HomeMy WebLinkAboutReso - CC - 011-1947RESOLUTION NO. 11-47 WHEREAS, Hills Water Company, a corporation, operating a water service for the supply of water to consumers in the Burlingame Hills District adjacent to the city limits of the City of Burlingame; and WHEREAS, it is necessary for the City Water Department to prepare to furnish water to the area in the city known as Burlingame Manor; and WHEREAS, on November 22, 1946: the Hills Water Company, a corporation offered to lease to the City of Burlingame its entire property including land, reservors, transmission and distribution mains, services, meters, hydrants, valves, fittings, pumping plant and all appurtenances, for a monthly rental of WO.00; and at the same time offered to sell to the City of Burlingame its entire property including all the factors before mentioned for the sum of ?35,000.00 provided the offer be accepted before June 10, 1947; and WHEREAS, the City Council of the City of Burlingame at a meeting held on November 23, 1946, held for the purpose of considering the offer of Hills Water Company, adopted Resolution No. 41-46, accepting said offer; and WHEREAS, pursuant to the authority vested in him, the City Engineer completed arrangements for transfer of the prop of said Hills Water Company, and ever since January 10, 1947, the Burlingame Municipal Water Works has been operating the entire plant of said Hills Water Company; and WHEREAS, application was made to the Public Utilities Commission of California by the Hills Water Company to sell its entire property to the City of Burlingame and thereafter the said Public Utilities Commission made an offer authorizing the sale of the entire property to the City of Burlingame; and WHEREAS, the Water Commission of the City of Burlingame, after consideration of the matter of purchase, unanimously decided to recommend that the City Council exercise "its option" to purchase the property of Hills Water Company, a corporation; and WHEREAS, the City Council after due deliberation deem it to be to the interest and best advantage of the City of Burlingame that the purchase of entire property of Hills Water Company be consummated at the offered price of �'�35,000.00. NOW, THERE IFOR, BE IT RESOLVED by the City Council that the City of Burlingame purchase from Hills Water Company, a corporation, all of its water rights and physical properties, in- cluding land, reservoirs, transmission and distribution mains, services, meters, hydrants, valves, fittings, pumping plant and all appurtenances for the sum of $35,000.00. BE IT F'QRTHER RESOLVED that the chairman of the City Council, the City Engineer and the City Attorney be and they are hereby authorized and directed to carry into effect this resolu- tion and consummate the purchase herein mentioned. BE IT. F[TRMER RESOLVED: That there `.s hereby appropriated from the Operating Fund of Burlingame Municipal Water Works the sum of t20p000.00 and the sum of d,D'15,000.00 from the Capital Outlay Fund to provide the purchase price for the property herein - above mentioned.
