CALL TO ORDER A duly noticed regular meeting of the Burlingame City Council was held on the above date in the City Hall Council Chambers. Mayor Ann Keighran called the meeting to order at 7:00 p.m. CLOSED SESSION CA Guinan advised that the Council met in closed session and gave direction on the four items. There was no reportable action. 2. PLEDGE OF ALLEGIANCE TO THE FLAG Led by Rudy Horak. 3. ROLL CALL COUNCILMEMBERS PRESENT: Baylock, Brownrigg, Deal, Keighran, Nagel COUNCILMEMBERS ABSENT: None 4. MINUTES Councilwoman Baylock made a motion to approve the minutes of the March 4, 2013 regular Council meeting; seconded by Councilwoman Nagel. The motion was approved by voice vote, 5-0. Councilwoman Baylock made a motion to approve the minutes of the March 5, 2013 Budget Study Session meeting; seconded by Councilwoman Nagel. The motion was approved by voice vote, 5-0. 5. UPCOMING EVENTS Mayor Keighran reviewed the upcoming events taking place in the City. 6. PRESENTATION a. RECOGNITION OF BURLINGAME HIGH SCHOOL STUDENT ZACH MARTINUCCI AS A JEFFERSON AWARD RECIPIENT Mayor Keighran presented Zach Martinucci with a Certificate of Appreciation for all his efforts on behalf of Cancer and the Relay for Life. HEARING ON APPLICATION FOR A PERMIT TO MAINTAIN MORE THAN THREE CATS AT HER RESIDENCE CA Guinan reviewed the staff report and requested Council hold a public hearing and determine to either grant or deny the permit allowing the applicant to have more than three cats in her home. CA Guinan advised that the applicant had a verified petition indicating that a majority of residents within 400 feet of her residence have consented to the excessive number of cats at her home. CA Guinan further advised that the City mailed a notice of this hearing to all the residents within 400 feet of the applicant’s home. Councilman Deal made a correction to the proposed Resolution to insert the word “no” before more than five cats in paragraph two, page two. Mayor Keighran opened the public hearing and the applicant, Kathleen Gorman addressed the Council. She advised that she volunteers at the Peninsula Humane Society and cares for feral cats at her home until they are ready for adoption. There were no further comments from the floor, and the hearing was closed. Vice Mayor Brownrigg made a motion to adopt Resolution No. 24-2013 granting a permit to Ms. Kathleen Gorman to maintain a maximum of five cats on her premises on Bancroft Road in Burlingame; seconded by Councilman Deal. The motion was approved unanimously 5-0. b. PUBLIC HEARING TO CONSIDER ADOPTION OF AN ORDINANCE ADDING CHAPTER 8.12 TO THE BURLINGAME MUNICPAL CODE RESTRICTING THE USE OF SINGLE USE CARRY-OUT BAGS AND ENCOURAGING THE USE OF REUSABLE BAGS CDD Meeker reviewed the staff report and requested Council adopt the Ordinance that was introduced at the March 4, 2013 Council meeting restricting the use of single carry-out bags and encouraging the use of reusable bags. Mr. Wayman Wong of San Mateo County Environmental Health clarified a few concerns expressed by the Council. Mayor Keighran opened the public hearing and Burlingame resident Larry Stevenson spoke in opposition to the ordinance; Burlingame resident Mike McCord spoke in favor of the ordinance. There were no further comments from the floor, and the hearing was closed. Councilwoman Nagel made a motion to adopt Ordinance No. 1883 adding Chapter 8.12 to the Burlingame Municipal Code restricting the use of single-use carry out bags and encouraging the use of reusable bags; seconded by Councilman Deal. The motion was approved unanimously by voice vote, 5–0. Mayor Keighran directed the City Clerk to publish a summary of the proposed Ordinance within 15 days of adoption. ADOPT AN ORDINANCE DELEGATING TO CITYMANAGER THE AUTHORITY TO APPOINT THE CITY CLERK CA Guinan reviewed the staff report and requested Council adopt the Ordinance that was introduced at the March 4, 2013 Council meeting delegating the appointment of the City Clerk to the City Manager. Mayor Keighran opened the public hearing. There were no comments from the floor, and the hearing was closed. Councilwoman Baylock made a motion to adopt Ordinance 1884 implementing Ballot Measure I of the November 2009 election making the office of Burlingame City Clerk an appointive position; seconded by Vice Mayor Brownrigg. The motion was approved unanimously by voice vote, 5–0. Mayor Keighran directed the City Clerk to publish a summary of the proposed Ordinance within 15 days of the public hearing. 8. PUBLIC COMMENTS Burlingame resident Rudy Horak spoke on item 10b. There were no further comments from the floor. 9. STAFF REPORTS AND COMMUNICATIONS a. SEWER SYSTEM MANAGEMENT PLAN (SSMP) UPDATE PW Superintendent Rob Mallick gave a presentation covering the background, key elements, program implementation, and results of the sewer system management plan. He advised that the City has performed closed circuit TV inspection of 100 miles of sewer pipelines in the last five years and identified nearly 1,800 structural and maintenance deficiencies. He further advised that as a result of the adoption and implementation of the Sewer System Management Plan, the sewage spills for sewer mainlines have been reduced by 78%; the sewage spills for sewer laterals have been reduced by 92%; and for the year 2012, Burlingame has the lowest average spill rate in the region. PW Superintendent Mallick concluded his presentation and thanked the Council for their support in providing the proper funding and management that led to the success of the program. Mayor Keighran thanked Superintendent Mallick, Public Works Director Murtuza and their staff for these significant accomplishments. 10. CONSENT CALENDAR Mayor Keighran requested a motion to adopt items 10a and 10c together and item 10b would be done separately since Councilwoman Baylock needed to recuse herself. Councilwoman Nagel made a motion to adopt items 10a and 10c of the consent calendar; seconded by Councilman Deal. The motion was approved unanimously 5-0. a. ADOPT A RESOLUTION APPROVING AN AMENDMENT TO WATER SUPPLY AGREEMENT WITH THE CITY AND COUNTY OF SAN FRANCISCO Burlingame City Council March 18, 2013 Approved Minutes 4 DPW Murtuza requested Council adopt Resolution No.25 -2013 approving an amendment to execute an amendment to the Water Supply Agreement with the City and County of San Francisco. b. ADOPT A RESOLUTION APPROVING MODIFICATIONS TO THE COMMERCIAL LEASE AGREEMENT WITH RINO BETTI FOR 1080 HOWARD AVENUE (SAM’S ITALIAN SANDWICH COMPANY P&RD Glomstad requested Council adopt Resolution No. 26-2013 approving and authorizing the Mayor to execute amendment No. 2 to the rental agreement with Mr. Rino Betti for the premises at 1080 Howard Avenue. Councilman Deal made motion to approve item 10b; seconded by Councilwoman Nagel. The motion was approved 4-0-1 (Baylock recused). Vice Mayor Brownrigg clarified that the City was not involved, nor soliciting any donations for Sam’s Italian Sandwich Shop as mentioned in the newspaper. CA Guinan confirmed that the City was merely acting as the Escrow Agent for the funds coming into the City to defray the cost of rent on City owned property. c. ADOPT RESOLUTIONS CONFIRMING THE APPOINTMENT OF FINANCE DIRECTOR/ TREASURER AND DESIGNATING CERTAIN EMPLOYEES AS OFFICIAL SIGNATORIES ON CITY BANKING AND INVESTMENT ACCOUNTS CM Goldman requested Council adopt Resolution No. 27-2013 approving the appointment of Carol T. Augustine as the Finance Director/Treasurer for the City of Burlingame. CM Goldman requested Council adopt Resolution No. 28-2013 authorizing City of Burlingame signatories for city checks, draft and other orders on Bank of America. CM Goldman requested Council adopt Resolution No. 29-2013 authorizing investment of monies in the State of California Local Agency Investment Fund. 11. COUNCIL COMMITTEE AND ACTIVITIES REPORTS AND ANNOUNCEMENTS Council reported on various events and committee meetings each of them attended on behalf of the City. 12. PUBLIC COMMENTS CA Guinan addressed the Council and expressed his honor at having served with such an esteemed group of Council members. He reviewed the issues that they individually championed, and said their constituents are very fortunate to have a group of such hard working, intelligent and talented Council members. 13. FUTURE AGENDA ITEMS Councilwoman Nagel requested that an invitation to an upcoming C/CAG meeting on April 11, 2013, to get feedback on “Plan Bay Area”, be placed on the April 1, 2013 agenda. 14.
