RESOLUTION NO.
RESOLVED by the City Council of the City of Burlingame
that an Agreement be entered into with HAROLD B. HAYMILL,
381 Bush Street, San Francisco, California, for the purpose of
employing said Harold B. Hammill as engineer in providing
engineering and architectural services kXxxxxxxXxxxx7C j=XXXg
jLJXtjz3F-for the preparation of designs, plans and specifications
and for general supervision of construction of a vehicular under-
pass under the Southern Pacific Company's tracks and adjacent
streets in the immediate vicinity of Burlingame High School.
BE IT FURTHER RESOLVED that upon completion of the
preliminary studies, the said Harold B. Hammill be paid the sum
of Three Thousand Five Hundred Dollars ($3,500.00).
BE IT FURTHER RESOLVED that the Mayor of the said City
of Burlingame be, and he is hereby authorized for and on behalf
of the City Council, to execute the Agreement herein provided
for.
The foregoing Resolution was adopted at a regular
meeting of the City Council of the City of Burlingame held on
December 22, 1941, by the following vote;

THIS AGREEMENT made this 22nd day of December in the year
nineteen hundred and forty-one by and between the CITY OF BURLINGAME,
California, hereinafter called the Owner, and HAROLD B. HAMMILL,
381 Bush Street, San Francisco, California, hereinafter called the
Engineer:
1. ENGINEERIS SERVICES AND FEE: The engineer agrees to
provide all engineering and architectural services required for,
(a) all preliminary studies and for (b) preparation of
design, plans, and specifications, and for (c) general
supervision of construction for a vehicular underpass
under the Southern Pacific Company's tracks and adjacent
streets in the immediate vicinity of the Burlingame High
School, for a sum in lawful money of the. United States
equal to five per cent (5%) of the contract cost of con-
struction of such underpass. Said design, plans and
specifications are to be acceptable to the Owner, the
California Highway Commission, the Southern Pacific
Company, and any other corporations or agencies legally
or financially interested in this project.
The preliminary studies shall include all work neces-
sary to determine the proper location of the underpass, determination
of probable sources for financing the project and an estimate of cost.
2. PA=NTS: The Owner agrees to pay the Engineer in ac-
cordance with the following schedule:
(a) The Owner agrees to pay the Engineer the sum of
Five Hundred Dollars ($500.00) per month from the time
the Engineer is authorized to commence work until the
preliminary studies have been completed and the pre-
liminary report has been presented to

the City Council of the City of Burlingame. At the completion
of the preliminary studies the Engineer shall receive a sum which
added to the aggregate monthly swns paid up to that time equals
thirty-five hundred dollars (14'>3500.00).
(b) During the period of preparation of designq plans and
specificationsg the Owner agrees to pay the Engineer the sum of
Five Hundred Dollars 0500.00) per month plus actual payroll
costs. At the completion of plans and specifications the Engineer
shall receive a sumo Which added to the aggregate of monies re-
ceived shall be equal to seventy-five per cent (751.) of the total
fee based on the estimated construction cost.
(c) The remaining portion of monies due the Engineer as determined
by actual contract costs shall be p4id monthly in proportion to the
Lmount of -.:ork completed on the project.
3. SUPERVISION OF `UORKS In providing general supervision of con-
struction the Engineer shall visit the work at such frequent intervals as to
have close personal knowledge of the construction.
4. The 0•,,ner reserves the right to terminate this contract at the
expiration of any one of the periods of this work as designated above by "a" and
"b" and the Engineer hereby agrees to be fully compensated in accordance viith
the provisions under "Payments" at the termination of either one of these
