RESOLUTION NO.
v4FREAS, the City of Burlingame, by and through the
City Council thereof, has agreed to pay an additional sum of
Fifty Dollars ($50.00) per month to the parties composing the
partnership of L. ARATA GARBAGE COMPANY and the partnership
known as BURLINGAME GARBAGE COMPANY, for the cost and expense of
gathering refuse and rubbish in the new subdivision known as
Burlingame Village and pursuant to the Agreement heretofore made
between the City and the said garbage companies dated August 20,
1940;
NOW, TI-MREFORE, be it resolved that the annexed Agree_
ment containing the amendment to the original Agreement dated
August 202 1940, between the parties aforementioned, be entered
into according to the terms thereof, as therein set forth, a
copy of which Agreement is hereto attached and made a part of
this Resolution;
BE IT FURTHER RESOLVED that the mrayor and the City
Clerk be and they are hereby authorized, for and in behalf of
the City Council of the City of Burlingame, to execute the said
Agreement and attach the Seal of the City thereto.
The foregoing Resolution was introduced at a regular
meeting of the City Council of the City of Burlingame held on
June 1, 1942, and adopted by the following vote;
Ayes; Councilmen Coleman, Dahl. Hunt & Roth
Noes; Councilmen None
Absent; Councilmen Burrows

THIS AGREEMENT made and entered into this lst day of
June, 1942, by and between the CITY OF BURLINGAME, a Municipal
Corporation, the party of the first part, and E. BARBAGELATA,
J. CELLONI, L. ZIRRELLI, B. BRUZZO And V. ARATA, operating under
a partnership known as L. ARATA GARBAGE COMPANY, and L. FIGONE,
M. CONDO, M. UGHE, C. GRAGULIA, L. DEVINCENZI AND M. BERNETEICH,
Operating under a partnership Known as BURLINGAME GARBAGE COMPANY,
both of which and the members thereof are designated as the party
of the second part,
W I T N E S S E T H:
WHEREAS, the parties hereto entered into an Agreement
on the 20th day of August, 1940, wherein the party of the second
part, for a consideration, agreed to gather and haul away certain
dry refuse, rubbish and garden cuttings, for a period of five (5)
years beginning July 1, 1940, for the sum of Three Hundred Twenty-
five Dollars ($325.00) per month, the said Agreement contemplating
the then existing limits of the City of Burlingame; and,
WHEREAS, since the execution of the said Agreement, the
City of Burlingame has annexed a subdivision known as Burlingame
Village, and that the cost and expense of gathering refuse and
rubbish in said new subdivision will be at an additional cost to
the party of the second part, and the party of the first part is
desirous of paying Into the said party of the second part an
additional amount to take care of the excess;
NOW, THEREFORE, in consideration of the premises and
other valuable consideration, moving to the parties hereto, as
herein mentioned, the said parties do agree as follows:
1. That the said Agreement entered into on August 20,
1940, between the parties hereto, be amended so that the compen-
sation to be paid to the party of the second part shall be
Three Hundred Seventy-five Dollars ($375.00) per month, commencing

June 1, 1942, and continuing to the end of the term of said
agreement as therein set forth, which said Three Hundred Seventy-
five Dollars ($375.00) per month the said party of the first part
hereby agrees to pay.
2. The party of the second part hereby agrees to
carry out its part of the aforesaid Agreement of August 20, 19402
all according to the terms and conditions as therein set forth,
and to include Burlingame Village.
IN WITNESS WHEREOF, the party of the first part has
caused these presents to be executed by the Mayor and City Clerk
of said City of Burlingame, and the parties of the second part
have hereunto affixed their hands the day and year first above
written.
