HomeMy WebLinkAboutReso - CC - 044-1948RESOLUTION NO. 44-48 RESOLVED that the City of Burlingame, a municipal corporation, enter into the attached agreement with the Pacific Gas and Electric Company, a corporation, for furnishing electricity for a neon directional sign now installed at Hillside Drive and the Skyline Boulevard in the City of Burlingame, pursuant to the terms of said Agreement. White, do hereby certify that the foregoing - resolution was introduced a; a regular meeting of the City Council held on October 4, 1948, and adopted by the following vote; AYhS: COUNCIL?TEN: T)a%�l _ ?ar�er_�ir i-_i.nVP-Si.tlt�n��s ITOES: COUNCILIvEN: ABSENT COb TICILT?TETv : TqnnP - Herbert K. _ite, City Clerk - 9-1-48 THIS AGREEMENT made by and between PACIFIC GAS AND ELECTRIC COMPANY, a California corporation, hereinafter call- ed Pacific, and CITY OF BURLINGAME, a California municipal corporation, situate in the County of San Mateo, State afore- said, hereinafter called City, W ITNESSETH that: For and in consideration of the respective promises of the parties hereto they do hereby mutually agree as follows, to -wit: 1. Pacific shall, during the term hereof and subject to the terms and conditions hereinafter set forth, furnish elec- tricity for lighting one (1) City -owned and -maintained 820 watt neon directional sign,now installed at Hillside Drive (North) and Skyline Boulevard, in said City of Burlingame, County and State aforesaid. 2. Said neon directional sign shall be lighted each night during the term hereof on Pacific's standard all-night burn- ing schedule. Service to said sign shall be turned on and off once each night by means of a City -owned and -maintained astronomical dial time clock, regulated to limit the hours of operation of said sign to 4000 hours per year. Pacific reserves 1. the right to inspect and adjust said City -owned time clock from time to time during the term hereof. 3. City shall pay Pacific monthly at its office in said City for electric service rendered hereunder at the rate of Four and 75/100 Dollars ($4.75) per month. 4. Said electricity shall be delivered by Pacific to City at the point where wires owned, leased or under license by City contact Pacific's wires, but for the con- venience of the parties hereto said electricity may be trans- formed at a location on the City's side of said point of delivery, as shall be arranged by the parties hereto. 5. This agreement shall be and remain in force for the period of five (5) years from and after August 2, 1948, and shall continue thereafter until terminated by thirty (30) days' written notice given by either party to the other of such termination. 6. This contract shall at all times be subject to the rules and regulations of Pacific now and hereafter on file with the Public Utilities Commission of.the State of California. 7. This contract shall at all times be subject to such changes or modifications by the Public Utilities Commission 2. of the State of California as said Commission may, from time to time, direct in the exercise of its jurisdiction.
