HomeMy WebLinkAboutReso - CC - 134-2001RESOLUTION NO. 134-2001 RESOLUTION DETERMINING 247 CALIFORNIA DRIVE TO BE PEDESTRIAN ORIENTED RETAIL SALES BUSINESS RESOLVED by the CITY COUNCIL of the City of Burlingame that: WHEREAS, a determination has been requested and application has been made for a pedestrian oriented retail sales business with nonconforming parking at 247 California Drive, zoned C-1, Subarea B, Basim and Linda Azar, property owner, APN: 029-211-050; WHEREAS, the Planning Commission held a public hearing on said application on October 22, 2001, at which time said application was approved; WHEREAS, this matter was called up City Council and a hearing thereon held on December 3, 2001 , at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing; NOW, THEREFORE, it is hereby RESOLVED and DETERMINED by this Council that: 1. Said graphic art and design business at 247 California Drive is a pedestrian oriented retail sales business because it has a substantial taxable sales component and is pedestrian friendly with walk in retail business/trade. With this determination that the present graphics art and design business is a pedestrian oriented retail sales business, no parking variance is required because the present business is replacing a pedestrian oriented retail business with nonconforming parking. Findings for such determination are as set forth in the minutes and recording of said meeting. 2. It is further directed that a certified copy of this resolution be recorded in the official records of the County of San Mateo.
