FINDINGS AND DETEIUIINATION OF THE CITY
COUNCIL ON THE APPLICATION OF PAUL
R. A. WESSEL FOR A VARIANCE IN USE OF
LOT 13, BLOCK 10, AS PER MAP OF BURLINGAME
LAND COiti,PANY
'iHEREAS, On November 11, 1948, Paul R. A. Wessel as
owner, filed with the City Clerk of the City of Burlingame his
verified petition praying for an order of the Council to permit
a variance in the use of property in the City of Burlingame,
commonly designated as Lot 13, Block 10, Burlingame Land Sub-
division and known as street No. 1449 Bellevue Avenue, and gave
the following reason for such variance in use of the said
property:
That the petitioner had entered into an agreement to sell
the said property to the San Mateo County Chapter of the American
Red Cross. The property and the buildings thereon were to be
used by the said Chapter to carry on its work and for administra-
tion purposes. That unless the variance in use was granted, the
said San Mateo County Chapter was not interested in the property;
and
WHEREAS, the City Cleric set the petition for hearing
before the Planning Commission for December 2, 1948, and gave
the notice thereof as required by law; and
WIiEREAS, The Planning Commission at the time last
mentioned held the public hearing and thereafter recom:::erded to
the City Council that the variance in the use of said property
be granted; and
WHEREAS, the City Council at its meeting held on
December 6, 1948, fixed December 20, 1948, as the time for the
public hearing before the said Council upon the said application
and the recommendation of the Planning Commission; and
WHEREAS, the City Clerk gave the notice of the said
hearing before said Council as required by law; and
'WHEREAS, on December 20, 1948, the said City Council held
a public hearing upon the petition aforementioned and after a
full and complete discussion on the matter, interested citizens
participatin@; therein, the City Council unanimously determined
that the granting of the variance herein applied for will not be
detrimental to the public welfare nor injurious to the property
in the immediate vicinity.
AND NOvd IT IS HEREBY RESOLVED AND ORDERED by the City
Council of the City of Burlingame that a variance in the use of
the property described in the petition and abovementioned is
hereby granted provided the following conditions af'e carried out
and complied with:
1. That if the sale of the property to the San Miateo
County Chapter of the American Red Cross is not consummated
before April 1, 1949, the variance herein granted shall be of
no force or effect and shall 'be automatically revoked and
cancelled.
2. That the property shall be used by the San a;ateo
County Chapter of the American Red Cross for its local and admin-
istrative purposes and for no other purpose; any use of said
property for any other purpose being hereby prohibited.
3. In the event the San E'ateo County Chapter of i,merican
Red Cross shall cease to use the said property for the purposes
as aforesaid, the variance herein granted shall be automatically
revoked and cancelled.
4. Any violations of the conditions herein specified
shall be sufficient reason to revoke the variance herein granted.

hereby certify that the foregoing Resolution was introduced
at a regular meeting of the City Council held on January 3, 1948,
and adopted on the same date by the following vote:
