RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME REVISING
PROCEDURES FOR SETTLEMENT AND PAYMENT OF SELF-INSURANCE CLAIMS
RESOLVED, by the City Council of the City of Burlingame:
WHEREAS, since 1976, the City of Burlingame has been self-insured for general liability
and property damage; and
WHEREAS, since 1979, the City of Burlingame has been permissibly self-insured for
workers compensation claims; and
WHEREAS, it is appropriate to revise the settlement authority limits in light of escalating
costs from time to time and to clarify procedures,
NOW, THEREFORE, IT IS ORDERED:
1. The City Attorney shall be the risk manager for the City's self-insured program and is
authorized to review and administratively deny any general liability claims valued at up to $5,000,
and to settle any general liability claims and make payments up to a maximum amount of $5,000 for
any one person for a single claim.
2. The City Attorney with the approval of the City Manager is authorized to review and
administratively deny any general liability claims valued up to $7,500, and to settle general liability
claims and make payments up to the maximum amount of $7,500.
3. The City Attorney with the approval of the City Manager and City Council shall be
authorized to make such payments and settle such claims up to the maximum amount of the self
insured retention for general liability purposes.
4. The Human Resources Director in consultation with the City Attorney is authorized to
review, deny, and resolve workers compensation claims up to $10,000.
5. The City Manager in consultation with the Human Resources Director and the City
Attorney is authorized to review, deny, and resolve workers compensation claims up to the
maximum amount of the self-insured retention of the City.
6. This resolution supersedes Resolution No. 76-96.
