Approval of Minutes Approve the minutes of the May 19, 2016 regular meeting 3. Public Comments Members of the public may speak about any item not on the agenda. The Ralph M. Brown Act (the State and local agency open meeting law) prohibits the Commission from acting on any matter that is not on the agenda. Speakers are asked to fill out a `request to speak' card located on the table by the door and hand it to staff, although provision of a name, address or other identifying infomation is optional. AGENDA 06/16/16posted 0613/16 a STAFF REPORT To: Parks and Recreation Commission Date: June 16, 2016 From: Tim Barry, Parks and Recreation Supervisor Subject: Youth Field User Organization Validation - Burlingame Soccer Club (BSC) RECOMMENDATION Staff recommends that the Commission review the additional information requested from the BSC and determine if the BSC should be approved as a Validated User Group for another year. BACKGROUND At the May 19 Commission meeting staff was directed to hold a meeting with the BSC Board of Directors to get clarification on the questions that were generated during the Commission meeting. On Tuesday, May 24 Recreation Supervisor Barry, Parks and Recreation Director Glomstad and Commissioner Joe Dito met with members of the BSC Board of Directors. The members of the BSC Board of Directors who attended were Lawrence Viola (President, resident), Steven Koury (Treasurer, non-resident), Anh Vasquez (Secretary, non-resident), Medina Begic (Board Member, resident) and Anthony Dimech (Board Member, resident). Absent from the meeting was Tim Wei (Board Member, non-resident). The Commission requested further information & documentation regarding the following: 1. All positions in the BSC organization including voting and non -voting board members and their residency status. 2. BSC blocking other soccer clubs from renting field space in Burlingame. 3. A list of any coaches, board members or administrators that currently hold positions on both BSC and Star Academy. 4. Any alliances or partnerships the BSC has with any other club soccer programs. 5. A list of all positions on the Star Academy organization. 6. Anticipated reduction in teams for the upcoming season with the termination of the BSC/SMC partnership. The responses from the meeting included: 1. All positions in the BSC organization including voting and non -voting board members and their residency status. The BSC has six members on their Board of Directors. These are the only members of 1 Youth Field User Organization Validation - Burlingame Soccer Club June 16, 2016 the club who have the ability to cast a vote on decisions of the club. Christopher Sullivan, Director of Coaching, is an advisory position on the board and has no voting rights in BSC decisions. 2. BSC blocking other soccer clubs from renting field space in Burlingame. NorCal Soccer is one of the governing bodies for club soccer. According to the BSC Board of Directors, NorCal Soccer requires a club to declare a geographic area when establishing a club. BSC has always declared Burlingame its geographic area and NorCal Soccer does not allow another club to declare Burlingame as its home territory. 3. A list of any coaches, board members or administrators that currently hold positions on both BSC and Star Academy. Christopher Sullivan is the only individual who currently appears on both the BSC Board of Directors and the Star Academy coaching team as their Technical Director. 4. Any alliances or partnerships the BSC has with any other club soccer programs. BSC is a feeder program to the Star Academy. 5. A list of all positions on the Star Academy Organization. The current Board of Directors includes Bill Burkoth, Jennifer Livingstone, Maria Murnane and Angie Taube. Also, the current coaching staff and advisors are as follows; Juan Porras, Mikey Varas, Dan DeGeer, Sennay Ghebresellasie, Waldemar Roldan, Luciano Fusco and Christopher Sullivan. 6. Reduction in field time due to the decrease in teams because of the termination of the BSC/SMC STAR teams. The BSC does not anticipate any reduction in the number of teams for the upcoming season. Subsequent to the meeting, additional information has been gathered by staff to clarify the responses above and changes have occurred to the BSC. Firstly, the members of the Board of Directors have changed. Below are the current board members: 1. Lawrence Viola (Resident) 2. Steven Koury (Non -Resident) 3. Anthony Dimech (Resident) 4. Jackie Donaho (new)(Resident) 5. Will Evans (new)(Resident) In addition, staff contacted Daniel Chamberlain, Director of Operations of NorCal Premier Soccer. He said, "There are no territories or boundaries in NorCal Premier. Rules regarding field use are set by the local Regional Advisory Committee and the Region 2 RAC has no set rules regarding the use of the fields outside of the normal area of the operation of a club." EXHIBITS None 2 aSTAFF REPORT To: Parks and Recreation Commission Date: June 16, 2016 From: Tim Barry, Parks and Recreation Supervisor Subject: Second Subletting Violation - Burlingame Soccer Club (BSC) Staff recommends that the Commission review and determine if a 2Id subletting violation has occurred by the BSC. BACKGROUND In the past few weeks staff has become aware of a possible 2Id subletting violation. Staff was on site at Murray Field on Tuesday, June 7 and Thursday, June 9. It was noticed that Juan Porras was on the field coaching a team. Mr. Porras is not a Burlingame Soccer Club coach and is currently the Director of Coaching for Star Academy. Since then staff has spent time investigating the possible violation. Staff has reached out to the following people; Lawrence Viola (Board President), Steven Koury (Board Member), Anthony Dimech (Board Member), Will Evans (new Board Member), Brian Mansell (Coach), Chris Sullivan (BSC Director of Coaching) and the team manager. From the many discussions that have occurred there is conflicting explanations of what was happening on the field while this team was practicing. In addition, staff discovered that in the Bonzi scheduling system (used by club soccer organizations) the notes for the team in question reflected that these were Star Academy practices. From the information gathered, staff believes that this is the 2nd subletting violation; however, staff hasn't been able to confirm that the current BSC leadership was aware of the subletting. Per the Field Use policy, the penalty for a 2°d subletting violation is a $1,000 fine, hearing before Commission and probationary status of the organization. EXHIBITS None 1
