CALL TO ORDER A duly noticed regular meeting of the Burlingame City Council was held on the above date in the City Hall Council Chambers. Mayor Keighran called the meeting to order at 7:00 p.m. 2. PLEDGE OF ALLEGIANCE TO THE FLAG Led by Mary Hunt. 3. ROLL CALL MEMBERS PRESENT: Baylock, Brownrigg, Deal, Keighran, Nagel MEMBERS ABSENT: None 4. REPORT OUT FROM CLOSED SESSION There was no closed session. 5. UPCOMING EVENTS Mayor Keighran reviewed the upcoming events taking place in the City. 6. PRESENTATION a. BUSINESS LANDSCAPE AWARD PRESENTATION TO URBAN BISTRO Beautification Commissioner, and Chair of the Landscape Award Committee Richard Kirchner reviewed the previous winners of the Landscape Award and introduced fellow Beautification Commissioners Leslie McQuaide, Anne Hinckle, Mary Hunt and Karen Dittman. He also introduced local artist, Dale Perkins who provided watercolor renderings of the winning business to the Council members, City Hall, the Library and City Manager. He also provided a large original watercolor to Urban Bistro to be displayed at their business. Richard Kirchner presented the business landscape award to Urban Bistro owners Steven and Jennifer Sarver and they thanked the Commission and the City. 7. CONSENT CALENDAR Councilwoman Baylock made a motion to approve the Consent Calendar; seconded by Vice Mayor —� Brownrigg. The motion was approved unanimously by voice vote, 5-0. a. APPROVE THE CITY COUNCIL MEETING MINUTES OF SEPTEMBER 16 2013 CC Kearney requested Council approve the minutes of the September 16, 2013 City Council meeting. b. ADOPTION OF AN ORDINANCE FOR A TWO-HOUR PARKING RESTRICTION ON THE 1600 BLOCK OF HOWARD AVENUE DPW Murtuza requested Council adopt Ordinance 1886 for a two-hour parking restriction on the 1600 block of Howard Avenue. C. ADOPTION OF AN AMENDMENT TO CHAPTER 12.23 OF THE MUNICIPAL CODE TO REVISE STANDARDS FOR THE PLACEMENT ANDMAINTENANCE OF NEWSRACKS IN PUBLIC RIGHTS-OF-WAY DPW Murtuza requested Council adopt Ordinance 1887 to revise the standards for the placement and maintenance of newsracks in public rights-of-way. d. (i)ADOPTION OF AN ORDINANCE TO AMEND TITLE 17 OF THE BURLINGAME MUNICIPAL CODE AND ADOPTION BY REFERENCE OF THE 2013 CALIFORNIA FIRE CODE (TITLE 24, PART 9, CFC) AND THE 2012 EDITION OF THE INTERNATIONAL FIRE CODE; AND (ii) ADOPTION OF AN ORDINANCE TO AMEND TITLE 18 OF THE MUNICIPAL CODE TO ADOPT THE 2013 CALIFORNIA BUILDING CODES WITH LOCAL AMENDMENTS CBO Cyr requested Council adopt Ordinance 1888 amending Title 18 of the Municipal Code to adopt the 2013 Building Codes with local amendments. Fire Inspector Reed requested Council adopt Ordinance 1889 amending Title 17 of the Municipal Code and adoption by reference of the 2013 California Fire Code and the 2012 edition of the International Fire Code. 9. PUBLIC HEARINGS a. PUBLIC HEARING TO INTRODUCE AN ORDINANCE AMENDING CHAPTER 10 (FIREWORKS) OF THE BURLINGAME MUNICIPAL CODE Fire Inspector Reed reviewed the staff report and advised that currently the prohibition of possession and use of fireworks is addressed in Chapters 17.04 and 10. The proposed amendment to Chapter 10 combines enforcement language from both Chapters and assists in the standardization of Municipal Codes among Central County, Millbrae and San Bruno. Mayor Keighran requested CC Kearney read the title of the proposed Ordinance. Vice Mayor Brownrigg made a motion to waive further reading and introduce the Ordinance amending Title 10 of the Municipal --� Code; seconded by Councilwoman Baylock. The motion was approved by voice vote, 5-0. 2 Burlingame City Council October 7,2013 Approved Minutes Mayor Keighran directed the City Clerk to publish a summary of the proposed Ordinance within 5 days of the public hearing. Mayor Keighran opened the public hearing. There were no comments from the floor, and the hearing was closed. b. INTRODUCTION OF AN ORDINANCE AMENDING TITLE 3 OF THE BURLINGAME MUNICIPAL CODE TO ADJUST SIGNATURE AND SETTLEMENT AUTHORITY FOR THE CITY MANAGER AND THE CITY ATTORNEY CA Kane reviewed the staff report and advised that the proposed Ordinance amending Title 3 of the Burlingame Municipal Code will clarify the signature authority of the City Manager and City Attorney and will serve to codify the settlement authority exercised by these individuals. Council agreed to introduce the proposed Ordinance, as written, but would like to set a policy that claim settlements be reported to them more frequently than on a fiscal year basis. Mayor Keighran requested CC Kearney read the title of the proposed Ordinance. Councilwoman Nagel made a motion to waive further reading and introduce the Ordinance amending Title 3 of the Municipal Code, Chapters 3.04 City Manager and 3.05 City Attorney, to confer contracting signature authority on the City Manager for all City contracts under $100,000 and the City Attorney for retention of outside Legal Counsel and to provide for limited settlement authority exercisable by the City Attorney and City Manager; seconded by Councilwoman Baylock. The motion was approved by voice vote, 5-0. Mayor Keighran directed the City Clerk to publish a summary of the proposed Ordinance within 5 days of the public hearing. Mayor Keighran opened the public hearing. There were no comments from the floor, and the hearing was closed. 10. STAFF REPORTS AND COMMUNICATIONS There were no staff reports. 11. COUNCIL COMMITTEE AND ACTIVITIES REPORTS AND ANNOUNCEMENTS Council reported on various events and committee meetings they each attended on behalf of the City. 12. FUTURE AGENDA ITEMS Councilman Deal would like to discuss writing a letter to Caltrain about tunneling, rather than trenching,to install fiber optic cable. DPW Murtuza commented that staff has been working with Caltrain and the trenching is very minimal and in some places it is boring. Mayor Keighran would like to address residential street parking at a future meeting or at the Goal Setting Session in January. Councilwoman Nagel and Vice Mayor Brownrigg would like to address parking incentives for employees working in the downtown area to encourage them to park in the long term lots. 3 Burlingame City Council October 7,2013 Approved Minutes 13.
