HomeMy WebLinkAboutReso - CC - 010-19404 RESOLUTION NO. RESOLVED: That the City of Burlingame enter into an Agreement with E. BARBAGELATA, J. CELLONI, L. ZIRRELLI, B. BRUZZO, and V. ARATA, operating under a partnership known as L. ARATA GARBAGE COMPANY, and L. FIGONE, M. CONDO, M. UGHT, C. FRAGULIA, L. DEVINCENZI and M. BERNETEICH, operating under a partnership hmown as BURLINGPI41E GARBAGE COMPANY, to remove and haul away gar- den cuttings and dry rubbish from in front of residence premises in said City, for a period of five (5) years beginning July 1, 1940, for a fixed compensation of Three Hundred Twenty-five Dollars ($325.00) per month, according to the proposed agreement attached hereto and made a part hereof; BE IT FURTHER RESOLVED: That the agreement dated July 18, 1938, made with the same parties, providing for the removal of garbage in said City, be and all of the terms thereof are extended so as to be in effect to and including June 30, 1945; BE IT FURTHER RESOLVED: That the Mayor and City Clerk be and they are hereby authorized to execute the necessary agree- ment for and in behalf of said City of Burlingame. TEIS AGR' E',II YT, made and entered into this 20th day of Auf=ust, 1940, by and between the CITY OF BURLINGAME, a Municipal Corpor- ation, the _;arty of the first part, and E. BARBACFLATA, J. CI:LI.OSI, L. ZIRRELLI, B. BRUZZO and V. ARATA, operating under a partnership known as L. ARATA GARBAGE COMPANY, and L. FIGONE, M. CONDO, M. UGIIE, C. FRAGULIA, L. DFV1'TCFNZI and M. BERVETEICH, operating under a partnership known. as BURLINGAU GARBAGE COMPANY, both of which and the members thereof are designated as the party of Vrx second part, JITNESSETH- V??LREAS, the party of the first part, as a municipal func- tion, and according to regulations prescribed by it, does cause a certain dry refuse, consisting of garden cuttings and dry rub- bish to be gathered from the front of residence properties in said City, and hauled away for disposition, and desires to con- tract with the party of the second part for the purpose of carrying such function into effect; and, WHEREAS, the party of the second part, engaged in the busi- ness of garbage disposal, is willing to contract with the party of the first part to gather and haul away for disposition the refuse above mentioned; NOW, THEREFORE, in consideration of the premises and other valuable consideration, moving to the parties hereto, as herein mentioned, the said parties do agree as follows; 1. The party of the second ,art hereby agrees to gather and haul away, according to regulations as to time, place and districts prescribed by the party of the first part, garden cut- tings and dry rubbish deposited in containers in front of the residence properties in said City, for a period of five (5) years beginning July 10 1.40, the compensation therefor to be paid to the said party of the second Marty by the party of the first part, to be Three hundred Twenty-five Dollars (a325.00) per month, which compensation the party of the first part hereby agrees to 4 Pane - 2. pay. 2. Party of the second part hereby further agrees to fur- nish any and all equipment necessary to complete the terms of this agreement, excepting garbage or refuse containers, and in this connection, the party of the first part hereby agrees to adopt and enforce all regulations necessary to assist the party of the second part in the complete performance of this agreement, and permit said second party to deposit dry rubbish, collected in accordance with this agreement, at City Dump. For the consideration hereinafter mentioned it is furti;er agreed between the parties hereto, that the contract and each of the terms therein specified, made and entered into on July 18, 1938, between the same parties as to this agreement, providintc for the collection and disposal of garbage in said City of Burlingame, be, and the same are hereby, extended to and Includ- ing; the 30th day of June, 1945, provided, however, that the fixed consideration of Fifteen Hundred Dollars (J1500.30) per annum, as therein provided to be paid by the party of the second part to the party of the first part, is hereby increased to Seventeen Hundred Dollars (p"1700.00) per annum, beginning July 1, 1940, said payments to be made in the manner and time specified in the oril-inal agreement. It is mutually understood and agreed that this contract applies to City of Burlingame within legal limits as of this date. Forward, for signatures Page - 3.
