative declaration prepared in connection
with the application and approved it; and
WHEREAS, on December 6, 1999, the City Council approved a General Plan
Amendment proposed for 320-350 Primrose Road by a resolution combining approval of the
Amendment and the underlying conditional use permit; and
WHEREAS, the proposed conditional use would not adversely affect property in the area;
and

WHEREAS, this Resolution is intended to separately confirm the conditional use permit
approval so that title to the property is not confused; and
WHEREAS, this conditional use permit cannot become effective until such time as an
ordinance adopting a Zoning Map amendment to change the zoning of the property at 320-350
Primrose Road from C-1, Subarea A, to C-1, Subarea B-1, becomes effective; and
WHEREAS, the ordinance making the zoning change was adopted by the Council on
January 4, 2000, and is scheduled to be effective on February 4, 2000,
NOW, THEREFORE, IT IS RESOLVED AND ORDERED:
1. Approval of the conditional use permit allowing real estate use on the ground floor
of 320-350 Primrose Road, Burlingame, California, pursuant to the application filed by Primrose
Plaza Partners, and subject to the conditions attached as Exhibit A hereto, is affirmed. However,
this approval shall not be effective until such time as Ordinance No. 1621 becomes effective.
2. The City Clerk is requested to record a copy of this resolution in the official records
of the Recorder of the County of San Mateo.

1. that the project shall be built as shown on the plans submitted to the Planning Department
and date stamped October 5, 1999, Sheets P-1;
2. that the real estate office may not be open for business except during the hours of 8:30
A.M. to 5:30 P.M., Monday through Friday, and 9:30 A.M. and 4:30 P.M. on weekends,
with no more than 28 employees in the total real estate use on the first floor (4000 SF);
3. that the conditions of the Chief Building Official's October 7, 1999 memo shall be met; and
4. that any improvements for the use shall meet all California Building and Fire Codes, 1998
Edition as amended by the City of Burlingame.
