HomeMy WebLinkAboutReso - CC - 006-1946RE30LUTION NO. 6 -46 COYDEP%NING PREIsMES IMOINN AS PORTOLA HOTEL AMEX AS A NUISANCE 0 0 0 0 0 0 0 0 0 0 0 0 0 0 G 0 0 WHEREAS, the Department of Public Health and S,Velfare, the Fire Chief and the Building Inspector, of the City of Burlingame having heretofore made an inspection of the premises designated as 315 Lorton Avenue, in the City of Burlingame, and having reported their investigation to the City Council from which report and investigation it was recommended that the said premises were maintained in violation of the health regu- lations and in their present condition are a menace to the health and welfare of the City and all the persons living in the vicinity thereof, and that there was also a very great fire hazard because of the condition of the said premises: and, 47112L'4S, the City Council at its meeting on January 7th, 1946, after considering the matter, directed that February 4th, 1946, at the hour of eight o'clock P.Mn., of said day and before the said City Council, of the City of Burlingame, have fixed as the time and place when and where all persons interested should appear before said City Council and show cause why the said premises should not be condemned as a public nuisance and further that due notice be given to the persons interested of the time and place of said 'nearing: and, WHEREAS, Ir. Joseph A. Garry, as administrator of the estate of P,ary 'endt, deceased, represented the owners of the premises involved and by his letter, dated January 29, 1946, addressed to the City Council stated that steps to remove the building and the shed which adjoins the hotel premises would be taken immediately: and, WHEREIS, the City Council at its meeting on February 4, 1946, hereby finds that the said premises are a nuisance to the health and welfare of the City and should be condemned and the buildings removed: NOVI, THEREF M E, the City Council of the City of Burlingame does hereby order that the said premises located at 315 Lorton Avenue, in the City of Burlingame, commonly known and designated as the tortola Hotel ?nnex and the shed adjoining thereto are a nuisance as defined by Section 105 of the Ordinance Code of the City of Burlingame and that steps should be taken immediately to have the said buildings removed: IT IS FM TH;ER RESOLVED and ordered that the City Clerk of the City of Burlingame serve written notice upon iir. Joseph A. .marry as administrator of the estate of b'ary Wendt, deceased, that steps be taken to abate the said nuisance immediately by removing the buildings herein mentioned and that if they are not so removed within a period of five (5) days as provided by the Ordinance Code of the City of Burlingame then in that event the Superintendent of Streets summarily remove the said buildings and all the material therein and the cost of such removal be fixed as a lien upon the real estate upon which the building is situated and collected at the same time as the taxes thereon are collected.
