HomeMy WebLinkAboutReso - CC - 014-1937c RESOLUTION OF INTENTION TO CONSTRUCT AN ALLEY RESOLVED by the City Council of the City of Burlingame that it is their intention, if and when Federal 1.P, a funds for which application has been made are made availarle, to construct an alley extending southwesterly from Primrose Road in the rear of the property fronting on .Burlingame Avenue in Block I, Town of Burlingame, This alley to be constructed in accordance with plans and estimates prepared and as delineated in tde appraisal submitted by Robert N. McLean, duly a.pPointed appr«iser. All this work to be done under the s��e:^vision of the City of Burlin- game for and on behalf of the property owners in the district effected. In consideration of said corporation executing a quitclaim deed to the owners of the so-called Peninsula Theatre property in Burlin�-,rxme of a strip of said property lying at the rear of the theatre building subsisting on said property to per- mit of t..e e:cee-'tion by said owner of a quitclaim deed of said strip for street purposes to the City of Burlingame, and the execution of said deed by said owners for said purposes, which strip is to be utilized by the City of Burlingame in conjunction with adjacent property as a street, running in a generally Wester- ly direction from the Westerly line of Primrose iAoad, which street is delineated upon a map entitled,`Uap of Proposed Alley" pre- pared in Janaary, 1937, by C. L. Longson, :acting City Engineer, the City of Burlingame herewith agrees to hold said owners and said Peninsula 'Theatres Corporation safe and harmless from, and to indemnify it against, any damage to the balance of said prop- erty of the owners, the said theatre buildinj, and the contents thereof, arising during and from the construction of said street, and further :agrees should the construction of said street en- croach upon the space in said theatre building utilized for boiler -room and oil tanks and require removal or adjustment of said tanks, machinery or any of the pipes and appliances in connection therewith, the undersigned will bear the cost and expense thereof. This agreement is ntered int pursuant to a reso- lution of the City Council e City of i game, regularly passed and adopted on the day o$j 1937. Dated this 7t4 day of 1937.
