Meeting called to order at 8:00 P.M; Chairman Henderson presiding.
In the absence of Secretary Diederichsen, the Chair appointed Com-
missioner Martin acting Secretary.
Minutes of the Regular Meeting of August 22 and the Adjourned Regu-
lar Meeting of September 12, 1955, approved as written.
HEARINGS:
1. CHANGE OF LOT LINES - LOTS 1 and 2, GLENWOOD PARK,
MARY M. DOEPFNER, 55 EL CAMINO REAL.
Director Public Works Marr presented to the Commission the final map
submitted by Mrs. Mary Doepfner proposing the above change of lot
lines.
Chairman Henderson, in review, stated that with approval of the map
the two lots become R-3 and can be developed as one unit.
There being no objections raised to the proposal, it was moved by
Commissioner Mitchell and seconded by Commissioner Martin that the
map as submitted be approved. Motion carried unanimously on roll
call of members.
2. RESUBDIVISION - SOUTHERLY PORTION BLOCK 8, MILLS ESTATE
NO. 3 J. B. OSWALD AND LOUIS JOHNSON.
The final map of.the proposed resubdivision, approved by the Direc-
tor of Public Works, was presented to the Commission.
In answer to Chairman Henderson's question, Mr. Thompson of Wilsey &
Ham stated the owners have an 8 acre parcel previously subdivided
into 2 lots of 4 acres each. The present request is to resubdivide
into 2 smaller parcels - 1 containing 2.035 acres MOL and the other
1.911 acres MOL. Mr. Thompson stated further that the Trousdale
Company holds the deed restrictions on the property.
In answer to Commissioner Mitchell's question, Planning Consultant
Mann observed that the property is on a service road and not on
El Camino Real.
Moved by Commissioner Martin and seconded by Commissioner Kindig that
the application as submitted be approved. Motion carried unanimously
on roll call of members.
Planning Consultant Mann, in further reference to the proposed resub-
division, stated there will be a number of stores, housed in separate
buildings constructed on the site. The stores will be located around
the lot and the central portion will be reserved for parking. Mr.
Oswald, the owner of the property, has agreed to present a plan to the
Commission showing the access and egress and the proposed development
of the property. '
3. RICHFIELD OIL CORPORATION
PROPOSED SERVICE STATION - NWC BROADWAY AND ROLLINS ROAD.
Secretary Martin read the minutes of the Planning Commission meetings
of July 15, 1954, and January 24, 1955, applicable to the subject.
A communication dated September 22, 1955, was read from the Richfield
Oil Corporation, San Francisco, submitting plans and specifications
covering the proposed station.
Chairman Henderson invited interested persons to speak. Mr. Carl A.
Blandin, Richfield Oil Corporation Construction Superintendent, ad-
vised the commission that the oil company is prepared to start on the
project as soon as the Use. Permit is granted.
In studying the specifications, the Commission raised the following
point:
"Is it customary to have the gasoline islands so close to the
sidewalk - that is, 10 feet?"
Mr. Blandin stated the distance is ample. He observed further that
the plans as submitted show A. C. sidewalk on Broadway which will be
changed to concrete sidewalk.- Also, the sign centered on the Broadway
island is a 31x121 double-faced neon sign on the Broadway side.
Building Inspector Watson advised the Commission the fire department
has approved the plans.
Moved by Commissioner Mitchell and seconded by Commissioner Martin that
the Commission recommend to the City Council that the Use Permit be
granted. Motion carried unanimously on roll call of members.
4. STANDARD OIL COMPANY - USE PERMIT
PROPOSED SERVICE STATION - PORTION LOT 52 BLOCK 1,
MILLS ESTATE #1.
A letter dated September 19, 1955, was read from Robert J. McGahie,
attorney at law, requesting a one year extension from October 6, 19550
on the above Use Permit. Mr. McGahie explained that the need for the
service station has been postponed because of the delay in the ad-
jacent housing development and shopping center.
Moved by Commissioner Kindig that the Commission recommend to the City
Council that the request be granted seconded by Commissioner Mitchell
and carried unanimously on roll call of members.
5. SIGN ORDINANCE.
A communication dated September 24, 1955, was read from Mr. W. John-
son, H. Jackson, and J. P. Hartnett, residents of Toyon Drive pre-
senting a proposed addition to Section 1851, Permits, paragraph a;
also a proposed change in Section 1855, Prohibited Signs, paragraph
g, of the above ordinance. The letter was held for discussion.
Planning Consultant Mann advised the Commission he has recently re-
ceived considerable material for study and, in particular, the Plexi-
Glass Company has been very helpful covering the use of plastics.
After Commission discussion of the amendments and additions as pre-
sented by Planning Consultant Mann, the Chair asked for comments
from the floor.
Mr. Walter Johnson spoke with reference to Section 1855 "Prohibited
Signs". It was his contention that property owners should be no-
tified and a public hearing held in all instances where the Building
Inspector has referred an application to the Planning Commission for
consideration - as provided for in Section 1855 - paragraph g.
The City Attorney, in response to a question from the Chair, stated
that when, in the opinion of the building inspector, a proposed sign
will or might constitute a nuisance, and a reference is made to the
planning commission, such reference will be set for hearing and that
hearing may be with or without notice to those affected.
The question was raised as to the course of action after a permit
has been granted for a sign which is later protested as a nuisance.
The City Attorney maintained that "once the building inspector has
issued a permit - that is it so far as the City is concerned. The
power of abatement rests in the people in the neighborhood."
Mr. Carl Smith, resident of Toyon D ive, expressed objection to the
ordinance stating, in his opinion, Ehe ordinance could be more re-
strictive.
Planning Consultant Mann observed that there are certain projects
in process which are tremendously important to the whole community
and he hesitated to write an ordinance which would tend to dis-
courage the development of commercial and light industrial districts.
After some further discussion, it was moved by Commissioner Martin
and seconded by Commissioner Kindig that the Commission approve the
Sign Ordinance and recommend it to the City Council, with its amend-
ments and additions, for its approval and action. Motion carried
unanimously on roll call of members.
COMMUNICATIONS:
1. BURLINGAME CITY COUNCIL RE: Electrical Products Corp.
Roof Sign - 940 Carolan Avenue
A communication dated September 20, 1955, was read from the City
Council referring to the Commission for further consideration the
matter of the above application.
Planning Consultant Mann expressed the opinion that the application
should be reconsidered at a later meeting and that all parties in-
terested should be notified.
Commissioner Kindig expressed opposition to this suggestion; Com-
missioner Mitchell concurred and moved that the Commission reiterate
its past action to recommend denial of the application.
Motion lost for want of a second.
Moved by Commissioner Martin that the matter of the application be
tabled until such time that the Electrical Products Corporation takes
fiction to bring it'to the attention of the Commission; seconded by
Commissioner Kindig;

2. CORPS OF ENGINEERS, U.S. ARMY, SAN FRANCISCO DISTRICT
Public Notice #56-16 dated September 19, 1955, was read with refer-
ence to application for permit to construct a fill and cover levee
in San Francisco Bay at Burlingame filed by Director of Public Works
Marr.
Mr. Marr stated the application is in conformance with the City
Council proposal to contemplate the development at a future time of
a small boat harbor within the breakwater. The communication was
filed.
There being no further business for consideration, the meeting was
regularly adjourned at 10:20 P.M.
