Josephine Lang has executed and delivered to the representative of the City of Burlingame, an option annexed hereto, wherein said party agrees to sell and convey to the City of Burlingame, the property described in the option for the price therein stated; and WHEREAS, the City Council of the City of Burlingame desires to accept the said option, at the said price; NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Burlingame, that the option to purchase, annexed hereto, be, and the same is hereby accepted by the City of Burlingame in accordance with the terms and specifications set forth. ? � 4� U. JOSEPHINE LAND of the County of San Mateo, State of California, in consideration of the sum of One Dollar (1.00) to her in hand paid, receipt whereof is hereby acknowledged, does here- by bargain and agree to and with the City of Burlingame, a municipal corporation, hereinafter referred to as the City, upon the payment to her or her legal representative, of the sum of Nineteen Thousand Two Hundred and Sixty -One Dollars (619,261.00) to sell and convey to the City, free and clear of all liens and encumbrances, the following de- scribed real property situated in the City of Burlingame, County of San Mateo, State of California: COMMENCING at a point on the northwesterly line of Oak Grove Avenue, distant thereon North 480 30, East, 69.4 feet from the point of intersection thereof, with the center line of the 100 foot right of way of the Southern Pacific Railroad Company; thence North 620 301 West and parallel with said center line of the right of way of the Southern Pacific Railroad Company, 115 feet 4 inches to the southeasterly boundary of that certain parcel of land de- scribed in Deed from Fred Bakewell, a widower, to Mary Frances Ayers, dated December 18, 1906,and recorded December 21, 1906, in Book 127 of Deeds at Page 270, Records of San Mateo County; thence on and along said southeasterly boundary of the lands conveyed to Ayers, North 480 30, East, 69.85 feet; thence South 620 30t East and parallel with said right of way of the Southern Pacific Rail- road Company, 115 feet 4 inches to the northwesterly line of Oak Grove Avenue; thence on and along said northwesterly line of Oak Grove Avenue, South 480 30, West, 69.85 feet to the point of be- ginning. It is hereby understood and agreed that the undersigned shall remain in possession of the above described premises until such time as the City is prepared to proceed with the extension of Carolan Avenue. The undersigned agrees to execute the deed and place the deed in escrow with the California Pacific Title Insurance Company at Redwood City to be recorded upon the payment by the City of the above mentioned sum, with the understanding that the transaction will be closed not sooner than April 1, 1950. It is also understood and agreed that the City will rezone to commercial the remaining portion of the lot fronting 73.15 feet on Oak Grove Avenue, otherwise this option is to become null and void.
