Regular Meeting of March 19, 2012
1. CALL TO ORDER
A duly noticed regular meeting of the Burlingame City Council was held on the above date in the City Hall
Council Chambers. Mayor Jerry Deal called the meeting to order at 7:00 p.m.
CLOSED SESSION
CA Guinan advised that Council met in closed session prior to the meeting with Labor Negotiators for two
labor groups and gave direction to the Labor Negotiators. There was no further reportable action.
2. PLEDGE OF ALLEGIANCE TO THE FLAG
Led by Russ Cohen.
3. ROLL CALL
COUNCILMEMBERS PRESENT: Baylock, Brownrigg, Deal, Keighran, Nagel
COUNCILMEMBERS ABSENT: None
4. MINUTES
Councilwoman Baylock made a motion to approve the minutes of the March 5, 2012 regular Council
meeting; seconded by Councilman Brownrigg. Councilman Brownrigg requested the minutes be changed for
item 9b to read, "Councilman Brownrigg, noting the large amount of work that had gone on before he joined
the Council, deferred to his colleagues judgment". The motion was approved unanimously by voice vote, 5-0.
5. UPCOMING EVENTS
Mayor Deal advised that Planning Commissioner applications are due by Friday, March 30, 2012.
6. PUBLIC HEARINGS
a. ADOPT LEAF BLOWER ORDINANCE
CM Nantell reviewed the revisions to the Ordinance that were made at the March 5, 2012 meeting.
Councilwoman Baylock requested that the Ordinance be changed to start leaf blowing on Sundays from
10:00 a.m. to 2:00 p.m., rather than 9:00 a.m. to 2:00 p.m. CM Nantell requested that the condition of
exemption for properties greater than five acres be changed to four acres to accommodate Ray Park.

Mayor Deal opened the public hearing and the following individuals spoke: Thomas Hornblower, Brian
Berm, Russ Cohen, Gary Parma, Pat Stratigos, and Steve Feng. There were no further comments from the -�
floor and the hearing was closed.
Councilwoman Baylock made a motion to adopt Ordinance No. 1871-2012 repealing section 10.40.038 of
the Burlingame Municipal Code and adding a new section 10.48.030 to the Burlingame Municipal Code, to
regulate the use of leaf blowers within the City of Burlingame, noting the two revisions mentioned above;
seconded by Councilwoman Nagel. The motion was approved unanimously by voice vote, 5-0.
b. ADOPT AN ORDINANCE REPEALING CHAPTER 6.48 OF THE BURLINGAME
MUNICIPAL CODE, "CABLE TELEVISION SYSTEMS" AND ENACTING A NEW
CHAPTER 6.50, "VIDEO SERVICE PROVIDED BY STATE FRANCHISE HOLDERS"
FinDir Nava reviewed the staff report.
Mayor Deal opened the public hearing and Burlingame residents Kerbey Altmann and Russ Cohen spoke on
the item. There were no further comments from the floor, and the hearing was closed.
Councilwoman Nagel made a motion to adopt Ordinance No. 1872-2012 repealing chapter 6.48 of the
Burlingame Municipal Code, "Cable Television Systems" and enacting a new chapter 6.50, "Video Service
Provided by State Franchise Holders"; seconded by Councilman Brownrigg. The motion was approved
unanimously by voice vote, 5-0.
7. PUBLIC COMMENTS
Burlingame Historical Society President Jennifer Pfaff spoke and advised that the Howard-Ralston
Eucalyptus tree rows along El Camino Real in Burlingame have been inducted into the national register of
historical places. Councilwoman Baylock commented that when she attended the national register meeting in
January and she was advised that Charleston, South Carolina is known for adopting an historic district,
however, they adopted theirs in 1930 and Burlingame adopted its historic district in 1929. Councilman
Brownrigg also spoke and requested a presentation from the Historical Society at a future meeting. There
were no further comments from the floor.
8. STAFF REPORTS AND COMMUNICATIONS
a. PARKS & RECREATION COMMISSION REPORT AND RECOMMENDATION ON DOGS
OFF LEASH IN WASHINGTON PARK
PR&D Glomstad reviewed the staff report and requested Council approve the Parks & Recreation
Commission recommendation making the dogs off-leash hours at Washington Park from 6:00 p.m. to 7:30
p.m. permanent. PR&D Glomstad said there were no complaints during the six-month trial period.
Council asked if there were any plans to improve the existing dog park and PR&D Glomstad said not at this
time.
Russ Cohen spoke on the item.

Councilwoman Nagel made a motion to approve making the off-leash hours from 6:00 p.m. to 7:30 p.m. in
Washington Park permanent; seconded by Councilman Brownrigg. Vice Mayor Keighran and
Councilwoman Baylock both advised that they would not support the motion for the same reasons they did
not support it in the past. Councilwoman Keighran further stated that she did not want Washington Park
�— turned into a dog park since a dog park already exists in Burlingame. Councilwoman Baylock commented
about a recent walk through Washington Park at noon during which people had their dogs off leash for over
an hour, despite being asked to put the dog on a leash. Mayor Deal said he was not in favor of extending the
hours and would prefer that the City focus on creating a bona fide dog park
Mayor Deal asked for a roll call vote and the motion failed 2-3 (Baylock, Keighran and Deal voted no).
Councilwoman Baylock made a motion to deny extending the dogs off-leash hours on a permanent basis;
seconded by Vice Mayor Keighran. Councilman Brownrigg said that he thought the proposal was a good
compromise between people who only have dogs, and those who only have children, since young children
are not normally at the park from 6:00 to 7:30 p.m. He said that denying the extended hours would not solve
the problem of dogs off leash in the middle of the day. There was much discussion about improving the
existing dog park and CM Nantell suggested that Council might want to make that a goal for next year.
Mayor Deal asked for a roll call vote and the motion was approved 3-2 (Brownrigg and Nagel voted no)
b. CALTRAIN ELECTRIFICATION
DPW Murtuza reviewed the staff report and requested Council provide direction to staff on the conditions
for consideration that were included in the staff report. He advised that staff would provide these
considerations to Caltrain to include in the development of a memorandum of understanding.
Council discussion followed and Council all agreed that Caltrain service is vital to the Peninsula; however,
they expressed concern about supporting the concept without knowing what is being proposed and its full
benefits and impacts. They also expressed concern that the Metropolitan Transportation Commission is
involved in the negotiation and development of the memorandum of understanding with the High Speed Rail
Authority since it is not familiar with local issues. Council would prefer that Caltrain was representing the
City since they are well aware of local concerns.
Council voted to support the electrification of Caltrain and agreed to several preliminary conditions. They
requested that Caltrain include the conditions in the memorandum of understanding.
9. CONSENT CALENDAR
Councilwoman Nagel made a motion to adopt the consent calendar; seconded by Vice Mayor Keighran. The
motion was approved unanimously by voice vote, 5-0.
a. ADOPT A RESOLUTION APPROVING AN AMENDMENT TO BAY AREA BIOSOLIDS-TO-
ENERGY JOINT EXERCISE POWER AGREEMENT
DPW Murtuza requested Council adopt Resolution No.16 -2012 approving and authorizing the Mayor to
execute an amendment to the joint powers agreement establishing the Bay Area Biosolids Joint Powers
Authority and to add the cities of San Jose and Santa Rosa to the authority.
b. APPROVAL OF A NEW JOB CLASSIFICATION ENTITLED POLICE COMMUNICATIONS
AND RECORDS SUPERVISOR

COP Wood requested Council approve a new job classification of Police Communications and Records
Supervisor and the accompanying rate of pay recommended by the Human Resources Department. -�
C. APPROVAL FOR OUT-OF-STATE TRAINING FOR TWO PUBLIC WORKS WATER
DIVISION EMPLOYEES
DPW Murtuza requested Council approve out-of-state training for Public Works Department employees,
Sam Johnson and Matt Costello.
10. COUNCIL COMMITTEE AND ACTIVITIES REPORTS AND ANNOUNCEMENTS
Council reported on various events and committee meetings each of them attended on behalf of the City.
11. PUBLIC COMMENTS
Burlingame resident Andrew Wallace spoke on items 8b and 12a. There were no further comments from the
floor.
12. OLD BUSINESS
a. HIGH SPEED RAIL—CONSIDER WHETHER TO SUPPORT AB 1455
Councilwoman Baylock made a motion to adopt a Resolution at the next meeting in support AB 1455;
seconded by Councilman Brownrigg. The motion was approved unanimously by voice vote, 5-0.
