HomeMy WebLinkAboutReso - CC - 007-1940RESOLVED: RESOLUTION NO. That the City of. Burlingame grant to CLAUDE R. KECK, his heirs and successors, permission to use the southwesterly eight (S) feet, front and rear measurements, of that portion of a ten (10) foot alleyway situated in the rear of Lots Nos. 16 and 17, in Block No. 5, as per Map of Easton Addition to Burlingame, for vehicular egress and ingress only, upon the followin; conditions: (1) The City of Burlingame reserves its right to use the northeasterly two(2) feet of said alleyway for utility pur- poses, and the said CLAUDE R. KECK is to use the remaining portion of the alleyway in such manner and at such times, as will never interfere with or impede said City, its agents and employees, in carrying on any necessary work in said alleyway. (2) That the said CLAUDE R. KECK shall pay to the City of Burlingame, the sum of Twenty-five Dollars ($25.00) per annum for such use and permission. (3) That the said CLAUDE R. KECK agrees to construct, maintain and repair a pavement over the area to be used by him. The said pavement shall be of such character as may be required by the Superintendent of Public Works and the Superintendent of the Municipal Water Works. (4) That the said CLAUDE R. KECK will agree to hold the City of Burlingame harmless from any loss it may suffer by reason of any injury to any person or property on that portion of the alleyway herein granted for his use. (5) That the City of Burlingame reserves the right to 1. revoke the permit if the said CLAUDE R. KECK, or any of his successors, breach or violate any of the conditions of the grant herein authorized. That the Mayor and the City Clerk are hereby authorized to execute any documents necessary to carry this Resolution into effect. Introduced this BtY-. day of July, 1940.
