AUTHORIZING DISMISSAL OF ACTION "CITY OF BURLINGAME
VS. GEORGE F. LYON, ET AL, CASE 22908
WHEREAS, the City of Burlingame, a municipal corporation,
on January 25, 1934, commenced an action against George F.
Lyon, et al, defendants, to condemn certain property for public
use for the construction of a storm water drainage system; and
WHEREAS, subsequent to the commencing of the aforesaid
action a grant was made to the City of Burlingame, dated
June 29, 1934, and recorded July 28, 1934 in Book 626 of
Official records of San Mateo County at Page 411 wherein said
George F. Lyon, et al, granted to the City of Burlingame an
easement for constructing and maintaining a drainage canal
over certain land of the grantors, which the aforesaid action
was brought to condemn; and
WHEREAS, the grant of George F. Lyon, et al, above
referred to made the action, No. 22908, above mentioned un-
necessary, and no proceedings were had in said action since the
date of the filing of the complaint and for the purpose of
clearing the title to said land a dismissal of said action is
required by the present owners, Lyon and Hoag, a corporation.
NOW, THEREFORE, BE IT RESOLVED and it is hereby ordered
by the City Council of the City of Burlingame, that the City
Attorney be, and he is hereby authorized to prepare and file a
dismissal of the action, No. 22908, pending in the Superior
Court of the State of California, County of San Mateo and
entitled "City of Burlingame, plaintiff, vs. George F. Lyon,
et al, defendants."
