R OVAL OF GARDEN CUTTINGS AND D Y RUBBISIi IN THE CITY OF BURLINGAME. * * * * * * * * * * * * * * * * * * * * RESOLVED by the City Council of the City of Burlingame that the said City enter into an agreement with the San Mateo County Scavenger Company, a Corporation, for the purpose of removing and hauling away garden cuttings and dry rubbish deposited in front of residence property in the City, for a period of five (5) years beginning July 1, 1945, all pursuant to the terms of the contract hereunto attached and made a part of this resolution: BE IT FURTHER RESOLVED, that the Mayor of the City be, and he is hereby authorized for their behalf of the City to execute the said agreement. DNAN, CITY CLERK, of the City of Burlingame, do hereby certify that the foregoing Resolution was introduced and duly passed at a regular meeting of the City Council of the City of Burlingame, held on August 6, 1945, by the f ollowing vote: AYES: COUNCILMEN: Dahl -Harris Hunt-Roth-dhitsell NOES: COUNCIUiEN: None ABSENT: COUNCIIYL,N: None City Clerk City of Burlingame AGREEDINT FOR TIE REMOVAL OF GARDEN CUTTINGS AND DRY RUBBISH This Agreement made this day of July, 1945, between the City of Burlingame, a Municipal Corporation, the party of the first part, and San Mateo County Scavenger Company, a Corporation, the party of the second part; WITVESSETH: WHEREAS, the party of the first part is desirous of contracting with the party of the second part to remove dry refuse, consisting of garden cuttings and rubbish from in front of the residence properties in the City of Burlingame and removing them for disposition, and the party of the second part is agreeable to entering into such a contract; NOW, THD R FORE, in consideration of the premises and of the covenants and agreements herein contained, the parties hereto agree among themselves as follows: FIRST: The party of the second part hereby agrees to remove and haul away garden cuttings and dry rubbish deposited in the front of the residence properties in the City of Burlingame, for a period of five (5) years beginning July 1, 1945. Such removal shall be performed every other week, and as compensation therefore the party of the first part hereby agrees to pay to the party of the second part the sum of SIX HUNDRED (0-600.)DOLLARS per month. SECOND: The party of the first part hereby reserves the right to terminate this agreement at any time upon giving to the party of the second part a six months notice,in writing; said termination to be for the purpose of the party of the first part to operate the aoove outlined service with municipal equipment and personnel. THIM: The party of the second part hereby agrees to furnish all labor and equipment necessary to do and perform the requirements of this agreement, and the party of the first part agrees to assist and enforce all nec- essary regulations to complete this contract. Said regulations to be adopted by both parties within thirty days from the signing of this contract and to be a part thereof; FOURTH: The party of the .first part hereby grants to the party of the second part permission t o d eposit all such garden cuttings and dry rubbish collected pursuant to the terms of this Agreement, at the "City Dump", so called; FIFTH: It is understood and agreed that the terms of this Agreement shall apply to all of the City of Burlingame except the subdivis ion thereof known as gay Park.
