The regularly scheduled meeting of the Beautification Commission was called to order at 6:30 pm by
Chair Hunt.

Commissioner Kearney noted that the address for the Business Landscape Award is 1427 Chapin Avenue.
Commissioner Kirchner made a motion to approve the July 6, 2017 minutes as amended. The motion was
seconded by Commissioner Kearney and unanimously approved.

PUBLIC COMMENT
Matt Feemster, a resident in Burlingame commented regarding ivy growing on trunks of trees. He stated
that it can be harmful to the trees and asked if there was a program to remove the ivy. He also
commented that there are areas of Burlingame where the trees are sparse. He wanted to know if there is a
process for residents to recommend addresses where trees be planted. Mr. Feemster also stated that large
bare concrete walls of Parking structures are unsettling in a City and suggested ivy be planted to
transform the look of the area.
OLD BUSINESS
1. Business Landscape Award Recognition Update
Commissioner Kirchner stated he will present a slide show at the award ceremony during the Council
meeting on October 16, 2017.
2. Residential Sustainable Landscape Award Recognition Update
Commissioner Kirchner stated the award will be presented at the Council meeting on September 18,
2017. Arborist Disco showed the Commissioners the garden plaque that will be presented at Council
to the award winners. Commissioner Hinckle inquired if something like the garden plaque could be
done for the Business Landscape Award for outdoor recognition. Commissioner Kirchner will
present a power point at the Council meeting award ceremony.
NEW BUSINESS

Commission Chair Hunt welcomed Commissioner Dinuri to the Beautification Commission.
2. Oath of Office — Qiva Dinuri
Commission Chair Hunt read the Oath of Office to Commissioner Dinuri and she was sworn in.
3. Appeal to the Denied Tree Removal Permit at 2714 Easton Drive
Arborist Disco read the staff report regarding the denial to remove a Cedar tree at 2714 Easton Drive.
Commissioner Kirchner asked if this is a common problem. Arborist Disco stated there are two
issues with the Cedar tree; honeydew from the aphids and sap that is dripping from the tree. The
dripping is seasonal and tends to happen more in the summer. Commissioner Hinckle asked Arborist
Disco if the tree did not fall in his criteria for removal. Arborist Disco stated he is mainly looking at
health and structure but there is language in the ordinance for economic consequences and obligation
to the homeowner to consider. Commissioner Dinuri inquired if excessive sap is an indication that a
tree is sick. Arborist Disco stated it could be. Commissioner Hunt also inquired about the sap and
asked if it could be tested.
Public Comment
Brian with Davey tree has been involved with the property since the reconstruction in 2012 and has
provided tree protection and care during the process to current. He stated the honeydew from the
aphids can be treated and washed off fairly easily. Davey has also provided care by way of trimming
this Cedar tree which could result in increased sap. He stated that the tree has many cones which are
a likely culprit for a lot of the sap also. He believes in saving and caring for trees. He doesn't see any
feasible way to keep the tree health and manage the current concerns. His recommendation was to
remove the tree and plant a replacement. Arborist Disco asked if there were any roots cut during
construction. Brian stated no significant roots were lost during construction. Commissioner Hunt
asked what will happen if the tree is removed, to the tree that is intertwined with it. Brian noted he
would not expect a change to the tree and the branches will not reach the hardscape of the property.
Commissioner Hinckle stated there was so much protection put in place for the preservation of the
tree and now they wanted to remove it. Brain stated the plan was always to keep the tree; these issues
were unforeseeable developed over time. Arborist Disco stated the hardscape was not there before
renovation so it is hard to tell when the issue started.
Secretary Chandra read a correspondence from Gary Debal the Architect of the renovation project
who strongly supports the removal of the Cedar tree.
Appellant
Bill Cunningham -Corso the property owner stated they purchased the house 5 years ago. At that time
the hill was a forest setting with no hardscape. Mr. Cunningham -Corso stated that he terraced the hill
and planted gardens and loves the trees. During renovation preserving the tree was a top priority. He
doesn't know what happen during the renovation process to stress the Cedar but it happened. It has
been 3 years since the completion of the project and the sap is there every year and accelerating.
They have trimmed the tree and power washed the hardscape; the quotes are expensive and the tiles
are shot from excess cleaning. They can't use the front yard or steps because it is sticky. They
reached the point where it is not working anymore. He said the trees would be replaced. The
Ordinance does state safety hazard and economic obligation and the Cedar does fall in those
parameters.
Commission Discussion
Commissioner Kirchner stated that there has to be compelling issues to remove a tree, the
Commission is here to protect the trees but the cost to maintain the tree is large. Commissioner Hunt
stated she thinks the sap issue needs to be looked into further. Commissioner Kearney addressed the
safety issue regarding the stairs stating that the railing and stairs are sticky and if someone takes a fall
it is going to be bad. She stated the Ordinance does state tree removal for economic consequences.
Commissioner Dinuri stated that she did see the safety issues and the damage to the surface, it's
pretty extensive. Commissioner Hinckle spoke to the aesthetics of tree removal. She stated it is more
pleasing to have two small trees lower down then the one large up above.
Commissioner Kearney moved to uphold the appeal based on the economic consequences and
obligations to the homeowner by requiring the tree remain; Chapter 11.06.050(d) (7) of the Municipal
Code and requested the City Arborist to determine the type, location and number of replacement
trees(s). Commissioner Kirchner seconds the motion. Motion passed 4-1.
REPORTS
1. Parks Superintendent/City Arborist
Arborist Disco reported on Burlingame Avenue Eucalyptus trees; he is waiting on a final report for
the inspection of health and structure of 15 trees. On September 19t1i PG& E will turn off power and
Bay Area Tree Specialists will be removing 2 Eucalyptus trees on the 300 block of Burlingame
Avenue. Arborist Disco stated he is having the trees on Easton assessed for health and structure and
will come up with a plan to take to council.

Commissioner Hunt stated there are 3 Sycamores on Bernal that look stressed. Arborist Disco will
inspect.
4. Commissioner Hinckle
Commissioner Hinckle inquired about Broadway landscaping. Arborist Disco stated he just walked
Broadway with City Manager Goldman, Council Member Keighran and Parks and Recreation
Director Glomstad A list of possible improvements is being developed. Arborist Disco is waiting to
hear from the BBID for direction on the planter pots.
5. Commissioner Kirchner
Commissioner Kirchner inquired about ivy growing on street trees. The City issued a letter to the
homeowner and the homeowner needs to remove the ivy. Arborist Disco reported that ivy is
considered ground cover and the homeowner is responsible for the removal of anything in the
planting strip but the tree.

Commissioner Dinuri thanked everyone for the nice welcome and hopes to learn a lot while on the
Commission.

Subject: Appeal to Remove One Cedrus Deodara at 1555 Alturs Drive
RECOMMENDATION
Staff recommends one of two options.
Deny the appeal because the tree is healthy, has been well maintained and is
structurally sound and does not meet the criteria for removal based on Ch. 11.06 of the
Urban Reforestation and Tree Protection Ordinance.
2. Uphold the appeal based on the medical discomfort and issues that are being
experienced by the homeowner.
BACKGROUND
The Parks Division received a Protected Tree Removal Permit application on September 18,
2017, for the removal of a Deodar Cedar at 1555 Alturas Drive. Along with the application, the
resident included a letter with their reasons for the removal (Exhibit A).
The tree is located in the front yard adjacent to the neighbor at 1549 Alturas Drive. The tree is
roughly 50-60 feet tall, about 10-12 feet from the foundation of the house and driveway, and was
planted in 1980.
The permit application listed the reason for removal as "tree creates too much pollen." The letter
that accompanied the permit also listed the reasons for removal as evasive roots in the sewer
lines, roots cracking and lifting the driveway, previous fire in the chimney, and excessive leaf
debris (Exhibit B).
The City Arborist inspected the tree on September 28, 2017, and found the tree to be healthy,
structurally sound and well maintained. The City Arborist denied the request for removal because
the tree did not meet the criteria for removal as listed in Chapter 11.06 of the Urban Reforestation
and Tree Protection Ordinance (Exhibit C).
Appeal to Remove One Cedrus Deodara at 1555 Alturs Drive November Z 2017
DISCUSSION
The Ordinance states that when reviewing a tree for removal, priority is given to those based on
hazard or danger of disease, plus, the condition of the tree with respect to: disease; danger of
falling; proximity to existing structures, yards, driveways and other trees; and interference with
public utilities. The decision for removal is also based on the necessity to remove the tree in order
to construct improvements to the property; topography; the number of tree existing on the
property; the number of trees a parcel can adequately support; the effect the tree will have on
wind, privacy and noise; and the economic consequences and obligations of requiring a tree to
remain (Exhibit D).
The City Arborist determined that the tree did not meet any of the criteria and therefore could not
approve removal. The City Arborist believes the tree can be preserved by the performance
additional maintenance by a licensed qualified tree company. This work would include pruning
back any limbs interfering with the chimney, pruning roots lifting the driveway, and thinning the
canopy to reduce leaf debris and pollen.

Dear Mr. Disco,
A few weeks ago I spoke with you on the telephone and inquired if you could come and evaluate a tree
located on our front yard property that has become massive and is creating a nuisance to our property
and that of our neighbors' property, 1549 Alturas Drive. At the time of the call, you said if it's a City or
private tree and I said private. You suggested the names of a couple of arborist and said to start there.
My husband and I decided, for our health, to have the tree cut down and called three tree companies
for estimates. Verbally all three tree companies said the tree is healthy. We would like to remove the
tree and replace with a type of evergreen tree that will hopefully grow only half the size of the current
tree and not produce pollen. We would work with the City to choose a tree that works for us and the
neighborhood. We are in a view ordinance neighborhood but the tree to our knowledge, does not block
anyone's view.
The Deodora Cedar tree over the last few years of its growth, has produced an abnormal amount of
pollen. And because of this pollen, I have been going back and forth with my primary doctor to find
ways to control the allergies and sinus headaches that I have endured. Enclosed with this letter is a
letter from my primary, Dr. Karl Chan, outlining my condition and the steps I have taken over these last
few years to exist with our current situation? But as I am aging, the tree is causing more grief than I can
handle and the medication I am taking needs to be taken more frequent than I am comfortable taking.
The roots of the Deodora Cedar has caused a few problems over the years but we have always paid to
have the problems dealt with. Not sure how far back it started but at the beginning of every winter in
the last ten plus years, we have had to have a plumber come to our property to snake out the line from
the backyard to the side yard to the street because of backups. Many plumbing companies have been
to our house. The culprit, tree roots.
In 2013/2014 we had to call a plumber to have a sleeve installed in the line from the side yard to the
front yard to the street because the tree roots were becoming more difficult to snake out. A major
expense but seems to work so far. We also noticed that the roots are lifting our driveway and creating
cracks towards the center of the driveway.
During this past winter we had a flue fire and had the fire department here at our home. They felt it was
too hot of a fire at first but when I said there was an explosion in the flue, one fireman said there may
have been a nest in the flue. The amount of sparks and flame coming out of the flue caused a neighbor
driving by, to stop and scream to call 911. 1 had no idea until I went outside to look what the noise was
about. Thank goodness for the spark arrestor. Maybe a nest in the flue was not a far-fetched
conclusion. Makes you wonder. But do not want to experience a flue fire again. Had to have the
chimney arrestor replaced and the flue cleaned but as the chimney sweeper said, the fire cleaned it well.
Our neighbor Diana of 1549 Alturas Drive, has politely complained to us a couple of times about the
debris the tree leaves on her property and my husband David has gone over many times to clean the
driveway if the gardener has already been there. Our tree infringes on our neighbors' Eugenia trees as
well as our Eugenia trees not allowing the sun to keep them from growing properly. They are reaching
so high for the sun that they have become very woody. We personally have had the Deodora Cedar
thinned and trimmed twice in the last nine years. It continues to grow more rapidly than we can keep
up with and this also has become an ongoing expense.
Currently the tree is again infringing on our neighbors' house. Because it is our tree, we have never
asked Diana to help share the cost in dealing with the trimming. With this application and letter, Diana
Wang has concurred of what we have written and has signed this letter too in hopes of having the tree
cut down.
The Deodora Cedar was planted by my husband's father in 1980 and was probably all of three feet tall.
The time has come to remove the tree and replant another tree that will be conducive to the
neighborhood and enjoyed by all. We are aware that the City of Burlingame is the City of Trees and we
respect this title and want to continue to keep our City green with trees. We have no problem replacing
the tree. The only request we have, it be a tree that will stay green 365 days of the year and definitely
not produce pollen. We will consider any suggestion from the City but ultimately it will be our decision
that is final.
In conclusion please respect our request and help us to live a cleaner and healthier life. At our age, we
can no longer live and handle the Deodora Cedar tree as it exists.

We, Anne and David Nannini, are sending this letterto appeal a decision made by Mr. Bob Disco,
denying our request to remove the above mentioned tree and replace with a tree that will not create
pollen and droppings. I, Anne Nannini, have a severe allergy to the tree. Up until 4 years ago, the
pollens have caused me grief but not like it has caused in these most recent years.
The Deodora tree was planted by my father-in-law when we moved into our neighborhood in
September 1979. The tree has been trimmed and thinned out several times during its period of growth
but has grown out of control in the past four years and the pollens that come off of this tree is
unforgiving. This is the reason we are requesting its removal. Not sure if it has to do with the drought
we have experienced these past several years or its age but we need to have the tree removed. This is
a health issue to me and I need to know the City of Burlingame will work with my husband and me to
come to an understanding that respects all parties.
Enclosed is all the information I sent to Mr. Disco along with his letter of denial to remove. I have sent
to all my neighbors listed on Mr. Disco's letter, dated October 2, 2017 but received on Tuesday, October
9, 2017, a copy of my letter for removal along with the letter from my primary physician. I have asked
the neighbors to either acknowledge their concern with our tree directly to you should they have an
opinion about the matter.
We love our City of Burlingame and know many people and have always been involved with our local
school district, the high school district and our local government officials. We have been around for a
very long time and like anything in this world, things age and with age comes health issues. What may
not have bothered me 20 to 30 years ago is making me ill now. Please take all of our information and
allow us to remove the Deodora tree and replace with a tree that we and our neighbors can live with.

I am writing this letter to you for assistance. Back in February of this year, you were driving home from dinner I believe, and stopped
in front of my house and hollered to call 911 because of sparks and fire coming out of my chimney flue. Because I heard your
scream, I went out on my back deck and witnessed what you had seen. Came back in the house and called 911. The problem is by
the time the fire department arrived there was no sign of what we had both witnessed.
Why am I bringing this up??? I have requested a permit to remove the Deodora Cedar tree between me and my neighbor and
replace with a tree that will not produce pollen or droppings that have been of control. I have a severe allergy to this breed of tree
and have lived with it over the years but now that I am older the pollen that comes off this tree is creating grief and I need to
remove.
The City is denying the permit because it is a healthy tree and the City ordinance does not allow tree removal for health reasons. I
need to go to a Beautification commission meeting on November 2nd and plead my case. This is where I need some help from both
of you if you are willing.
When the fire department was here to investigate my call at the time one fireman said maybe from what I was describing and you
and I witnessed, a nest may have been in the flue. I found that hard to believe because there is a spark arrestor on top of the
chimney so I said how could a bird get into the flue and create a nest. Everyone agreed at the time that my fire may have been to
hot and that caused what sounded like a fireball roaring up the flue, sound. There may have been creosol collected inside my flue
but I told the fire department that we burn when we are allowed to burn and we only burn clean wood. Oak or almond. The
incident report does not describe what we witnessed. Only that the fire department arrived and saw only smoke coming out of the
chimney. It did rain lightly that night and we truly believe had everything been dry a fire could have occurred.
What my husband and I were hoping if you two could write up something saying you witnessed the flames and sparks coming out of
the chimney. Also the fact that you were driving by the house on your way home. My husband and I now believe the needles from
the cedar tree on windy days and nights may have collected in the flue and because we hardly had that many burn days during the
winter of 2016-2017 that the dry needles collected and caused the sound of a fireball roaring up the flue.
I know I am giving you a lot of information that is not necessary but I wanted to explain our situation and we would like to use this
fire call as one of our concerns for having the tree removed. With everything that has been going on this past week in Santa Rosa
and Napa/Sonoma we would like to make sure something of that magnitude does not occur here, especially because we live next to
the canyon.

E35, E33, E38, T34 and B8 were dispatched to a possible flu fire at 1555 Alturas Drive. On arrival, E35 found a two story residential
home with nothing showing from the front and established "Alturas IC".
The occupant, Anne Nannini met us in the front and stated that she has a fire in her fireplace and she heard a loud pop and saw a lot
of sparks come out of her chimney. E35 investigated and found a fire in the fireplace and no sparks coming out of the chimney. The
fireplace was located in the family room which had vaulted ceilings and no attic space. E35 used the TIC camera and found the walls
and ceiling around the fireplace 75-80 degrees.
E35 investigated the exterior of the fireplace and found no signs of excessive heat including the roof around the chimney.
E35 terminated "Alturas IC' and canceled the balance of resources and returned to service.

303.9 Fuel containers under air pressure. Fuel containers
that operate under air pressure shall not exceed 20 gallons (76
L) in capacity and shall be approved.
SECTION 304
COMBUSTIBLE WASTE. MATERIAL
304.1 Waste accumulation prohibited. Combustible waste
material creating a fire hazard shall not be allowed to accu-
mulate in buildings or structures or upon premises.
[California Code of Regulations, Title 19, Division 1,
§3.07(a)] Clearances.
(a) General. No combustible material shall be placed or
stored within 10 feet of any building or structure.
304.1.1 Waste material. Accumulations of wastepaper,
wood, hay, straw, weeds, litter or combustible or flamma-
ble waste or rubbish of any type shall not be permitted to
remain on a roof or in any court, yard, vacant lot, alley,
parking lot, open space, or beneath a grandstand, bleacher,
pier, wharf, manufactured home, recreational vehicle or
other similar structure.
304.11 Vegetation. Weeds, grass, vines or other growth
that is capable of being ignited and endangering property,
shall be cut down and removed by the owner or, occupant
of the premises. Vegetation clearance requirements in
urban-wildland interface areas shall be in accordance with
Chapter 49.
[California Code of Regulations, Title 19, Division 1,
§3.07(h)] Clearances.
(b) Ground Clearance. The space surrounding every
building or structure shall be maintained in accor-
dance with the fallowing:
Any person that owns, leases, controls, operates, or
maintains any building orstructure in, upon, or adjoin-
ing any mountainous area or forest -covered lands,
brush covered lands, or grass -covered lands, or any
land which is covered with flammable material shall at
all times do all of the following: .
(1) Maintain around and adjacent to such building
or structure a firebreak made by removing and
clearing away, for a distance of not less than 30 feet
on each side thereof or to the property line, which-
ever is nearer, all flammable vegetation or other
combustible growth. This section does not apply to
single specimens of trees, ornamental shrubbery, or
similar plants which are used as ground cover, if
they do not form a means of rapidly transmitting fire
from the native growth to any building or structure.
(2) Maintain around and adjacent to any such build-
ing or structure additional fire protection or fire-
break made by removing all bush, flammable
vegetation, or combustible growth which is located
GENERAL REQUIREMENTS
from 30 feet to 100 feet from such building or struc-
ture or to the property line, whichever is nearer, as
may be required by the enforcing agency if he finds
that, because of extra hazardous conditions, a fire-
break of only 30 feet around such building or struc-
ture is not sufficient to provide reasonable fire
safety. Grass and other vegetation located more
than 30 feet from such building or structure and less
than 18 inches in height above the ground may be
maintained where necessary to stabilize the soil and
prevent erosion.
(3) Remove that portion of any tree which extends
within 10 feet of the outlet of any chimney or stove-
pipe-
(4) Cut and remove all dead or dying portions of
trees located adjacent to or overhanging any build-
ing.
(5) Maintain the roof of any structure free of leaves,
needles, or other dead vegetative growth.
(6) Provide and maintain at all times a screen over
the outlet of every chimney or stovepipe that is —
attached to any fireplace, stove, or other device that
burns any solid or liquid fuel. The screen shall be
constructed of nonflammable material with open-
ings of not more than 1/Z inch in size.
(7) Vegetation around all applicable buildings and
structures shall be maintained in accordance with
the following laws and regulations:
(A) Public Resources Code Section 4291.
(B) California Code of Regulations Title 14 - Natural
Resources, Division 1.5 - Department of Forestry and
Fire Protection, "General Guideline to Create Defen-
sible Space. "
(C) California Government Code Section 51182.
(D) California Code of Regulations, Title 24, Part 9.
304.1.3 Space underneath seats. Spaces underneath
grandstand and bleacher seats shall be kept free from com-
bustible and flammable materials. Except where enclosed
in not less than 1-hour fire-tesistance-rated construction in
accordance with the California Building Code, spaces
underneath grandstand and bleacher seats shall not be
occupied or utilized for purposes other than means of
egress.
304.2 Storage. Storage of combustible rubbish shall not pro-
duce conditions that will create a nuisance or a hazard to the
public health, safety or welfare.
304.3 Containers. Combustible rubbish, and waste material
kept within or near a structure shall be stored in accordance
with Sections 304.3.1 through 304.3.4.
[California Code of Regulations, Title 19, Division 1,
§3.19(h) and (c)]Housekeeping.
Every building or portion of a building governed by Califor-
nia Code of Regulations, Title 19, Division 1 regulations
shall be maintained in a neat orderly manner, free from any
condition that would create afire or life hazard or a condi-

We moved here in September, 1979, at which time we were one of the young families on the street with
two small boys that ultimately grew up along with their sister in our neighborhood.
I am appealing to my neighbors to help us with an issue we are currently experiencing and should you
be inclined to offer assistance, please consider sending a letter or email to The Beautification
Commission of which I have enclosed their information with this letter. Mr. Disco did not supply my
medical information with his notice to the neighbors of which I respect but I need the neighbors to know
why we requested a permit for removal. My medical condition is the main reason for the removal
besides the other points I presented in my letter.
We requested a permit for the removal of the Deodora Cedar between our house and Diana Wang's
house. We are willing to replace this tree we planted but our City of Trees, Burlingame, has deny our
request. We understand the beauty of this tree but the pollens that come off this tree are creating a
health issue for me and I need to do what I can for my health.
No one wants to see a healthy tree removed but we promise we will replace with a tree that will benefit
the neighborhood and my health.
We will respect your response but we hope you will take the time to respond either way to Mr. Disco or

want to include this information to your surrounding neighbors.
From the information you provided, the pollen from the tree is causing you grief and discomfort.
Unfortunately, my decision to approve or deny protected trees is based solely on the Urban
Reforestation and Tree Protection Ordinance 11.06. The Ordinance does not account for
allergies or health issues and therefore I must deny your request for removal.

to the evaluation and workup of your Cedar Pollen Allergies.
On 1/26/2005 you were evaluated and prescribed medication for recurrent headaches.
Fiorinal was started and you have been taking this medication since that time for these
headaches.
An allergy test was conducted on 6/17/2009 and you were found to be markedly allergic
to Cedar Tree Pollen. Dr. Robert Lo, an allergy specialist, made this diagnosis based
on tests conducted.
On 8/14/2003, due to recurrent headaches, an MRI of the brain was performed.
On 10/18/2007, due to recurrent sinus tenderness, an x ray of the sinuses was
performed.

11.06.050 Prohibitions and protections.
(a) No protected tree shall be removed from any par-
cel without a permit except as provided in Section
11.06.040.
(b) The following conditions shall be observed during
construction or development of property:
(1) Protected trees are to be protected by a fence
which is to be maintained at all times;
(2) Protected trees that have been damaged or de-
stroyed by construction shall be replaced or the city shall
be reimbursed, as.provided in Section 11.06.090;
-(3) Chemicals or other construction materials shall not
be stored within the drip line of protected trees;
(4) Drains shall be provided as required by the direc-
tor whenever soil fill is placed around protected trees; and
(5) Signs, wires or similar devices shall not be at-
tached to protected trees. (Ord. 1057 § 1 (part), (1975);
Ord. 1470 § 1, (1992); Ord. 1598 § 1 (part), (1998))
11.06.060• Notices -and permits required for
removal or work significantly
affecting protected trees.
(a) Removal or Pruning. Owners, or their authorized
representative, of protected trees on public or private prop-
erty shall obtain a permit to remove or prune a protected
tree. The;application shall be on a form furnished by the
department and shall state, among other things, the number
and location of the tree(s) to be removed or pruned by
type(s) and the reason for removal orpruning of each. The
application shall also include a photograph with correct
botanical identification of the subject tree or tree(s). An
authorized representative of the department shall make an
inspection of the tree(s) and shall file a written report and
his or her recommendations to the director.
(b) Educational Conference before Work Commences.
After receipt of an application, the director may require an
educational conference to inform the owner of potential
alternatives to the proposed removal or pruning.
(c) Removal or Pruning of Protected Trees on Unde-
veloped or Redeveloped Property. When an application for
development or redevelopment of a property containing
one or more protected trees is filed in any office or de-
partment of the city, the person making such an applica-
tion shall file a -site plan showing the location of buildings
or structures or of proposed site disturbances, and the loca-
tion of all trees. The director shall determine if all pro-
tected trees are shown. An authorized representative of the
department shall make an inspection and shall file a report
of his or herfindings and recommendations to the director.
11.06.050
Subject to the replacement provisions of Section
11.06.090, the director shall approve the removal of pro-
tected trees within the footprint of approved construction
in the R-1 zone, which construction does not require a
variance, *conditional use permit, or special permit under
Title 25 of this code. The notice and appeal provisions of
Sections 11.06,070 and 11.06.080 shall not apply to such
approvals.
(d) Review. In reviewing applications, the director
shall give priority to those based on hazard or danger of
disease. The director may refer any application to another
department, committee, board or commission of the city
for a report and recommendation, and may require the
4pplicant to provide an arborist's report. In reviewing each
application, the director shall determine:
(1) The condition of the tree(s) with respect to dis-
ease; danger of falling; proximity to existing or proposed
structures, yards, driveways and other trees; and interfer-
ence with public utility services;
(2) The necessity to remove the tree(s) in order to
construct any proposed improvements to allow economic
enjoyment of the property;
(3) The topography of the land and the effect of the
removal of the tree(s) on erosion; soil retention; and diver-
sion or increased flow of surface waters;
(4) The number of trees existing in the neighborhood
on improved property and the effect the removal would
have on the established standard of the area and property
value. Neighborhood is defined as the area within a 300-
foot radius of the property containing the tree(s) in ques-
tion;
(5) The number of trees the particular parcel can ade-
quately support according to good arboricultural practices;
(6) The effect tree removal would have on wind pro-
tection, noise and privacy; and
(7) The economic consequences and obligations of
requiring a tree to remain. (Ord. 1057 § 1 (part), (1975);
Ord. 1470 § 1, (1992); Ord. 1492 § 2, (1993); Ord. 1598 §

11.06.070 Decision by director.
A decision shall be rendered by the director for each
application. If an application is approved, it shall include
replacement- conditions in accordance with Section
11.06.090. The director shall give written notification of

Dear Mr. Disco,
A few weeks ago I spoke with you on the telephone and inquired if you could come and evaluate a tree
located on our front yard property that has become massive and is creating a nuisance to our property
and that of our neighbors' property, 1549 Alturas Drive. At the time of the call, you said if it's a City or
private tree and I said private. You suggested the names of a couple of arborist and said to start there.
My husband and I decided, for our health, to have the tree cut down and called three tree companies
for estimates. Verbally all three tree companies said the tree is healthy. We would like to remove the
tree and replace with a type of evergreen tree that will hopefully grow only half the size of the current
tree and not produce pollen. We would work with the City to choose a tree that works for us and the
neighborhood. We are in a view ordinance neighborhood but the tree to our knowledge, does not block
anyone's view.
The Deodora Cedar tree over the last few years of its growth, has produced an abnormal amount of
pollen. And because of this pollen, I have been going back and forth with my primary doctor to find
ways to control the allergies and sinus headaches that I have endured. Enclosed with this letter is a
letter from my primary, Dr. Karl Chan, outlining my condition and the steps I have taken over these last
few years to exist with our current situation? But as I am aging, the tree is causing more grief than I can
handle and the medication I am taking needs to be taken more frequent than I am comfortable taking.
The roots of the Deodora Cedar has caused a few problems over the years but we have always paid to
have the problems dealt with. Not sure how far back it started but at the beginning of every winter in
the last ten plus years, we have had to have a plumber come to our property to snake out the line from
the backyard to the side yard to the street because of backups. Many plumbing companies have been
to our house. The culprit, tree roots.
In 2013/2014 we had to call a plumber to have a sleeve installed in the line from the side yard to the
front yard to the street because the tree roots were becoming more difficult to snake out. A major
expense but seems to work so far. We also noticed that the roots are lifting our driveway and creating
cracks towards the center of the driveway.
During this past winter we had a flue fire and had the fire department here at our home. They felt it was
too hot of a fire at first but when I said there was an explosion in the flue, one fireman said there may
have been a nest in the flue. The amount of sparks and flame coming out of the flue caused a neighbor
driving by, to stop and scream to call 911. 1 had no idea until I went outside to look what the noise was
about. Thank goodness for the spark arrestor. Maybe a nest in the flue was not a far-fetched
conclusion. Makes you wonder. But do not want to experience a flue fire again. Had to have the
chimney arrestor replaced and the flue cleaned but as the chimney sweeper said, the fire cleaned it well.
Our neighbor Diana of 1549 Alturas Drive, has politely complained to us a couple of times about the
debris the tree leaves on her property and my husband David has gone over many times to clean the
driveway if the gardener has already been there. Our tree infringes on our neighbors' Eugenia trees as
well as our Eugenia trees not allowing the sun to keep them from growing properly. They are reaching
so high for the sun that they have become very woody. We personally have had the Deodora Cedar
thinned and trimmed twice in the last nine years. It continues to grow more rapidly than we can keep
up with and this also has become an ongoing expense.
Currently the tree is again infringing on our neighbors' house. Because it is our tree, we have never
asked Diana to help share the cost in dealing with the trimming. With this application and letter, Diana
Wang has concurred of what we have written and has signed this letter too in hopes of having the tree
cut down.
The Deodora Cedar was planted by my husband's father in 1980 and was probably all of three feet tall.
The time has come to remove the tree and replant another tree that will be conducive to the
neighborhood and enjoyed by all. We are aware that the City of Burlingame is the City of Trees and we
respect this title and want to continue to keep our City green with trees. We have no problem replacing
the tree. The only request we have, it be a tree that will stay green 365 days of the year and definitely
not produce pollen. We will consider any suggestion from the City but ultimately it will be our decision
that is final.
In conclusion please respect our request and help us to live a cleaner and healthier life. At our age, we
can no longer live and handle the Deodora Cedar tree as it exists.

This letter is in support of the Nannini's request for a permit to remove and replace a Deodar Cedar Tree from their
property at 1555 Alturas Drive.
I have lived at 1547 Alturas Drive since 1972, and am very well acquainted with the Nannini family and know them to be
wonderful, considerate neighbors. It has been difficult for me to watch Anne have increasingly more painful and frequent
allergy attacks caused by the pollen from the Cedar Tree on their property. It's my understanding that her strong allergic
reaction to Cedar Tree Pollen has been well documented by an allergy specialist and submitted as evidence in their
petition to the City.
As a concerned neighbor with interest in supporting the well-being as well as the aesthetics of our neighborhood, it is my
opinion that the Nannini's should be granted permission to remove the Cedar Tree that causes the allergy and replace it,
as they have offered, with a tree which remains green 365 days a year and does not produce pollen.

Since the permit for removal at 1555 Alturas Drive is based around a medical issue, I did not
want to include this information to your surrounding neighbors.
From the information you provided, the pollen from the tree is causing you grief and discomfort.
Unfortunately, my decision to approve or deny protected trees is based solely on the Urban
Reforestation and Tree Protection Ordinance 11.06. The Ordinance does not account for
allergies or health issues and therefore I must deny your request for removal.
As I stated in the attached letter, you may appeal my decision to the Burlingame Beautification
Commission. The commission has the flexibility to uphold or deny my decision based on any
information you provide them during the meeting.

11.06.010 Purpose and intent.
The city of Burlingame is endowed and forested with a
variety of healthy and valuable trees which must be pro-
tected and preserved. The preservation of these trees is
essential to the health, welfare and quality of life of the
citizens of the city because these trees preserve the scenic
beauty of the city, maintain ecological balance, prevent
erosion of top soil, counteract air pollution and oxygenate
the air, absorb noise, maintain climatic and microclimatic
balance, help block wind, and provide shade and color. For
these same reasons, the requirement of at least one tree,
exclusive of city -owned trees, on every residential lot in
the city should be part of the permit process for any con-
struction or remodeling.
It is the intent of this chapter to establish conditions and
regulations for the removal and replacement of existing
trees and the installation of new trees in new construction
and development consistent with these purposes and the
reasonable economic enjoyment of private property. (Ord.
1057 § 1 (part), (1975); Ord. 1470 § 1, (1992); Ord. 1598
§ 1 (part), (1998))
11.06.020 Definitions.
Terms used in this chapter shall be defined as follows:
(a) "Commission" means the Beautification Commis-
sion of the city of Burlingame.
(b) "Department" means the parks and recreation
department of the city of Burlingame.
(c) "Development or redevelopment" means any work
upon any property in the city of Burlingame which re-
quires a subdivision, variance, use permit, building permit
or other approval or which involves excavation, landscap-
ing, or constriction in the vicinity of a protected tree.
(d) "Director" means the director of parks and recrea-
tion of the city of Burlingame.
(e) "Landscape tree" means a generally recognized
ornamental tree and shall exclude fruit, citrus, or nut -
bearing trees.
(f) "Protected tree" means:
(1) Any tree with a circumference of forty-eight (48)
inches or more when measured fifty-four (54) inches
above natural grade; or
(2) A tree or stand of trees so designated by the city
council based upon findings that it.is unique and of impor-
tance to the public due to its unusual appearance, location,
historical significance or other factor; or
(3) A stand of trees in which the director has deter-
mined each tree is dependent upon the others for survival.
(g) "Pruning" means the removal of more than one
third of the crown or existing foliage of the tree or more
than one third of the root system. Pruning done without a
permit or which does not conform to the provisions of a
permit shall be deemed.a removal-
(h) "Removal" means cutting to the ground,"extrac-
tion, killing by spraying, girdling, or any other means.

11.06.030 Nomination and listing of protected
trees.
Nomination for protected tree status under Section
11.06.020(f)(2) may be made by any citizen. The commis-
sion shall review such nominations and present its recom-
mendations to the city council for designation.
A listing of trees so designated, including the specific
locations thereof, shall be kept by the department and shall
be available for distribution to interested citizens.
The city council may remove a designated tree from the
list upon its own motion or upon request. Requests for
such action may originate in the same manner as nomina-
tions for protected tree status. (Ord. 1057 § 1 (part),
(1975); Ord. 1470 § 1, (1992); Ord. 1598 § 1 (part),

11.06.040 Emergencies.
In the event that an emergency condition arises
whereby immediate action is necessary because of disease,
or danger to life or property, a protected tree may be re-
moved or altered by order of the director or, if the director
is unavailable, a responsible member of the police, fire,
parks and recreation, or public works department. In such
event, a report shall be made to the commission describing
the conditions and necessity of such an order. (Ord. 1057 §
1 (part), (1975); Ord. 1470 § 1, (1992); Ord. 1598 § 1
(part), (1998))
11.06.050 Prohibitions and protections.
(a) No protected tree shall be removed from any par-
cel without a permit except as provided in Section
11.06.040.
(b) The following conditions shall be observed during
construction or development of property:
(1) Protected trees are to be protected by a fence
which is to be maintained at all times;
(2) Protected trees that have been damaged or de-
stroyed by construction shall be replaced or the city shall
be reimbursed, as.provided in Section 11.06.090;
(3) Chemicals or other construction materials shall not
be stored within the drip line of protected trees;
(4) Drains shall be provided as required by the direc-
tor whenever soil fill is placed around protected trees; and
(5) Signs, wires or similar devices shall not be at-
tached to protected trees. (Ord. 1057 § 1 (part), (1975);

11.06.060• Notices -and permits required for
removal or work significantly
affecting protected trees.
(a) Removal or Pruning. Owners, or their authorized
representative, of protected trees on public or private prop-
erty shall obtain a permit to remove or prune a protected
tree, The application shall be on a form furnished by the
department and shall state, among other things, the number
and location of the tree(s) to be removed or pruned by
type(s) and the reason for removal or pruning of each. The
application shall also include a photograph with correct
botanical identification of the subject tree or tree(s). An
authorized representative of the department shall make an
inspection of the tree(s) and shall file a written report and
his or her recommendations to the director.
(b) Educational Conference before Work Commences.
After receipt of an application, the director may require an
educational conference to inform the owner of potential
alternatives to the proposed removal or pruning.
(c) Removal or Pruning of Protected Trees on Unde-
veloped or Redeveloped Property. When an application for
development or redevelopment of a property containing
one or more protected trees is filed in any office or de-
partment of the city, the person making such an applica-
tion shall file a -site plan showing the location of buildings
or structures or of proposed site disturbances, and the loca-
tion of all trees. The director shall determine if all pro-
tected trees are shown. An authorized representative of the
department shall make an inspection and shall file a report
of his or her findings and recommendations to the director.
11.06.050
Subject to the replacement provisions of Section
11.06.090, the director shall approve the removal of pro-
tected trees within the footprint of approved construction
in the R-1 zone, which construction does not require a
variance,'conditional use permit, or special permit under
Title 25 of this code. The notice and appeal provisions of
Sections 11.06.070 and 11.06.080 shall not apply to such
approvals.
(d) Review. In reviewing applications, the director
shall give priority to those based on hazard or danger of
disease. The director may refer any application to another
department, committee, board or commission of the city
for a report and recommendation, and may require the
applicant to provide an arborist's report. In reviewing each
application, the director shall determine:
(1) The condition of the tree(s) with respect to dis-
ease; danger of falling; proximity to existing or proposed
structures, yards, driveways and other trees; and interfer-
ence with public utility services;
(2) The necessity to remove the tree(s) in order to
construct any proposed improvements to allow economic
enjoyment of the property;
(3) The topography of the land and the effect of the
removal of the tree(s) on erosion; soil retention; and diver-
sion or increased flow of surface waters;
(4) The number of trees existing in the neighborhood
on improved property and the effect the removal would
have on the established standard of the area and property
value. Neighborhood is defined as the area within a 300-
foot radius of the property containing the tree(s) in ques-
tion;
(5) The number of trees the particular parcel can ade-
quately support according to good arboricultural practices;
(6) The effect tree removal would have on wind pro-
tection, noise and privacy; and
(7) The economic consequences and obligations of
requiring a tree to remain. (Ord. 1057 § 1 (part), (1975);

11.06.070 Decision by director.
A decision shall be rendered by the director for each
application. If an application is approved, it shall include
replacement conditions in accordance with Section
11.06.090. The director shall give written notification of
the decision to the applicant and all property owners
within one hundred (100) feet of the property containing
the tree(s) in question, and include a copy of the city Ur-
ban Reforestation and Tree Protection Ordinance (Chapter

11.06.080
1 11.06.0.80 Appeal.
Any person may appeal the decision of the director to
the commission by filing .an appeal in writing with the
director no later than 5:00 p.m. of the tenth calendar day
after the decision.- The director shall set the matter for
review by the commission at its next regular meeting and
Provide notice by mail of the commission hearing to the
appellant- and applicant at leastfiive. (5) days prior thereto.
The determination of the commission shall become
.final and conclusive in ten (10) days if no appeal is filed.
Destruction, removal or other work on a protected tree
shall not commence until after the ten (10)-day period has
passed, or; if any appeal is filed, until the decision of the
city council. During. the period between the action of the
commission and the end of the ten (10)-day appeal period,
any; person.may appeal such: action. to the city council.
Such appeal'shall be in writing and shall be filed with the
city;clerk. During the same period the city council, on its
ow4 inotion, may suspend.the order of the commission for
the purpose. of reviewing the action of the commission. A
permit shall be valid for six (6) months after the date it is
-issued. Under exceptional circumstances, the director may
issue one six (6)-mmfith extension: (Ord. 1470 § 1, (1992);

/ 11.06 090 Tree requirements and reforesttit►on..
(a) Whenever the development or redevelopment of a
single family home, duplex; apartment house or condomin=
rum: results. in any inerease in lot coverage or habitable
space (as "d , ined'by Chapter 25 of this code), the property
AWL required to meefthe following requirements:
(1)' ` One landscape tree for everyOne thousand (1,000)
square feet of lot coverage or habitable space for single
family homes or: duplexes;
(2) " One_landscape tree for every two thousand (2,000)
square feet of lot coverage for apartment houses or con-
dominiums.:
Lot coverage and habitable space shall include both
existing anal new' construction. The director shall deter-
mine .-the number of existing trees'which are of an accept-
able size, species and location to be counted toward this
requirement. Any additional trees which are required shall
meet the standards for replacement trees set forth in sub-
section.(b) below.
(b) . Permits for removal of protected tree(s) shall in-
clude replanting conditions with the following guidelines:
(1) Replacement shall be three (3) fifteen (15)-gallon
size, one twenty-four (24)-inch box size, or one thirty-six
(36)-inch box size landscape tree(s) for each tree removed
as determined. below.
(2) ' Any.tree removed without a valid permit shall be
replaced by two (2) 24-irlch box size, or two (2) 36-inch

box size landscape trees for each tree so removed as de-
termined below.
(3) Replacement of a tree be waived by the director if
a sufficient number of trees exists on the property to meet
all other requirements of the Urban Reforestation and Tree
Protection ordinance. '
(4) Size and number of the replacement tree(s) shall
be determined by the director and shall be based -on the
species, location and value of the tree(s) removed.
(5) If replacement flees, as designated in subsection
(b)(1) or (2) above, as applicable, cannot be planted on the
property, payment of equal value shall be made to the city.
Such payments shall be deposited in the tree planting fund
to be drawn upon for public tree planting. (Ord. 1470 § 1,

11.06.100 Penalty.
In addition to any other penalties allowed by law, any
person removing or pruning a tree in violation of this ordi-
nance is liable to treble damages as set forth in Section 733
of the Code of Civil Procedure of the State of California.
Damages for this purpose shall be replacement value of the
tree as determined by the International Society of Arbori-
