HomeMy WebLinkAboutReso - CC - 033-1950RESOLUTION NO. 33-50 RESOLUTION OF INTENTION TO ABANDON EXISTING UTILITY EASEMENT TO LOT 8, BLOCK 9, AS PER MAP OF BURLINGAi:E GARDENS, FILED MAY 15, 1940 WHEREAS, It appears to the City Council that convenience and necessity require the abandonment of existing utility easement, 10 feet in width, on the westerly portion of Lot 8, Block 9, as designated on the map and entitled "Burlingame Gardens, Burlingame, California", which map was filed in the office of the Recorder of the County of San Mateo, State of California, on May 15, 1940, in Book 22 of Maps at pages 66 and 67, and to accept from the owner therefore, in place thereof, a similar easement on the easterly 5 feet of said Lot 8 and the westerly 5 feet of Lot 7 in said block and subdivision. NOVI, THEREFORE, BE IT RESOLVED A14D IT IS HLiiEB_1 ORDERED: that it is the present intention of the City Council to abandon the existing easement above described and referred to, and that Monday, September 18, 1950, at the hour of 8:00 p.m., at the Council chambers in the City of Burlingame, California, are hereby fixed as the time and place when and where any person interested in said matter may appear and be heard for or object to the abandonment of said easement. It is further ordered that this Resolution shall be pub- lished once in the Burlingame Advance, a newspaper of general circulation published in the City of Burlingame, at least 10 days prior to said hearing. City Clerk, City of Burlingame the TitIT of kgnrlinpmr SAN MATEO COUNTY CALIFORNIA August 18, 1950 Honorable City Council, City of Burlingame, Burlingame, Ca:iifornia, Gentlemen: Re: Revision of Public Utilities Easement, Lots 7 & 8 Flock 9, Burlingame Gardens Subdivision Transmitted herewith is a letter dated August 14, 1950, addressed to the Council from Mr. Jo Cu Forsythe, owner of the subject lots. Mr. Forsythe has requested that proceedings be instituted for the abandonment of the existing easements totaling 10 feet in width along the easterly side of Lot 8. In consideration of such abandonment, Mr, Forsythe has proposed the dedication of two 5 foot ease tents in each of Lots 7 and 8, which would have the effect of moving the existing easement 5 feet easterly. He has also agreed to pay for the relocation of the existing water line so that it would lie within the new easement, providing such cost does not exceed the sum of 300,00, It is the rocommondation of this office that this proposal be appr-<aved, and that if the Council concurs in such recommenda- tion, Mro Forsythe be advised by letter of such approvalo Very truly yours, 3 K. Fitch Director of Public Works CC Mr, Karmel Y August 14, 1950 Honorable City Council City of Burlingame Burlingame, California Gentlemen: I am at the present time the owner of Lots 1 to 10, in- clusive, Block 9 of Burlingame Gardens, and I am propos- ing to sell said lots for the construction of ten apart- ment houses thereon. There presently exists a utility easement covering the easterly 10 feet of Lot 8, which easement as presently existing will prevent the construction of an apartment house on said lot. At the present time the only utility existing in said ease- ment is a 4 inch water main apnroximately 7 feet from the easterly property line of said lot. It is my proposal that the City abandon the existing ease- ment and in return I will execute a like easement over the easterly 5 feet of Lot 8 and the westerly 5 feet of Lot 9. I am also willing to pay for the cost of moving said 4 inch water main from its present location to a location with- in the new proposed easement; provided the cost of moving said pine does not exceed the sum of 5300.00. It is respectfully urged the.t your assent to this plan will be ordered. :he California Pacific title Insurance Co. has agreed to proceed with the issuance of the necessary policies of title insurance to close said contemplated sale upon re- ceiving the written assurance of your City Council that my proposed plan for relocating said easement is acceptable to you.
