The meeting was called to order at 7:30 P. M. by Chairman Henderson.
First order of business was to set the time and place for the hear-
ings of:
(1) Proposed subdivision of lots 12 and 20, block.3, Glenwood
Park Subdivision, City of Burlingame, owner Frank R. Knippenberg.
Set for July 29, 1954, at 8:30 P. M.
(2) Approval of the final map of the northerly section of Hills-
dale No. 1. Set for July 29, 1954, at 8:00 P. M.
(3) Proposal of Leslie D. Saign to construct a new driveway at
1088 North Lane, Burlingame. Set for July 29, 1954, 9:00 P. M.
Hearing was held on the application of Oscar Person for a variance
of the zoning regulations of the City of Burlingame for the granting
of a permit for commercial purposes, i.e., erection, construction
and maintenance of a service station on that property on the east
side of Broadway, north of the Southern Pacific Co. right-of-way, at
the corner of the intersection of Broadway with Bayshore service road.
Request for variance necessary because the proposed station would be
1.4.36 feet from the nearest existing gasoline service station, and with-
in:212 feet of a proposed gasoline service station for which a permit
has been issued. The variance is requested to Sec. 1973, paragraph
3 of Ordinance 539, which requires "that there be a distance of 490
ft., exclusive of width of intervening streets between the closest
boundaries of any existing gasoline service stations.
Mr. Arthur Barrett and Mr. Daniel Creedon, speaking for the owner,
presented sketches of the proposed building and pointed out that by
using this land as a service station, it would eliminate the present
eyesore, leaving an open type construction, reducing danger from
traffic accidents and that it would not interfere with the operation
of the station operated on the opposite side of Broadway.
Mr. Orrin Gesas, representing the Burlingame Shore Land Company and
the Union Company opposed the variance on the grounds that it would
interfere with the operation and commercial value of their station.

Mr. James Himmel spoke in favor of the granting of the variance.
Messrs. George.Marr and George Mann had no objections to the grant-
ing of the variance, but recommended that the developer obtain a
letter from the Division of Highways that access to the service road
would be granted.
The following motion was made by Commissioner Simonds, seconded by
Commissioner Martin: "That the Planning Commission recommend to the
City Council that a variance for this service station be granted, with
the mandatory stipulation that an agreement in writing from the Div-
ision of Highways that access would be given the developer to the ser-
vice road and that bonstruction of the building would be in accordance
with modern practice - i.e. small signs, landscaping, etc. It was
carried by the following vote.

The next order of business was a hearing for a variance of Section
1973 of ordinance No. 539, for the erection, construction and main-
tenance of a gasoline service station upon that property of the City
of Burlingame, County of San Mateo, State of California, described
as follows: "a portion of Lot 5, Block A, Easton Industrial Subdivis-
ion, Burlingame."
Mr. Walter Hunter, representing the owner stated that the same reason-
ing applied to this permit as those given for granting the permit to
Mr. Oscar Person, and, that because of the divided roadway on Broadway,
the construction of a gasoline service station across the street from
the one for which permit was granted was compatible to the traffics
pattern. Messrs. Marr and Mann stated that because of the proposed de-
velopment of Rollins Road and Whitethorn Way this particular lot would
be reduced from 130 feet to approximately 75 feet along Broadway. Upon
the suggestion of Commissioner Simonds, Mr. Hunter agreed to postpone
his request for a variance until he had had an opportunity to consult
with the prospective lessee, the General Petroleum Uompany and the City
Engineer, as to the feasibility of constructing a gasoline service sta-
tion upon the smaller lot. Re -hearing set for the regular August meet-
ing.
Next order of business was a hearing on the classification of a portion
of unimproved and unclassified land in the City of Burlingame, County
of San Mateo, State of California, commonly designated "Mills Estate"
and described as follows: "363.21 acres, more or less, bounded on the
northeast by the Southern Pacific right-of-way, southeast by Burlin-
game Village, Peninsula Hospital, Ray Park and Burlingame Manor, on
the southwest by Skyline Boulevard and on the northwest by dividing
line between Burlingame and Millbrae."
Mrs. Davidson of Westmoor Road, questioned the type building the devel-
oper intended to erect immediately to the north of Burlingame Village,
and stated her objection to commercial development in this area.

Mr. James Himmel object to the area being zoned as C-2 and requested
that it be zoned R-1, and joined with Mr. Richard Broback in wanting
to know who proposed zoning other than R-1 in the entire area and ob-
jected because the Commission had failed to call upon the developer's
representative to state his reasons for C-2, C-3, R-3 and R-2 zoning.
Mr. George Mann stated that the original agreement between the City
of Burlingame, City of Millbrae and the Atlantic Life Insurance Com-
pany resulted in the establishment of interim zoning and that this
hearing was granted to establish permanent zoning of this area. He
further stated that the permanent zoning would follow the zoning as
set forth in the original agreement, without manor variances. This
statement was concurred in by Mr. Karmel, City Attorney.
Mr. L. E. Weisenberg-spoke for the developer, stating that the map, as
presented, is the work of the citizens of Burlingame, the Planning Com-
mission and that the..developer has agreed to any changes proposed by
the Commission and the citizens, as individuals and in groups. He
further stated that the developer has no objection to now changing
that area adjoining the proposed elementary school from R-3 to R-2.
Mr, Walter J. Bates, Mr. Milklein, Mrs. Broback and Mr. Holman, res-
idents of Ray Park, and Mr. James Himmel, objected to the R-3 zoning
adjoining the proposed elementary school. They also requested that
a height limitation of less than 25 feet be imposed on the buildings
in that area.
The following motion was made by Commissioner Mitchell: "ghat the
Planning Commission recommend to the City Council approval of zoning
as shown on that attached map for the property described above, with
the modification that R-3 zoning south of Trousdale Avenue be changed
to R-2". The motion was seconded by Commissioner Mattock and carried
by the following vote:
Ayes: Commissioners: Henderson -Martin -Mattock -Mitchell -Simonds
Abstaining: Commissioner Stivers
Absent: Commissioner Diederichsen
A Study Meeting was scheduled for Thursday, July 22, 1954, to discuss
revision of Ordinance No. 539.
