Oswald has executed and delivered to a representative of the City of Burlingame his option annexed hereto, wherein said party agrees to sell and convey to the City of Burlingame, the property described in the option for the price therein stated and subject to a condition set forth; and WHEREAS, the City Council of the City of Burlingame desires to accept the said option, subject to the condition, at the said price; NOW, THEREFORE BE IT RESOLVED, by the City Council of the City of Burlingame that the option to purchase, annexed hereto be, and the same is hereby accepted by the City of Burlingame in accordance with the teens and specifications set forth. an�ve, Jr. ;Mayor I, Herbert K. Whites City Clerk of the City of Burlingame, do hereby certify that the foregoing resolution was introduced at a regular meeting of the City Council on November 21, 1949 and adopted thereafter by the following vote: Al —ES: COUNCIIMEN: Atwater -Dahl -Hunt -Love -Simonds NOES: COUNCITI EN: None ABSENT COUNCILMEt: None Herbert e City Clerk I KNOTT ALL MEN BY THESE PRESENTS: THAT CA:J FORNIA PACIFIC TITLE INSURANCE COMPANY, a corpora- tion, formerly California Pacific Title & Trust Company, a corpor- ation, of the City and County of San Francisco, State of California, in consideration of the sum of One Dollar (€4.00) to it in hand paid, receipt whereof is hereby acknowledged, does hereby bargain and agree to and with the City of Burlingame, a municipal corpora- tion, hereinafter referred to as the City, upon the payment to it or its legal representative, of the sum of Eighty -Eight Hundred Dollars ($8,800.00) to sell and convey to the City, free and clear of all liens and encumbrances, the following described real prop- erty situated in the City of Burlingame, County of San Mateo, State of California: All that portion of lands described in Parcel No. 1, in the deed from the Burlingame Shore Land Company, a corpora- tion, to the California Pacific Title Insurance Company, a corporation, dated March 25, 1935, and recorded April 3, 1933, in Book 587 of Official Records of San Mateo County, at Page 427, which lies southerly of a line parallel to and distant 80 feet northerly at right angles from the northerly line of the Southern Pacific Company's right of way, and more particularly described as follows: BEGINNING at a point which bears North 330 33' East, a distance of 60,33 feet and South 520 26' East, a dis- tance of 281.53 feet from the intersection of the north- erly line of the Southern Pacific Company's right of way, and the southeasterly line of Broadway (when a 60 foot street prior tothe widening thereof); thence from said point of beginning parallel to and distant 60 feet northerly at right angles from the said line of the Southern Pacific Company's right of way North 620 26' West, a distance of 120.66 feet; thence North 330 33' East, a distance of 20,11 feet; thence parallel to and distant 80 feet northerly at right angles from the said line of the Southern Pacific Company's right of way South 620 26' East, a distance of 120.66 feet; thence South 330 33' West, a distance of 20.11 feet, more or less to the point of beginning. TOGETHER with all the appurtenances thereunto belonging, It is expressly agreed that City shall remove or alter the existing improvements, without cost to the undersigned, as follows: (a) Remove approximately twenty feet of galvanized steel building and concrete slab and footings, delivering the re- claimable sheet metal to the undersigned; -1- (b) Remove and dispose of masonry wall and foundation, (c) Remove all of brick masonry building, delivering re- claimable steel sash, tile roof, lumber and plumbing to undersigned. All of the above work shall be performed within a period of 180 days from the date of recording the conveyance of the real property, and only after giving written notice to the undersigned 30 days prior to the beginning of work.
