Regular Meeting of May 16, 2011
1. CALL TO ORDER
A duly noticed regular meeting of the Burlingame City Council was held on the above date in the City Hall
Council Chambers. Mayor Terry Nagel called the meeting to order at 7:00 p.m.
2. PLEDGE OF ALLEGIANCE TO THE FLAG
Led by Susan Castner-Paine.

4. MINUTES
Councilman Brownrigg made two corrections to the City Council meeting minutes of May 2, 2011. On page
four,paragraph four, insert(appended) after slide show presentation; paragraph six, change opposition to
concern, and add after the word merging, the full police services of Burlingame and San Mateo. Vice Mayor
Deal made a motion to approve the amended minutes of the May 2, 2011 regular Council meeting; seconded
by Councilwoman Keighran. The motion was approved by voice vote, 4-0 (Baylock absent).
5. PUBLIC HEARINGS
a. ADOPTION OF THE 2010 URBAN WATER MANAGEMENT PLAN FO R THE CITY OF
BURLINGAME
DPW Murtuza requested Council hold a public hearing on the City's draft 2010 Urban Water Management
Plan and approve a resolution adopting the Plan.
Matt Zucca of Erler&Kalinowski gave a presentation and advised that Burlingame has an adequate water
supply to meet the anticipated growth in the City; additional water conservation efforts will be necessary to
meet recently passed laws related to water conservation; and mechanisms are in place to address water
shortages, including catastrophic interruptions in supply.
Councilman Brownrigg commented that the use of grey water was not addressed in the report and requested
that it be looked at over time.

Mayor Nagel opened the public hearing and former Burlingame Mayor Rosalie O'Mahony spoke. There
were no further comments from the floor, and the hearing was closed.
Councilman Brownrigg made a motion to adopt Resolution No. 31-2011 approving an Urban Water
Management Plan for the City of Burlingame; seconded by Vice Mayor Deal. The motion was approved by
voice vote, 4-0 (Baylock absent).
b. ADOPT A RESOLUTION ADJUSTING THE STORM DRAINAGE FEE FOR FISCAL
YEAR 2011-2012 BY 1.5% BASED ON THE CONSUMER PRICE INDEX FOR THE SAN
FRANCISCO—OAKLAND—SAN JOSE, CA AREA AS PUBLISHED FEBRUARY 4, 2011
FinDir Nava reviewed the staff report and requested Council hold a public hearing on the proposed consumer
price index increase of 1.5% for the annual storm drainage fee.
Mayor Nagel opened the public hearing. There were no comments from the floor, and the hearing was
closed.
Councilwoman Keighran made a motion to adopt Resolution No. 32-2011 levying a storm drainage fee on all
parcels in the City of Burlingame for fiscal year 2011-2012 and directing that a list of the storm drainage fees
for Burlingame parcels be provided to the County of San Mateo for placement on the 2011-2012 tax bills.
seconded by Councilman Brownrigg. The motion was approved by voice vote, 4-0 (Baylock absent).
C. PUBLIC HEARING TO CONSIDER ADOPTION OF AN ORDINANCE ADDING
CHAPTER 8.10 TO THE BURLINGAME MUNICIPAL CODE TO PROHIBIT FOOD
VENDORS FROM USING POLYSTYRENE BASED DISPOSABLE FOOD SERVICE WARE --�
CDD Meeker reviewed the staff report and requested Council conduct a public hearing and consider all the
information contained in the staff report, and any written or oral testimony after conclusion of the public
hearing. He further requested that Council adopt San Mateo County's Ordinance with administration and
enforcement of the restrictions to be handled by County personnel.
CDD Meeker advised that the County Ordinance would be effective July 1, 2011 and the City of Burlingame
Ordinance would be effective on January 1, 2012 in order to allow ample opportunity for local businesses to
transition into the purchasing of compliant food ware items.
Mayor Nagel opened the public hearing and Stephen Knight of Save the Bay spoke and thanked the City for
moving this issue forward and urged adoption of the Ordinance. Dean Peterson, Director of San Mateo
County Health Services also spoke. There were no further comments from the floor, and the hearing was
closed.
Vice Mayor Deal made a motion to adopt Ordinance 1861-2011 adding Chapter 8.10 to the Burlingame
Municipal Code to prohibit food vendors from using polystyrene based disposable food service ware;
seconded by Councilman Brownrigg. The motion was approved by voice vote, 4-0 (Baylock absent).

Burlingame residents Leslie McQuaide , Susan Castner-Paine and John Taylor spoke on item 7b. There were

7. STAFF REPORTS AND COMMUNICATIONS
a. COUNCIL DIRECTION REGARDING FUNDING OF THE BURLINGAME TROLLEY

PWD Murtuza reviewed the staff report and requested Council review the funding request from the Bayfront
hotels for the hotel shuttle (Burlingame Trolley) and provide direction to staff. He advised that due to budget
shortfalls in 2009, the City stopped funding the $80,000 for the trolley and the Bayfront hotels, with help
from the San Mateo County Convention and Visitors Bureau, stepped in and have been funding the Trolley.
Council discussion followed and it was agreed to provide $25,000 in funding and the money would come
from capital improvements projects, signage and transient occupancy tax. Councilman Brownrigg made a
motion to approve the funding; seconded by Councilwoman Keighran. The motion was approved by voice
vote, 4-0 (Baylock absent).
b. COMMUNITY GARDEN AGREEMENT
P&RD Skeels reviewed the staff report and requested Council provide direction to staff regarding the
proposed location and size of the community garden and adopt a Resolution authorizing an agreement
between the City and Burlingame Garden Club. The Garden Club is proposing to use 40 parking spaces of
the 234 spaces in the Golf Center parking lot.
CA Guinan advised that based on a 1997 agreement between the City of Burlingame and the Doubletree
Hotel, the Golf Center parking lot was paid for by the hotel and it continues to pay 50 percent of annual
upkeep and lot maintenance. He further advised that the hotel pays an annual license fee for availability in
the lot, and with the use of 40 spaces for the garden, that could mean an estimated $5,000 to $6,000 loss of
revenue for the City. CA Guinan told the Council that until the agreement with the Doubletree and the City
is renegotiated, construction of the Community Garden must wait and that could be several weeks.
Council discussion followed and they suggested that other options for the garden location be reexamined, in
case a backup plan is necessary. They also expressed their desire that the negotiations with the Doubletree
be done in an expeditious manner. Mayor Nagel commended Garden Club President Leslie McQuaide and
the other members of the club for all the work they have put into the project thus far.

Councilwoman Keighran made a motion to approve the Consent Calendar; seconded by Vice Mayor Deal.
The motion was approved by voice vote, 4-0 (Baylock absent).
a. CANCEL JULY 5, 2011 CITY COUNCIL MEETING
CC Kearney requested Council approve the cancellation of the regular City Council meeting scheduled for
July 5, 2011. In the past, due to summer vacations, this meeting has been cancelled.
9. COUNCIL COMMITTEE AND ACTIVITIES REPORTS AND ANNOUNCEMENTS
Council reported on various events and committee meetings each of them attended on behalf of the City.

Councilman Brownrigg requested that the Post Office site be discussed at a future meeting. CM Nantell
advised that it was going to take place at the June 6, 2011 Council meeting.
