HomeMy WebLinkAboutReso - CC - 043-1947RESOLUTION NO. 43-47 DECLARING NOXIOUS AND DANGEROUS WEEDS, RUBBISH, RE'iUSE OR DIRT ON PARK WAYS, SIDE5IALK3, OR PRIVATE PROPERTY TO BE A PUBLIC NUISANCE. RESOLVED by the City Council of the City of Burlingame: That all weeds growing u.:on any private property or in any public street, lane, way, or alley within the City, and bearing seeds of a wingy or downy nature or which, because of having attained such a large growth and being dry shall have become a fire menace or which are otherr:ise noxious or dangerous, and all rubbish, refuse or dirt on park ways, sidewalks or pri- vate property, are hereby declared to be a public nuisance, and shall be abated by the ofvner of the property, who is hereby re- quired to remove or destroy such weeds, rubbish, refuse, or dirt, from his property, and in iie abutting one-half of the street in front and the alley, il:' any, behind his property, and between the lot lines thereof as extended. FURTHER BE IT RESOLVED that the property upon which said nuisance exists or all of the streets, squares, lanes, alleys, courts, avenues, places, and private property within said City as shown, described and delineated on the several maps of the City of Burlingame as said ma- s are recorded in the office of the County Recorder of the County of San Mateo, reference in each instance for tI-B description of any particular street or property eing hereby made to the several maps aforesaid, and in the event of there being several subdivision maps upon tahich the same lots are shown, reference is h:_reby made to the latest subdivision map, BE IT .rURTHER R-ESODTED, that Monday, the day of cember 1947, at the hour of 8:00 otclock P.M. of said day and at the council chambers of the City Council of the City of Burlin- located in the City Hall in said City, be and the same is ereby fired as the time and place vinen objections to the proposed emoval of such greeds shall. be held and given due consideration, BE IT FURTHER RESOLVED that the Sixperintendent of Streets of the City of Burlingame be hereby ordered to cause notice of the hearing to be given as prescribed by law. City Clerk AFFIDAVIT OF POSTING NOTICE TO DESTROY WEEDS STATE OF CALIFORNIA SS COUNTY OF SAN MATEO CHARLES A. WILSON, being first duly sworn, deposes and says:l That pursuant to the direction of the Superintendent of Streets, he posted eighteen hundred and fifty (1.850) copies of Notice to Destroy Weeds throughout all the streets of the City of Burlingame, as per the copy of the notice attached hereto, and that the posting of these notices was completed on November 25, 1947. V Street Maintenance Foreman City of Burlingame ATTEST: November , 1947 Notice is hereby given that on the 3rd day of November, 1947. the City Council of the City of Burlingame passed Resolution No. 43.47 declaring that noxious or dangerous weeds, rubbish, refuse and dirt upon or in front of property in all streets in said City of Bur- lingame in those certain subdivisions of the City of Burlingame more particularly described in said resolution, constitute a public nuisance which must be abated by removal of said noxious or dangerous weeds, rubbish, refuse and dirt, otherwise they will be removed and the nuisance will be abated by the municipal authorities, in which case the cost of such re- moval shall be assessed upon the lots and lands from which or in front of which such weeds, rubbish, refuse and dirt are removed, and such cost will constitute a lien upon such lots or lands until paid. Reference is hereby made to said resolution for further particulars. All property owners having any objection to the proposed removal of such weeds, rub- bish, refuse and dirt are hereby notified to attend a meeting of the City Council of the City of Burlingame to be held on Monday, the 1st day of December, 1947, at 8:00 p.m., when their objections will be heard and given due consideration.
