RESOLUTION APPROVING CATEGORICAL EXEMPTION
AND PARKING VARIANCE
RESOLVED by the CITY COUNCIL of the City of Burlingame that:
WHEREAS, a categorical exemption has been proposed and application has been made for a
parking variance for converting an existing storage room to a studio unit at 1209 Bellevue Avenue,
zoned R-4, Estee Coldwell, property owner, APN: 029-151-090;
WHEREAS, the Planning Commission held a public hearing on said application on Febru
12, 2001, at which time said application was denied;
WHEREAS, this matter was appealed to City Council and a hearing thereon held on May 7,
2001, at which time it reviewed and considered the staff report and all other written materials and
testimony presented at said hearing;
NOW, THEREFORE, it is hereby RESOLVED and DETERMINED by this Council that the
categorical exemption and parking variance are approved and:
1. that a parking variance of two parking spaces shall be granted to this site so long as the converted
storage unit at the rear of the building at grade is maintained and continuously priced as
affordable as a low income housing unit for a single individual based on the income definition
table used for the Federal Block Grant Program and the tenant occupying that unit does not own
a motor vehicle or cause a motor vehicle to be parked on the site, failure to comply with either
of these requirements shall mean that the variance shall be voided, all utilities and improvements
removed within 30 days and the dwelling unit returned to common storage/laundry use for all
tenants on the site;
2. that the storage unit shall be unoccupied and vacant at this time and shall remain unoccupied and
unleased until it has been inspected, corrected to compliance with the California Building and
Fire Code requirements as determined by the Fire Marshal and Chief Building Official and an
occupancy permit has been issued by the City Building Official; and the City Attorney has
approved as to form the terms of a lease agreement for the unit to be administered by the Shelter
Network or another non-profit, community service agency qualified for such activity and
authorized by the City;
3. that the Burlingame Building Department shall be called to inspect the installation of the toilet,
shower, sinks (bathroom and kitchen) and all plumbing and gas connections into the storage unit
within 15 days of the city action on the variance and shall provide to the applicant, in writing, a
report noting all of the corrections to be made;
4. that the required improvements shall be installed and final inspection called for within 45 days
of the issuance of the Chief Building Official's written report, a building permit shall be required
to be issued before any work can commence on the site;

5. it shall be the responsibility of the applicant to call for final inspections, correct punch lists,
receive an occupancy permit, negotiate an agreement with Shelter Network and get the City
Attorney's review of that agreement included that the rent charged shall include the cost of all
utility services and that the tenant shall not own or possess a car, truck or similar motor vehicle,
and notify the city Planning Department of the fact that a qualified tenant has been secured and
a specific date of occupancy established, before any tenant occupies the space; failure to do this
and failure to make an annual report based on the date of the first occupancy to the Planning
Department regarding compliance with the conditions of approval shall cause the parking
variance to be reviewed by the Planning Commission and/or City Council and, in any event, the
variance shall be reviewed in two (2) years from the date of the unit's occupancy for compliance
with the conditions of approval;
6. that the rent for the first year of occupancy shall not exceed $700. per month, including all
utilities; and
that staff shall review the unit for compliance eighteen (18) months after occupancy of the unit
by a tenant.

and adopted thereafter by the following vote:
