HomeMy WebLinkAboutReso - CC - 110-2001RESOLUTION APPROVING CATEGORICAL EXEMPTION, FENCE EXCEPTION AND HEDGE EXCEPTION RESOLUTION #110-2001 RESOLVED by the CITY COUNCIL of the City of Burlingame that: WHEREAS, a categorical exemption has been proposed and application has been made for a fence and a hedge exception for an existing fence and hedge at 1705 Easton Drive, zoned R-1, Donelson and Jane Berger, property owners, APN: 026-153-140; WHEREAS, this matter was appealed to City Council- and a hearing thereon held on October 1. 2001, at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing; WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on August 27, 2001, at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing and said application was APPROVED ; NOW, THEREFORE, it is hereby RESOLVED and DETERMINED by this Council that: 1. On the basis of the Initial Study and the documents submitted and reviewed, and comments received and addressed by this commission, it is hereby found that there is no substantial evidence that the project set forth above will have a significant effect on the environment, and categorical exemption, per CEQA Article 19. Categorically Exempt per Section: 15303 - New Construction or Conversion of Small Structures Class 3 (e), Accessory (appurtenant) structures including garages, carports, patios, swimming pools and fences. 2. Said fence exception and hedge exception are approved, subject to the conditions set forth in Exhibit "A" attached hereto. Findings for such exceptions are as set forth in the minutes and recording of said meeting. 3. It is further directed that a certified copy of this resolution be recorded in the official records of the County of San Mateo. o� Y -I, ANN MUSSO, City Clerk of the City of Burlingame, do hereby certify that the foregoing resolution was introduced at a regular meeting of the City Council held on the 1 st day of October, 2001 , and adopted thereafter by the following vote: AYES: COUNCILMEMBERS: Coffey, Janney, O'Mahoney AND Spinelli NOES: COUNCILMEMBERS: Galligan ABSENT: COUNCILMEMBERS: None (�G /�vt-J� � C�� CITY CLERK EXHIBIT "A" Conditions of approval for a fence and hedge exceptions 1705 EASTON DRIVE effective OCTOBER 1, 2001 that the fence shall be maintained as shown on the plans submitted to the Planning Department date stamped June 20, 2001; with the first 26'-0" of the fence from the front property line at 5'-0" in height, with 33'-0" of bamboo hedge maintained at 8'-4" in height and 35 feet of wood board fence at 8'-4", and the remaining 84 feet of fence extending from the 8'-4" board fence to the rear property line made up of 23 feet of solid wood board fence at 5'-0" in height and 57 feet of wire fence covered with ivy at 5'-0" in height; 2. that the fence exception of 8'-4" shall apply only to those portions of the fence in excess of 8'-4" on October 1, 2001, and that the existing post which exceeds 8'-4" shall be reduced to the height of the closest portion of wooden board fence not to exceed 8'-4"; 3. that the applicant shall obtain an encroachment permit for the existing 5'-0" high fence along the right side of the property and encroaching by 4'-0" into the public right-of-way; this encroachment permit shall be valid until the fence is removed or destroyed; 4. that if the 35 feet of 8'-4"wooden board fence or 33 feet of bamboo hedge are not maintained at the 8' — 4" height they shall be replaced by a wooden fence at the height allowed by the code at the time replacement is required; and 5. that the project shall meet all the requirements of the California Building and Fire Codes, 1998 edition, as amended by the City of Burlingame. `A Recording Requested by: Ann T.
