Bearint, oridinally submitted at the mee.tin6 of September 8, 1958, was abain considered by the Commission. .in earlier discussions, Commissioners had in- dicated reluctance to approve further resubdivisions of the Bearint property without assurance that the Necessary public improvements, curbs, sidewalks, gutters, etc., were to be Installed. A letter written under date of October 7, 1958, by Robert 'Thompson, attorney representing Dr. Bearint, was read offeriraE; tape following: (1.) To enter into an improvement agreement with the City to provide necessary public improvements to the specif°lcations of the City Er 6lneer, the work to commence not later than three years from date of said agreement, or at the time tiiat a building; parmit application for new construction should be filed, whichever date is sooner; (2) to post a Goad. In the sum of 47000.00 to assure completion of the Improvements. Commissioner Stivers a6aln stated his opinion that the amount of the bond offered by Dr. Bearint dial not appear to be sufficient, pEar- ticularl,y la view of the fact that there was no definite program out- lined by the City as to actual Improvements required. The Plan_nl€a_,Consultant stated that the cost flgv res had been pre- pared by the contractirk firm of Fiek, Firenze and. VicLean£ based on what was cor►sldered to be a proper work plan. Chairman P'tarti n recognized Dr. Bearint who advised that at the pre. afat: time. tie preferred not to become Involved In any agreement concerning, public improvements, but In order to expedite Turther resubdiviviloa of his lands, was prepared to proceed in accordance with the plan out- lined in the communisation. The City attorney Otated that from the standpoint of tfZe City It would be preferable to process the appiitation 'under tips provisi.oiz of the Subdivision Ordiaance. 111r. Karciel pointed out tnat the offer made by Dr. Beariat differed from a normal subdivision agreement only In the postponement date of performance of public Improvements The Pla-ria ng Consultant stated that in his opinion there did not ap- pear to be any objection to the time element which was made sa part of the proposal and.further advised that It was his understa-ad rg th—a t Dr. Beal lat wab hoping; to avoid the cost of additioml. €;ng$ neoring work Involved in ars out -right subdivision agreement.
